These Regulations may be cited as the Insurance (Amendment) Cin Regulations, 2020. 2, The Fifteenth Schedule to the Insurance Regulations is Sb Lee amended— (a) in Part A by deleting the expression “31st December, 2020” appearing in the proviso to paragraph 11 and substituting therefor the expression “3 st December, 2025”, (b)_ in Part B by deleting the expression “31st December, 2020" appearing in the proviso to paragraph $ (i) and substituting therefor the expression “3st December, 2025”, Made on the 24th August, 2020. LEGAL NorIcENo. 218 ‘THE PUBLIC FINANCE MANAGEMENT ACT (No. 18 of 2012) IN EXERCISE of the powers conferred by section 24(4) of the Public Finance Management Act, 2012, the Cabinet Secretary for the National Treasury and Planning makes the following Regulations— ‘THE PUBLIC FINANCE MANAGEMENT (KENYA ENERGY- SECTOR ENVIRONMENT AND SOCIAL RESPONSIBILITY PROGRAMME FUND)(AMENDMENT) REGULATIONS, 2020 |. These Regulations may be cited as the Public Finance Management (Kenya Energy-Sector Environment and Social Responsibility Programme Fund) (Amendment) Regulations, 2020, 2. Paragraph 2 of the Public Finance Management (Kenya Energy-Sector Environment and Social Responsibility Programme Fund) Regulations, 2007 herein after referred to as the “principal. ist2vor Regulations” is amended in the definition of “officer administering the 2492 Kenya Subsidiary Legislation, 2020 Fund” by deleting the words “Permanent Secretary” and substituting therefor the words “Principal Secretary”, 3. Regulation 3 of the principal Regulations is amended in paragraph (2)(b) deleting subparagraph (vi) and substituting therefor the following new paragraphs— (vi) Energy and Petroleum Regulatory Authority; (vi) Rural Electrification and Renewable Energy Corporation; (ili) Kenya Electricity Transmission Company; (x) Geothermal Development Company; and (x) Nuclear Power and Energy Ageney 4. Regulation 4 of the principal Regulations is amended by adding the following new paragraphs— (©) promoting alternative energy technologies for environmental conservation; and (@ improving livelihoods through sustainable use of energy and environmental resources. S. Regulation 4 of the principal Regulations is amended by deleting the word “Minister” and substituting therefor the words “Cabinet Secretary”. NOTICE No. 219 ‘THE STAMP DUTY ACT (Cap.480) EXEMPTION IN EXERCISE of the powers conferred by section 106 (1) of the Stamp Duty Act, the Cabinet Secretary for the National Treasury and Planning, on the recommendation of the Cabinet Secretary for Lands and Physical Planning, directs that the instruments executed in respect Of transactions relating 10 the Project Agreement for the Nairobi Expressway Project between the Kenya National Highways Authority ‘and the China Road and Bridge Corporation, shall be exempt from the provisions of the Stamp Duty Act Dated the 25th November, 2020. Kenya Subsidiary Legislation, 2020 LLBGAL NOTICE No.220 THE PUBLIC PROCUREMENT AND ASSET DISPOSAL ACT (No. 33 of 2015) IN EXERCISE of the powers conferred by section 180 of the Public Procurement. and Asset Disposal Act, 2015, the Cabinet Secretary for the National Treasury and Planning makes the following Regulations — THE PUBLIC PROCUREMENT AND ASSET DISPOSAL. (AMENDMENT) REGULATIONS, 2020 1. “These Regulations may be cited as the Public Procurement and Asset Disposal (Amendment) Regulations, 2020. 2. The Public Procurement and Asset Disposal Regulations, 2020 (in these Regulations referred to as the “principal Regulations") are amended in regulation 91(2)(b) by deleting the expression “39” and substituting therefor the expression “29” 3. Regulation 141 of the principal Regulations is amended by deleting paragraph (5) and substituting therefor the following Paragraph— (5) “A. procuring entity shall seek legal advice or clearance from the Attorney General in case of the national government entities, or head of legal services in case of Parliament, Judiciary and county government before terminating a contract under the Act or these Regulations”, 4. Regulation 183 of the principal Regulations is amended. by deleting paragraph (2) and substituting therefor the following Paragraph — (2) “Sale by public tender shall be conducted in accordance with the rules and procedures of open tender envisaged under sections 7, 75,16:77 78,79 80 81 82:83 848586 and 87 ofthe Act”. 5, Regulation 223 of the principal Regulations is amended by deleting paragraph (2) and substituting therefor the following Paragraph— (2) “A person who contravenes any provisions under paragraph (1) or the code of ethics prepared by the Authority lunder section 181 of the Act commits an offence under the ‘Act and these Regulations”.
