MUNICIPAL ORDINANCE NO.

08-2017

AN ORDINANCE AMENDING THE TITLE AND SOME PROVISIONS OF


THE MUNICIPAL ORDINANCE NO. 08-2017, “AN ORDINANCE
ENACTING THE REVISED TRAFFIC AND TRICYCLE MANAGEMENT
CODE OF PULILAN, BULACAN”

WHEREAS, Article II Section 10 of the Constitution of the Republic of


the Philippines provides that the State shall promote social justice in all phases of
national development;

WHEREAS, the Local Government Code of 1991 requires the local


government unit to maintain its residents' safety, peace, and order as well as their
comfort and convenience;

WHEREAS, Section 3 (b) of the same Code affirms that every local
government entity shall develop an accountable, effective, and dynamic
organizational framework and operating system that will satisfy the communities'
top priorities and service needs;

WHEREAS, the Sangguniang Bayan of Pulilan acknowledged the private


sector's ability to make a substantial contribution to the planning and execution of
traffic, transportation, and communication management plans and programs in the
Municipality of Pulilan, Bulacan;

NOW, THEREFORE, BE IT ORDAINED, by the Sangguniang Bayan


of Pulilan, in session assembled that:

SECTION 1. Title

This Ordinance shall be known as “An Ordinance Amending Some


Provisions of the Pulilan Revised Traffic Code of 2017”

SECTION 2. Amendments

The Section of the Municipal Ordinance No. 08-2017 to wit:

a. SECTION 1. TITLE. This ordinance shall be known as “MUNICIPAL TRAFFIC


AND TRICYCLE MANAGEMENT CODE OF PULILAN, BULACAN”.

“MUNICIPAL TRAFFIC MANAGEMENT CODE OF PULILAN, BULACAN”.
b. SECTION 6. CREATION OF MUNICIPAL TRAFFIC MANAGEMENT
OFFICE. There shall be created a Traffic Management Office (TMO)

a. FUNCTIONS – The Traffic Management Office shall have the following


functions:
1. Planning, organizing, coordinating, supervising traffic movement. Execute
measures within the municipal limits, and whenever feasible and possible
recommend such measure to the Municipal Mayor. The duties and functions of
the TMO shall include but not limited to traffic maintenance and orderliness. The
TMO shall efficiently address any and all problems relative to the regulation and
enforcement of traffic rules and regulations.
2. TMO shall issue franchise for motorized tricycles for hire operating within the
Municipality of Pulilan.
3. The TMO shall be in charge of the settlement of disputes among Public Utility
Vehicles (PUV’S) and the decision of the TMO shall be appealable to the
Municipal Traffic Enforcement and Management Board.
4. All disputes with criminal liability will be directly referred to the appropriate
court.

c. SECTION 11. THE SANGGUNIANG BAYAN. The Sangguniang Bayan shall:


a. Appropriate the necessary funds for the acquisition of traffic signs or indicators
to implement this code and other traffic rules and regulations;
b. Appropriate the necessary funds for installation and maintenance of high-
definition Close Circuit Television/CCTV along national highway of Pulilan;
c. Appropriate funds for the maintenance of street lights;
d. Appropriate funds for establishing the Traffic Management Office (TMO).

Bayan shall:

a. Appropriate the necessary funds for the acquisition of traffic signs or indicators to

c. Appropriate funds for the maintenance of street lights;

d. SECTION 51. RENEWAL OF FRANCHISE. The TMO shall start to accept


renewal of franchise one (1) month before the date of the expiration. A surcharge
of 25% plus 2% interest monthly from the annual supervision and processing fees
but not to exceed 36 months shall be collected from the operators with expired
franchises who will apply for renewal.

SECTION 51. RENEWAL OF THE FRANCHISE. The Sangguniang
Bayan Office shall start to accept renewal of franchise one (1) month before the
date of the expiration. A surcharge of 25% plus 2% interest monthly from the
annual supervision and processing fees but not to exceed 36 months shall be
collected from the operators with expired franchises who will apply for renewal.

e. SECTION 52. PUBLIC MOTORIZED TRICYCLE FOR HIRE. The color


scheme assigned by the TMO shall be adopted to identify the areas of operation
of the different tricycle associations. The sidecar must be painted totally and
uniformly with only one designated color scheme. The tricycle shall bear a body
number assigned by the TMO beginning with ‘001’ to be painted in front, back
and inside the sidecar. The size of the body number must be at least 6 inches in
height, 3 ½ inches in width and 1 inch thick. The name of the TODA must be
printed above the number and “Pulilan” below the number. Side car body made
of stainless sheet plate shall not be allowed due to paint resiliency.

SECTION 52. PUBLIC MOTORIZED TRICYCLE FOR HIRE. The


color scheme assigned by the TMO shall be adopted to identify the areas of
operation of the different tricycle associations. The sidecar must be painted totally
and uniformly with only one designated color scheme. The tricycle shall bear a
body number assigned by the federation beginning with ‘001’ to be painted in
front, back and inside the sidecar. The size of the body number must be at least 6
inches in height, 3 ½ inches in width and 1 inch thick. The name of the TODA
must be printed above the number and “Pulilan” below the number. Side car body
made of stainless sheet plate shall not be allowed due to paint resiliency.

f. SECTION 75. ZONE TRANSFER. Transfer to another zone shall be permitted


upon written application by the registered owner with the TMO stating his
willingness to surrender/terminate his tricycle franchise, body number of the unit
and his intention to apply for a new franchise to another zone. The franchising
requirements for new application shall be required.

permitted upon written application by the registered owner with the Sangguniang
Bayan Office stating his willingness to surrender/terminate his tricycle franchise,
body number of the unit and his intention to apply for a new franchise to another

g. SECTION 76. SUSPENSION OF OPERATION. An operator wishing to stop


service completely, or suspend service for more than one month, should report in
writing such termination or suspension to the TMO, which originally granted the
Franchise/MTOP prior thereto.

h. SECTION 78. TRANSFER AND / OR DROPPING OF FRANCHISE. The


franchisee must notify the Pulilan Traffic Management Office (TMO) in writing
within ten (10) days prior to the intended sale of the tricycle unit with franchise
stating therein the reason/s. As a consequence, the vendor/franchisee is barred
from applying another franchise.
The vendee who wishes to operate in the same must apply with the TMO
for the franchise under his/her name within the period of thirty (30) days from the
date of sale, otherwise, the vendee loses the priority right over the said franchise
and the franchise of the sold unit shall be automatically dropped in favor of the
TMO.
A franchise/tricycle operator who sold the tricycle unit without waiving

i. SECTION 79. EXPIRED FRANCISE. Franchise issued to public motorized


tricycle for-hire operators which had expired for more than six (6 months) shall
automatically dropped from service without a need for the notice of demand for
its renewal and the franchisee shall be subject to surcharges and other fees as
assessed by the TMO. The same rules shall apply with regard to franchise issued
to utility/private motorized tricycle. Franchise slots which were automatically
dropped, subject to the approval of the TMO upon terms and conditions in the
interest of justice and equity, filled up by qualified applicants upon
recommendation of the TMO with the confirmation of the Sangguniang Bayan.
Those persons with without franchise should be given priority and preference to
the vacant slots, provided that that they possess all qualifications and none of the
disqualifications mentioned in this Code for the issuance of tricycle franchise.

The same preference and the priority with the same conditions for the
same stated in the preceding paragraph shall likewise apply to open-slots in each
Pulilan TODA.

j. SECTION 80. DEATH OF FRANCHISEE. The franchise of the deceased may


be transferred to the qualified operator/driver under this Code and may apply
before the TMO within thirty (30) days after the death of the franchisee, for the
transfer of franchise ownership under his/her name provided that the same be
made on or before the expiration thereof. The priority beneficiary or family
member who wishes to continue the operation of the franchise in the same zone
must apply with the TMO for a transfer thereof under his/her name. In addition to
the documentary requirements aforementioned in the subject ordinance, the
applicant must present the death certificate of the deceased and letter of intent to
continue the franchise operation.

k. SECTION 81. MULTIPLE FRANCHISE. In case of sale of any but not all the
units with franchise, franchise of sold unit/s will be automatically dropped from
the service and the vendee who wishes to operate must apply with the TMO for a
franchise under his name.
The franchisee shall be barred from applying a new franchise but this is without
prejudice to the franchise of other units unsold which may be the subject of
renewal of application.

l. SECTION 82. FRANCHISE AMENDMENT/S CHANGE OF TRICYCLE.


Change of ownership of unit or transfer of MTOP/Franchise shall be construed
as an amendment to MTOP/franchise and shall therefore require appropriate
approval of the TMO. Changing of units, as a condition precedent to the approval
of same require the submission of the evidence showing the condition of the
motorcycle sought to be replaced-such as but not limited to pictures, affidavits
and certification of the TODA President and shall state the reason/s for such
changing of unit.
Change of tricycle units due to dilapidation and/or being not roadworthy
does not affect the franchise granted to the operator.

SECTION 82. FRANCHISE AMMENDMENT/S CHANGE OF


TRICYCLE. Change of ownership of unit or transfer of MTOP/Franchise shall

m. SECTION 86. PENALTIES FOR SERIOUS ILLEGAL ACTS OF


OMISSIONS OF DRIVERS OF MOTOR VEHICLES:
a. Disregarding any traffic signs, such as “No Left Turn”, “Do not Enter”, “No
loading or Unloading”, “No Blowing of Horns” and other traffic signs.

n. SECTION 89. PENALTIES FOR OTHER VIOLATION. Any violation


committed by the driver or operator of motorized tricycles shall be subject to the
following penalties, provided that for meritorious reason/s humanitarian
consideration, the Municipal Mayor may grant partial or total condonation
thereof:
1. Carrying of explosives, firearms or other deadly weapon ₱2,500.00
2. Operating dirty or dilapidated unit ₱300.00
3. Driving a motorized tricycle with no LTO License Plate or with improvised plate

₱500.00
4. Driving with no municipal plates, no stickers, no plate number printed I

SECTION 89. PENALTIES FOR OTHER VIOLATION. Any

SECTION 3. REPEALING CLAUSE

If any provision or part of any existing ordinance is not consistent with


this Ordinance, the same is hereby repealed or modified accordingly.

SECTION 4. SEPERABILITY CLAUSE

If for any reason, any provision of this Ordinance is declared


unconstitutional or invalid, the remaining provisions not affected thereby shall
continue to be in a full legal force and effect.

SECTION 5. EFFECTIVITY CLAUSE

This ordinance shall take effect upon its approval and compliance of the
necessary requirements set by law.
