This Warranty only applies to goods distributed by Xylem Water Solutions Australia Pty Limited (Seller) where the Buyer acquires
the goods for his/her own use and not for the purpose of re-supply. This warranty is additional to any rights and remedies that Buyer
may have under the Australian Consumer Law and other laws.

If this Warranty applies, Seller warrants that its goods (with the exception of membranes, seals, gaskets, elastomer materials, coatings,
cutters, cutting plates, impellers, agitators, diffusers, wear rings, volutes when used in an abrasive environment, and other "wear parts"
or consumables all of which are not warranted) will be free from defects in material and workmanship for the applicable period
specified on the attached Warranty Schedule, or if no period is listed, then for a period of one (1) year from the date of installation or
eighteen (18) months from the date of purchase, whichever shall occur first unless otherwise specified in the product documentation.
Seller shall, at its option and at no cost to Buyer, either repair or replace any product which fails to conform with the foregoing
warranty; provided, however, that under either option, Seller shall not be obligated to remove the defective product or install the
replaced or repaired product and the Buyer shall be responsible for all other costs, including, but not limited to, service costs, shipping
fees and expenses. Seller shall have complete discretion as to the method or means of repair or replacement. Buyer’s failure to
comply with Seller’s repair or replacement directions shall constitute a waiver of its rights and render this Warranty void. All
warranty claims must be submitted with an electrical schematic and electrical bill of materials when controls and switchboards used in
conjunction with the equipment are not supplied by Xylem and the failure to provide such documentation shall render this Warranty
void. Any parts repaired or replaced under this limited Warranty are warranted only for the balance of the warranty period on the
parts that were repaired or replaced. Seller’s warranty is conditioned on Buyer giving written notice to Seller of any defects in
material or workmanship of warranted goods within ten (10) days of the date when any defects are first manifest.

This Warranty does not apply to any parts of products that: (a) have been subject to misuse, misapplication, neglect, alteration,
accident, or physical damage; (b) have been used in a manner contrary to Seller’s instructions for installation, operation and
maintenance; (c) have been damaged from ordinary wear and tear, corrosion, or chemical attack; (d) have been damaged due to
abnormal conditions, vibration, failure to properly prime, operation without flow, or due to infiltration or inflow; (e) have been
damaged due to a defective power supply or improper electrical protection, or power supply failure; (f) have been damaged resulting
from the use of accessory equipment not sold by Seller or not approved by Seller in connection with products supplied by Seller,
including Xylem supplied electrical cables, monitoring and motor protection devices, or (g) system design or pump size as it is the
sole responsibility of Buyer to confirm its selection is appropriate for the specific application. This Warranty does not apply to
products not manufactured by Seller; however, Seller will extend to Buyer any warranty received from Seller’s supplier of such
products.

Statutory rights
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or
refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the
goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

To the extent our goods are not of a kind ordinarily acquired for personal, domestic or household use or consumption, then we limit
our liability to repair or replacement of goods or the payment of the cost of repairing or replacing goods, or supplying services again
or payment for the cost of supplying services again, in accordance with section 64A of the Australian Consumer Law.

Limitation of liability
SUBJECT TO THE BUYER'S STATUTORY RIGHTS AS SET OUT ABOVE AND OTHERWISE TO THE EXTENT
PERMITTED BY LAW, BUYER’S EXCLUSIVE REMEDY AND SELLER’S AGGREGATE LIABILITY FOR BREACH OF
THIS WARRANTY ARE LIMITED TO REPAIRING OR REPLACING THE PRODUCT AND SHALL IN ALL CASES BE
LIMITED TO THE AMOUNT PAID BY THE BUYER HEREUNDER AND IN NO EVENT IS SELLER LIABLE FOR ANY
OTHER FORM OF DAMAGES, WHETHER DIRECT, INDIRECT, LIQUIDATED, INCIDENTAL, CONSEQUENTIAL,
PUNITIVE, EXEMPLARY OR SPECIAL DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFIT, LOSS
OF ANTICIPATED SAVINGS OR REVENUE, LOSS OF INCOME, LOSS OF BUSINESS, LOSS OF PRODUCTION,
LOSS OF OPPORTUNITY OR LOSS OF REPUTATION.

The terms of this warranty policy may be inconsistent with the warranty statement in the product owner’s manual. To the extent of any
inconsistency other than warranty duration, the terms of this warranty shall prevail.

NOTE: In certain cases excluding Flygt dewatering pumps (2000 series), Seller may approve the Warranty Start Date as of the equipment start-up
date. In such case, Buyer must comply with the following and Buyer’s failure to do so shall constitute a waiver of its rights and render the Warranty
void: (i) A service technician approved by Seller must be used and must submit a completed start-up report within 30 days of start-up; and (ii) Start-
up must occur within 12 months of the invoice date.
