Facts:

Victim 'G', who was aged 12 years on 20.06.2022 stating that on 04.06.2022 at 2:00 P.M.
when she went to buy 'dahi' from the shop of Singh, which was nearby her house and kept her
hand on the counter of the shop, the accused/applicant started to touch her chest and also told
her not to tell about it to anyone otherwise he would kill her parents. On this the victim got
scared and did not tell it to anyone. Then, again on 05.06.2022 at about 6:00 A.M., when she
went to buy some eatable from the shop of the accused/applicant, he again touched her chest
and thereafter, on 13.06.2022 at about 6:00 A.M., when she went to buy some milk and chips
etc. for breakfast, then accused open the counter of the shop and he put his hand inside her
shorts and touched her private part. The accused also threatened her not to tell anyone or else,
he would make dirty videos of the victim and make it viral and would also kill her parents. As
a result of the same, her private part use to pain during urination so she told her mother that
she was feeling pain while urination on 15.06.2022 after which her mother took her to
hospital for treatment the next day i.e. 16.06.2022. On 19.06.2022, she told about the acts of
the Singh being done to her to her mother. Hence, the present case is registered under Section
376/506 of the Indian Penal Code, 1860 and Section 4 of the Protection of Children from
Sexual Offences Act, 2012 against the accused/applicant Chob Singh.
The child was studying in 6th grade at the time of the offence at a government school in her
locality, her teachers complained that she had started zoning out. The mother of the child
informed this to the support person and trauma therapy was started for the child.
During the child’s monthly check in with her support person, the child told the support person
that a few weeks after the FIR was filed, police personnel had come and called her out of
class for verification of her birth record as a result everyone in her school got to know about
her abuse. Thereafter they started calling her “POCSO”. Due to the bullying, she dropped out
of school for 2 months. She was currently enrolled in tuition classes as she was unable to get
admission into another school.
Concurrently, the landlords also got to know about the assault and did not want a sexual
assault survivor to be staying in their house as it would bring shame to them. They were
asked to vacate the house in 10 days.
