PETITION
Petitioner LYDIA ROY SASAHARA, through counsel, most respectfully states:
1. Petitioner LYDIA ROY SASAHARA (“SASAHARA”) is of legal age, Filipino, and
a resident of 516 Rosewood Street, Phase 2, Block 17, Lot 4, La Marea Hills
Subdivision, Brgy. San Antonio, City of San Pedro, Province of Laguna. She
is represented in this action by Edrelen C. Gregorio, a Filipino, of legal age and a
resident of P1A Lot 2 Blk 7, Pacita Complex 1, San Pedro City, Laguna, as evidenced
by his Special Power of Attorney, hereto attached as Annex “A”. Petitioner may be
served with notices and other processes of this Honorable Court through the undersigned
counsel.
2. That petitioner SASAHARA is the owner of a parcel of land registered under
petitioner's name LYDIA ROY SASAHARA (“SASAHARA”, for brevity), situated in
Brgy. Dita, Sta. Rosa City, Laguna with an area of 40 square meters, and covered by
Original Certificate of Title (OCT) No. T-709710 of the Register of Deeds for the
Province of Laguna (“PROPERTY”), more particularly described as follows:
““A parcel of land (Lot 41, Blk-13, of the consol./subd. Plan, Pcs-04-012800, being a
portion of the consol. Of all Lots of Nlks.1 to 5, & Road Lots 1 to 5, all Psd-04-011555,
LRC Rec. No., situated in Brgy. Dita, Mun. of Sta Rosa, Prov. Of Laguna, Bounded on
the SW., along line 1-2 by Road Lot 3; on the NW., aling line2-3 by Lot 40, Blk-13,
both of the consol. Subd. Pla; on the NE., along line 3-4 by Lot 1667, Sta Rosa East; on
the SE., along line 4-1 by Lot 42, Blk-13, of the consol. Subd. Plan, containing an area
of Forty (40) SQ. METERS.”
A certified true copy of said OCT No. T-709710 is attached as Annex “B” and a copy of
the pertinent Tax Declaration thereof, are hereto respectively attached as Annexes “C”,
“D” and “D-1” hereof.
3. That the facts and circumstances in relation to the ownership by petitioner
SASAHARA of the aforementioned property which are material to the instant petition,
are as follows:
3.1. The registered owner of the said property is Lydia Roy Sasahara.
3.2. At the time of her stay in Japan as the wife of a Japanese Citizen Kenetsu Sasahara,
her elder sister taking care of all the legal documents of all her acquired properties in the
Philippines.
4. Notably, it was only long after January of this year when the petitioner spend her
vacation in the Philippines and she looked for the original duplicate owner’s copy of
said OCT No. T-709710.
5.1. Specifically, Petitioner searched for said original title from whatever remained of in
her personal files and documents. But after a thorough and extensive search, the former
failed to locate the duplicate original owner’s copy of said OCT No. T-709710 up to the
present. Hence, said OCT No. T-709710, is considered irretrievably lost for all intents
and purposes.
5. That in view of the discovery of the loss of said duplicate original owner’s copy of
said title, said Petitioner, executed an Affidavit of Loss (which is hereto attached as
Annex “E”) which was duly entered and recorded in the Registry of Deeds of Calamba
City and consequently annotated on the last page of OCT No. T-709710, which is hereto
sub-marked as Annex “B-1” hereof).
6. That moreover, petitioner SASAHARA has also continuously occupied, possessed
and exercised acts of ownership over the said property and has paid and updated the
pertinent Real Property Taxes thereon. A copy of the latest Official Receipts showing
advance
payment of the Real Property Tax for the year 2022 for the said property, is hereto
attached as Annex “F” hereof.
7. That the Duplicate Original Owner’s copy OCT No. T-709710 has never been
pledged or otherwise delivered to any person or entity in pledge or to guarantee any
obligation, as
evidenced by the certified true copy thereof (Annex “B”). Neither has it been
confiscated, revoked or cancelled for any violation of law.
8. By way of support to the instant petition, a copy of the Judicial Affidavits of
petitioner’s witnesses, Edrelen C. Gregorio, is hereto attached as Annexes “G” hereof.
PRAYER
WHEREFORE, the petitioner respectfully pray for this Honorable Court to
declare as null and void the Duplicate Original Owner’s copy OCT No. T-709710 which
has been lost, and to order and direct the Register of Deeds for the City of Calamba,
Province of Laguna, after payment to him of the fees prescribed by law, to issue in lieu
thereof a New Owner’s Duplicate Certificate of Title which shall in all respects be
entitled like faith and credit as the original duplicate, in accordance with the applicable
provisions of the Land Registration Law.
Other reliefs just and equitable under the premises are likewise prayed for.
