National Human Rights Commission

Introduction:
The National Human Rights Commission(NHRC) is an embodiment of
India's concern for the promotion and protection of human rights. It was
established on 12 october, 1993. It is mandated to protect the rights and
dignity of Indian citizen.

In brief:
1. Human rights are the basic rights and freedoms that belong to every
person in the world, from birth until death. We have these rights simply
because we exist as human beings and they are not granted by any state
or government or any other.
2. The NHRC is responsible for spreading human rights awareness amongst
the masses and encouraging the efforts of all stake holders in the field of
human rights literacy not only at the national level but at international
level too.
3. Any citizen of the country can file complain of human rights violation in
the NHRC or the State Human Rights Commissions(SHRC). It is notable
that SHRC are independent organizations and are not working under the
NHRC.
4. Illegal Detention, False Accusations, Illegal Arrests, or other police
excesses, Fake-Encounter killings, Custodial Deaths, Atrocities Unleashed
on Prisoners, for long detention on inhabitation condition in jail , Injustice
against Schedule Cast and Schedule Tribe, Child labour, Child marriages,
Demands for dowry, Dowry death, Sexual harassment, Sexual exploitation
of women, Not registering complains, Refusal to take care of old people
by their relatives, Human trafficking , kidnapping, Murder or attempt to
murder, in these type of other criminal act which deals with a legal
provision of punishment , we can file a case in NHRC.
5. The NHRC can take the complaint by the victim or some one from the side
of the victim or some one who is the witness of an act of violence of
human rights or the party of public authority.
6. NHRC can also act on media report relating to violation of human rights.
7. The cases in which National Human Rights Commission does not take
action are, if a complaint is unclear, anonymous or pseudonymous,
complaints barred under Articles 36(1) and 36(2) of The Protection of
Human Rights Act, If the complaint has nothing to do with the
Government Department, Civil disputes such as Property disputes or
agreements related to contracts, Cases on service related issues, Labor or
industrial disputes, Complaint not strictly pertaining to violation of
Human Rights, Sub-Judice cases under a court or a tribunal, When the
case has been already addressed through a judicial or a commission’s
pronouncement, If the complaint has been made to some other authority
and only a copy has been sent to NHRC and if the case of violation of
Human Rights is more than a year old and if the matte is beyond the
jurisdiction of the commission.Here in these issues NHRC can not take
any actions.
8. There is no fees to file a complaint in NHRC.The complaints on plane
paper that carry the name of the complainant, his/her address and
his/her signature and can be send directly to the to the commission on
NHRC address. One can also file a complaint on the website.
9. It seeks to promote e-Governance for empowering citizens by promoting
the inclusive and sustainabl growth of Electronics, IT and ITeS industries.
10. It also aims at enhancing India’s role in Internet Governance and
adopting a multipronged approach that includes development of human
resources, promoting R and D and innovation, enhancing efficiency
through digital service and ensuring a secure cyberspace.
