b. Collective bargaining

Collective bargaining is the process in which working people, through their unions, negotiate contracts
with their employers to determine their terms of employment, including pay, benefits, hours, leave, job
health and safety policies, ways to balance work and family, and more.

Collective bargaining refers to the official process by which trade unions negotiate with
employers on behalf of their members in respect of employees’ terms and conditions of employment.
An example of collective bargaining could be about a pay increase or change in working hours.

c. What are industrial disputes?

Industrial Dispute means any dispute or differences between employers and employers or between
employers and workmen or between workmen and workmen which is connected with the employment
or non-employment or the terms of employment or with the conditions of labour of any person.

Types of Industrial Disputes: Strikes, Lockouts, Picketing, Gherao, Lay Off, Retrenchment and Boycott.

d . Discuss workmen’s compensation Act 1923

An Act to provide for the payment by certain classes of employers to their workmen of compensation
for injury by accident.

The Act was formed after it was noted that laborers were getting more exposed to danger with the use
of advanced and sophisticated machinery. The common law had it that the employer would only take up
the compensation responsibility if it is found that the industrial accident was a result of his negligence.
In India, the issue of compensating workmen after fatal and major accidents hit the road in 1884. It was
then in 1885 that the factory and mining inspectors realized that the Fatal Accidents Act, 1885, was not
enough to attend to the intended purposes.
