1. What are the three main rights of passenger under the Air passenger Bill of Rights?
There are three major rights of passenger covered under issuance, namely; (a) right to be
provided with accurate information before purchase of the ticket; (b) right to receive the
full value of the service purchased; and (c) right to compensation.
A. Right to be informed
The passenger is entitled to a full, fair and cleans disclosure of all the terms
and conditions of the contract of carriage before he or she purchase his ticket.
Remember that upon the purchase of your air ticket, you signify your
acceptance of the terms and conditions stated therein.
C. Right to Compensation
In the case of flight cancellations at least attributable to the carrier, the
passenger has the following rights; (a) to be notified of the fact of cancellation;
(b) be provided with sufficient refreshment, hotel accommodation
transportation from airport to the hotel, free phone calls texts or mails; (c) be
reimbursed of the value of the fare, including taxes and surcharges; (d)
endorsed to another air carrier; or (e) rebooked to the next flight available
without additional charge.
3. When is a common carrier of goods exempted from liability in case of lost or deterioration of the
same?
If the common carrier, without just cause, delays the transportation of the
goods or changes the stipulated or usual route, the contact limiting the
common carrier liability cannot be availed of in case of the loss, destruction,
or deterioration of the goods. Article 1748
4. What are the rights of the passenger in case of flights cancellation attributes to the carrier?
In case of flight cancellations at least attributable to the carrier, the passenger
has the following rights: (a) to be notified of the fact of cancellation; (b) be
provided with the sufficient refreshments, hotel accommodation,
transportation from the airport to the hotel, free phone calls, text or email and
first aid.
5. Why is common carrier required to observe the highest degree of care?
Under the transportation laws, a common carrier engaged in the carrying of
passengers, from the nature of its business and for reasons of public policy is
bound to observed extraordinary diligence to ensure the safety of the
passengers transported by them.
