Steinberg #1846 Richard Althouse Amanda Vielma Raymond Leung Thelma Moya ‘Avens Lemieux Donnie Campbell PREFACE On July 19", 2022, Internal Affairs was notified by Lieutenant Joseph Herb that Officer Kevin Harrell was the subject of a criminal investigation by the West Palm Beach Police Department. Lieutenant Herb and Sergeant Rich Smith advised they had a search warrant for Officer Harrell’s cellular phone. Officer Harrell was immediately placed on administrative leave pending a criminal investigation. On October 5", 2022, Lieutenant Herb advised his criminal investigation was complete and provided all evidence of potential policy violations to Internal Affairs. INQUIRY On July 19", 2022, Lieutenant J. Herb advised me that his unit, Special Investigations Division, Organized Crime Section, was investigating Officer K. Harrell for his potential involvement with a drug trafficking organization, possibly providing information to known associate, Richard Althouse. Lieutenant Herb also believed Office Harrell was divulging information to Amanda Vielma, a social Media Viogger. Officer Harrell was immediately placed on Administrative Leave pending the outcome of the criminal investigation. Association with Richard Althou: The West Palm Beach Police Department’s Organized Crime Section (OCS) began a criminal investigation into the Tanksley Drug Trafficking Organization in September 2020 under WPB PD case number 2020-0014433. The main area of operations was the 900-block alleyway between 3rd and 4" Streets, West Palm Beach. On February 6", 2020, West Palm Beach Detectives arrested over 20 defendants on R.I.C.O. charges, specifically Marcus Tanksley, Vernon Tanksley, Henry Mann, and Avens Lemieux. Both Tanksleys and Mann are stil in jail awaiting trial. Lemieux was released, however he was arrested July 48th, 2022, for attempted murder of his girlfriend by the West Palm Beach Police Department. Richard Clyde Althouse is a convicted felon. Althouse is known to associate with drug traffickers throughout the city for many years. Regarding this investigation, Althouse is seen meeting with both Marcus and Vernon Tanksley, Marcus and Vernon Tanksley are the heads of the Tanksley Drug trafficking Organization operating out of the 900-block alley between 3" and 4” Streets West Palm Beach Florida. The following information is from OCS surveillance and wire intercept logs: On July 14", 2021, Althouse meets with Marcus Tanksley in the alley on the south side of 914 4th Street. On July 21%, 2021, a conversation between Avens Lemieux and Vernon Tanksley was intercepted. Lemieux tells Tanksley that his girl was sending the Police through the alley because they had a domestic dispute. Lemieux tells Tanksley he was going to talk to Althouse to see if he can help. On July 31*, 2021, Althouse arrives in the alleyway with Marc Cutter, another known associate of the Tanksley organization. On August 9", 2021, Althouse is walking around the property of 916 4" St, looking at security cameras. On August 18", 2021, OCS Detectives Negron and Chaves observed Althouse meet with a West Palm Beach Police Officer in a marked unit #X2193 in the parking lot of the United States Post Office located at 640 Clematis Street, West Palm Beach. This meeting was captured on video. Both Detectives positively identified the Officer as Kevin Harrell. Officer Harrell left the meeting and drove to the 900 Block of 5" Street and remained for 3 minutes and 36 seconds. This is the known area of operations for the Tanksley Drug Trafficking Organization. The Avail System, used for tracking marked units confirms this. ‘On August 27, 2021, Althouse submitted a public records request for WPB PD case number 2020-0014433. This case number is the main case number for the drug trafficking case and was not made available to the public, There is no way Althouse should have even known that case number existed to submit a public records request. On August 27, 2021, Althouse was observed walking and talking with Vernon Tanksley in the NE corner of the alley. On September 9th, 2021, Althouse meets with Marcus and Vernon Tanksley and showed them paperwork contained in a paper folder. In March of 2022, a confidential informant told Detective Steinberg that Avens Lemieux, a high-level member of the Tanksley Drug Trafficking Organization told him that he and Richard Althouse met with a uniformed West Palm Beach Police Officer at City Hall for information. On October 10", 2022, at approximately 09:45 hrs., | met with Avens Lemieux at the Palm Beach County Jail. Lemieux told me that he was stopped by police in June or July of 2021. His sister, Yolande Saintil, recorded some of the stop with her cell phone. He stated Althouse called him and met him at the Downtown West Palm Beach Post Office, 640 Clematis Street. They drove to the Palm Beach County Courthouse, where they met a West Palm Beach Police Officer. Lemieux told me he showed the Officer the video and the Officer told him the names of the Officers involved. Lemieux told me the officer was a black male in a standard uniform. | showed him a picture of Officer Harrell. He stated he didn't look like that in person. On October 17%, 2022, after several unreturned phone calls and emails, Captain Michael Deighan and | drove to Sebring, Florida to speak with Althouse. We spoke to a female who advised Althouse was sick and in bed and did not wish to speak fo us. Association with Amanda Vielma Amanda Vielma is a social media Viogger. She publishes videos on her You Tube channel under the name “Acura Amanda’. She is also a self-proclaimed first amendment auditor. The intent of an auditor is to video Police interactions in public and publish these videos to hold the Police accountable. Officer Harrell stated he first met Vielma in October of 2021. He admits he confided in Vielma about incidents that happened to him. He stated his relationship with her was having her pull public records requests on his behalf. He stated he did not approve of her videos. In a text message from Vielma to Harrell sent on June 7", 2022, Vielma characterizes the nature of their relationship stating. “it | didn't take this seriously | would not have invested in you, your situation, blindly pursuing everyone who has done you wrong. | would have made one video like the rest do and move on. Or better yet ask yourself this... if { didn’t care about your safety and livelihood | would have just released videos that would reveal your cards and give defendants a heads up on what we have against them. That Renegades video if released would go viral. | don't care about any of that. This is not about me. This is for what's right and getting justice.” There is a pattern of Vielma targeting specific officers, usually after some type of incident with Officer Harrell. In some cases she appears to ask permission from Officer Harrell to release some videos. There's evidence in their communication that Officer Harrell was colluding with Vielma in what content she released. On October 11", 2022, | spoke with Vielma on the phone. She declined to come: in for a statement. WITNESS STATEMENTS Sergeant R. Smith #1474 On October 24th, 2022, at 1434 hrs., | took a swom taped statement from Sergeant Smith. The interview was conducted in my office in Internal Affairs. Sergeant Smith stated he came to the Organized Crime Section in October of 2021. He was briefed about a meeting OCS Detectives observed between Richard Althouse and Officer Kevin Harrell. This meeting took place on August 18", 2021, at the United States Post Office, 640 Clematis Street, West Palm Beach. Sergeant Smith and Detectives found this alarming as Althouse had been observed multiple times meeting with high level members of the Tanksley Drug Trafficking Organization, operating out of the 900-block alley between 4 and 5!" streets, Members of the organization were also heard talking about Althouse on a wire intercept. Althouse was also present during drug transactions in the alleyway. Sergeant Smith stated that he checked the Avail System used for GPS. tracking of marked units and confirmed Officer Harrell’s assigned vehicle, X- 2193, was in fact at the post office. Sergeant Smith stated after this meeting, Avail showed Officer Harrell’s vehicle drive to the 900 block of 5® St, within 100 feet of the known area of operations for the Tanksley Drug Trafficking Organization. He was there for approximately 3 % minutes. Sergeant Smith stated Sergeant Casey Goetz had mentioned that Officer Harrell asked him questions about OCS overtime which they found odd. Sergeant Smith believed information was divulged after Althouse submitted a public records request for case # 2020-0014433 on August 27, 2021, 9 days after meeting with Officer Harrell. This case number was never published anywhere that Althouse would have had access to even know that case existed. Sergeant Smith stated that in February of 2022, the TANKSLEY R.I.C.0. case was complete and most of the defendants had been arrested. In March of 2022, a Confidential Source approached Detective Steinberg and told him that Avens Lemieux, a defendant in the R.I.C.O. case was heard stating that he had met with a black male West Palm Beach Police Officer at City Hall. Althouse was also present at this meeting. Sergeant Smith stated that Officer Harrell was assigned to City Hall during that timeframe. Sergeant Smith then added that a co-defendant in this case, Henry Mann, proffered a statement on February 254, 2022. During his statement he outlined what role Althouse played in the operation. Sergeant Smith stated in July of 2022, based on the above facts, a search warrant was written and granted for Officer Harrell’s cellular phone. The warrant was executed on July 19", 2022, in Internal Affairs. The phone was turned over to Detective Dusten Campbell, Digital Forensics, for examination. Sergeant Smith stated that software designed to monitor activity was placed on Officer Harrell’s work laptop. This software, Veriato, was monitored by Detective Luttier. Sergeant Smith was aware that Officer Harrell was accessing Officers home addresses and employee profile photos. Detes Campbell #1823 On November 08", 2022, at 10:11 hrs. | took a sworn taped statement from Detective D. Campbell. The interview was conducted in the Internal Affairs office. Detective Campbell is assigned to the Criminal Investigations Division, Digital Forensics. He stated he was tasked by Sergeant Smith with downloading Officer Harrell’s cellular phone. He took the phone to the forensics lab. He stated he was able to extract pictures, phone calls, text messages, and other data. Detective Campbell was able to positively state that approximately 300 images from the phone were either received or disseminated. He could not determine where the images were sent. He stated he maintains the data on a separate server in the digital forensics’ unit. Detective Tucker Luttier #1978 On November 8", 2022, at 12:06 hrs. | took a sworn taped statement from Detective T. Luttier. The interview was conducted in the Internal Affairs office. Detective Luttier is assigned to the Organized Crime Section as a technical Detective. He stated he was assigned by Sergeant Smith the task of arranging to have software installed by IT, that would allow him to monitor Officer Harrell’s assigned laptop activity. The software used was Veriato. The software captured screen shots every few second that would be viewed in a stop action type format. The software also logs keyword searches. He stated monitoring began May 6", 2022, and ended July 14", 2022. The information was saved and stored for review in the future. Thelma Moya Thelma Moya is the ex-girlfriend of Sergeant Malcolm Allison. In June of 2022, Vielma began posting content regarding an incident Moya had with Casey Anthony, another ex-girlfriend of Sergeant Allison. On June 29", 2022, Officer Harrell searched department databases for “Moya, T”. On November 8", 2022, at 17:18 hrs. | interviewed Thelma Moya at her residence. She stated she knew Officer Harrell as he responded to a domestic dispute between her and her ex-boyfriend in 2016. She stated she did not have much contact with him. She has never had any other contact with Officer Harrell since. She stated there is no reason Officer Harrell should be trying to contact her. Donnie Campbell On February 27", 2023, | spoke with Donnie Campbell on the phone, Campbell is the ex-boyfriend of Thelma Moya Officer Harrell refers to in his statement. Campbell corroborated Officer Harrells statement to some extent, that he was upset about Sergeant Allison dating Moya and felt it wasn't right. He stated he and Officer Harrell exchanged numbers. He stated they would talk, and he would see him around town sometimes. Campbell has been living in Texas since 2020. Detective J. Negron # 1892 On November 30, 2022, at 15:06 hrs., | took a swom taped statement from Detective J. Negron, The interview was conducted in the Internal Affairs office. Detective Negron is assigned to the Organized Crime Section. He stated on August 18, 2021, he was involved in a long-term narcotics investigation, His assignment was surveillance. He stated he was in the parking lot of the United States Post Office, 640 Clematis Street. He was talking with Detective Chaves as they were staging. The targets of the investigation were in the 900-block alley way between 4t and 5" Streets. He stated a marked West Palm Beach Police Unit pulled into the parking lot and faced east. He said another vehicle pulled into the parking lot and met with the Officer driver door to driver door. Detective Negron was able to identify the second vehicle as Richard Althouse. He knew him from previous encounters. He also knew that Althouse was involved in the case he was actively investigating. Detective Negron recorded the interaction, After Althouse left, the marked unit turned around and drove out west to Sapodilla Avenue. As the vehicle was leaving, Detective Negron was able to identify the Officer as Officer Harrell. The recording was sent to the case Detective, Detective Tom Viale. Detect Raphael Chaves # 1952 On November 30", 2022, at 15:13 hrs., | took a swom taped statement from Detective R. Chaves. The interview was conducted in the Internal Affairs office. Detective Chaves is assigned to the Organized Crime Section. He stated on August 18", 2021, he was involved in a long-term narcotics investigation. He was conducting surveillance. He and Detective Negron were staging in the United States Post Office parking lot , 640 Clematis Street. He stated they were in unmarked vehicles, He stated a marked West Palm Beach Police vehicle driven by Officer Kevin Harrell, was meeting with another vehicle, driver's window to driver's window. The other vehicle was being driven by Althouse. Detective Chaves stated Althouse was involved in the investigation he was currently assigned to, so he found it odd that he would be meeting with a Police Officer. Detective Chaves had observed Althouse interacting with the targets of the investigation and felt confident that he was aware of the criminal activity. This raised red flags when he saw him meeting with a Police Officer. He stated Detective Negron took video footage. He stated he followed the Officer for a short distance, maybe 3-4 blocks, south of the Police Station. Detective Chaves stated he stopped following Officer Harrell, as he didn't want him to see him. Sergeant Casey Goetz # 1765 On December 1st, 2022, at 11:51 hrs., | took a sworn taped statement from Sergeant C. Goetz. The interview was conducted in the Internal Affairs office. Sergeant Goetz stated in 2021, he was assigned to the Organized Crime Section as a Task Force Officer working with U.S. Alcohol, Tobacco, and Firearms (ATF). He stated he was aware of an active long-term narcotics investigation around 4" Street and Tamarind Avenue involving a wire intercept. He stated during this time Officer Harrell contacted him. He stated this was prior to April of 2021. He stated Officer Harrell was assigned to the Lobby. He stated he would get calls from Officer Harrell from time to time, usually seeking guidance about firearms cases. He stated this call was different. Officer Harrell’s tone was different. Sergeant Goetz felt he was being recorded. He stated Officer Harrell asked him about Organized Crime section overtime during a certain period. The only active case going on during the time frame in question was the Tanksley Drug Trafficking Organization. Officer Harrell asked why they were committed to that case for so many hours. He stated Officer Harrell asked him “why are you always targeting these guys on 4" and 5" Street?” He also asked him “Why do you have a problem with Richard Althouse?”. Sergeant Goetz told Officer Harrell that Althouse was with the targets all the time and was “guilty by association’. Sergeant Goetz also knew that Althouse was a convicted Felon. Sergeant Goetz stated he told Officer Harrell that Althouse was a convicted Felon. Detective Matthew Steinberg # 1846 On December 2nd, 2022, at 13:47 hrs., | took a sworn taped statement from Detective M. Steinberg. The interview was conducted in the Internal Affairs office. Detective Steinberg is assigned to the Organized Crime Section. He stated he has a confidential source who told him in March of 2022, Avens Lemieux told him about a meeting he had with Richard Althouse and a West Palm Beach Police Officer. He stated Althouse met Lemieux at City Hall. He stated Althouse told him to stay out of sight. He stated a West Palm Beach Police Officer approached him and said, “Do you know who | am?". They discussed an incident where Lemieux was stopped, and drugs seized from him. The meeting was to get information from the Officer to help Lemieux with a lawsuit. Lemieux had a cell phone video his sister took of the stop. He showed this to the Officer. Lemieux told the source that the Officer was working at City Hall because he got in trouble. The Officer was to then contact Althouse with any information. The source said Althouse regularly uses this Officer for information. Subject Officer Statement Officer Kevin Harrell #1637 On February 24”, 2022, at approximate 14:05 hrs., Sergeant Dan Tumer of Internal Affairs took a sworn taped statement from Officer Kevin Harrell. The interview was conducted at the West Palm Beach Police Department Internal Affairs office. Officer Harrell was represented by his attorney, Rick King. Sergeant Turner confirmed with Officer Harrell if he had an opportunity to review all case file materials prior to the interview. He answered yes. Officer Harrell was asked how he met Richard Althouse. He stated he met him years ago while working in Patrol. He described his relationship as amicable and he did not know what Althouse did for a living. He was asked if he knew if Althouse was a convicted felon. He stated no, he had not seen any evidence of that. He was asked if he knew Althouse was a "street lawyer” and affliated with known drug dealers through out the city. He stated that's “rumored” but he does know that he does legal follow ups. Officer Harrell was asked if he discussed any open investigations with Althouse. He answered, ‘! don’t recall”. Mr. King then clarified, and Officer Harrell said there was one he did remember regarding an injunction hearing involving Althouse and retired Sergeant Gregorian Simonian. That was the only case he discussed with Althouse to the best of his recollection, He was then asked if he ever released any information to Althouse or anyone else that he could have only obtained by way of his position as a West Palm Beach Police Officer. Mr. King attempted to clarify the question. Officer Harrell was asked again if he had released any information to Althouse or any other third party, confidential or not available to the public at that time. He answered, “to my knowledge, | have not’. Officer Harrell was asked why he met with Althouse on August 18", 2021, in the United States Post Office parking lot in the 600 block of Clematis St. He stated he was obtaining public records request that Althouse had pulled for him. He was asked if he was aware of an OCS drug investigation in the 900 of 5" Street or the Tanksley Drug Operation. He stated he was not. He was asked why on August 18", 2021, he drove to the 900 Block of 5" Street after he met with Althouse. He stated before he left the station, he told Lieutenant Rideau that he had a contact which gave him a tip about the homicide of a 1 year old that occurred on 4" St. He stated he went over to follow up on the tip. Officer Harrell was asked if he ever accessed Telestaff or other police programs to research OCS overtime and look for associated case numbers. He answered, “absolutely not’. He was asked if he knew Avens Lemieux. He answered yes. He was asked if he ever met with Avens Lemieux and Althouse. He answered yes. He stated the meeting was with Althouse about a public records request he had asked him to obtain. He stated Lemieux was not present, he stayed outside while Harrell spoke with Althouse. This took place at City Hall, He was asked if Lemieux showed him a video and asked him to identify police officers. He stated he didn’t recall him doing that. He stated to the best of his knowledge he had never met Lemieux before. He was asked why he ran Lemieux’s driver's license on July 15%, 2022. He stated when he met Lemieux, he was skeptical as he didn’t want anyone around him or Althouse while he was making public records request on his behalf. He said he found out his name and wanted to research him to see if he was on “a good team or bad team’. Office Harrell was asked if he knew a Zande Reed or ‘Z” Reed. He stated he doesn't recall who that individual is. He was asked why he ran Reed's driver's license. He stated he had no recollection. Officer Harrell was asked why he texted Althouse and asked him to “do what you do” regarding Sergeant Robert Heisser. He stated he wanted Althouse to do public records request on Sergeant Heisser. He stated he knew he did them well and that’s what he meant. Officer Harrell was asked if he knew Amanda Vielma. He stated he did. He stated he met her while working the Walmart Detail in 2021. He stated she approached him and he was upset about being served with an investigation. She saw him crying and checked on him. They began talking. He told her he knew who she was and that he had seen her videos. They spoke about incidents involving him being harassed and retaliated against. He stated she was alone. He was asked if Sergeant Gellin's name ever came up. He stated no. Officer Harrell was asked if he ever provided Vielma with any Officers departmental or personal information. He answered no, she provided him that information. He denied providing her shift or overtime schedules of Officers. He was asked if he ever provided Vielma with any information containing incidents involving West Palm Beach Police Officers that she could use on her YouTube channel. He did explain to her about the officers that harassed, discriminated, and battered him. He named the Officers to her. He stated he asked her to do public records requests on his behalf for his files. He stated he did not specifically tell her to use these incidents for her You Tube channel. Officer Harrell was asked why he looked up Sergeant Brian Gellin's address on May 9", 2022. He stated he received an anonymous letter. He stated he looked up Sergeant Gellin's address to see if he lived near where the envelope was postmarked. He was asked why he accessed Sergeant Gellin's employee profile ‘on May 13", 2022. He stated the same reason. Officer Harrell was asked if he ever provided Vielma with Sergeant Gellin's home address or personal vehicle information. He stated no, she provided him his home address. He stated she got his address from Sunbiz.org. He stated he did tell her he drove a BMW. 10 Officer Harrell was asked to describe his relationship with Sergeant Gellin. He stated “very hostile, uncomfortable, unsafe * and that he's “racist” Officer Harrell was asked why on May 13", 2022, he accessed Officer Michael Rosario and Jaqueline Medina’s employee profile information to include pictures and home addresses. He stated for the same reason he looked up Sergeant Gellin, to compare their home address and zip code with the post mark on a letter he received. He stated he did not recall providing officers personal information with any third party. He was asked if he had any conversations about Officers Medina and Rosario with Vielma. He stated he talked about his "Renegades ordeal’. Office Harrell was asked about his relationship with Officer Rosario and Medina. He stated he never had an issue with Medina until the Renegades incident. He stated he had an issue with Officer Rosario about a disagreement over a use of force Officer Rosario had. Officer Harrell was asked why on June 19", 2022, why he conducted an RMS search on Sergeant Allison. He stated there was a pending injunction hearing involving Sergeant Allison where Officer Harrell was a witness and he wanted to see if there was any documentation. He was asked if he shared Sergeant Allison’s personal information with anyone and he stated, */ did not’. He was asked about his relationship with Sergeant Allison. He stated it was amicable prior to Vielma publishing videos about him. He stated he didn’t know why Sergeant Allison was blaming him for Vielma’s actions and that he stated, “/ did not even have Malcolm in my sights”. Officer Harrell was asked why on June 29", 2022, he searched Thelma Moya in MCT. He met her on a domestic disturbance call involving her and her ex- boyfriend about 4 years ago. He stated the ex-boyfriend told him the next day that he saw Sergeant Allison sitting in a car with Moya and he was upset and thought it was inappropriate. He stated the ex-boyfriend had contacted him several times after the domestic. He stated he saw Moya at a gas station a couple years after. She told him she was living with Sergeant Allison for 2 years, He stated that because he and Sergeant Allison had complained on each other recently, he wanted her full name because of counter complaints he an Sergeant Allison had against each other and the upcoming injunction Sergeant Allison had with Vielma in which Officer Harrell was a witness. He stated he wanted to look up the incident so he could have Moya’s ex-boyfriend's name in case he needed him as a witness. He denied providing Moya’s information to any third party. Officer Harrell was then asked about 10 photos of Driver and Vehicle Information Database (D.A.V.|.D.) information recovered from the photos on his personal phone. He did not recall them. He stated generally, he would take photos to use to complete his report later. He stated that if he had disseminated ML any of the photos , it would have been to a Police Officer. He stated he also in the past has had dispatch send him D.A.V.I.D. photos to identify people in the street, Officer Harrell was asked about Intelligence Bulletins he had photos of on his phone. He stated he did not recall these photos. Officer Harrell was asked about several photos of personnel orders in his photos. He stated they were either downloaded when he opens an email and if they were disseminated it was to police officer. Officer Harrell was asked about a photo of FBI credentials on his phone. He stated it was a former records employee who had been hired as an FBI agent and sent him the photo because he was proud. Office Harrell was asked about a screen shot he received from Sergeant Mcintosh with a list of West Palm Beach Police Officers and things they have been charged with. He stated it was a joke from someone in a training class that he was not present in. Officer Harrell was shown a photo from his phone which was a screenshot of Sergeant Brian Gellin’s home address from the Palm Beach County Property Appraiser website. He stated he was looking for the closest post office to his residence as he was trying to see who sent an anonymous letter. He stated he did send this photo to Vielma Officer Harrell was asked if he discussed this internal investigation with anyone besides his attorneys or investigators, specifically, Richard Althouse, Amanda ielma, or Avens Lemieux. He stated he has not spoken to any of them about this investigation. The interview ended. EVIDENCE REVIEWED Officer Harrells’ Phone Detective Campbell was able to download the contents of Officer Harrell’s cell phone. | was able to identify text messages between Officer Harrell and both Richard Althouse and Amanda Vielma. | was also able to review pictures that were on the phone. Officer Harrell had a photo that appeared to be a screen shot from a social media platform taken on May 10", 2022. The photo had a picture of Laiz Gellin, who at the time was Laiz Amador. The picture was of her profile pic under Jaiz_05, Laiz Amador. A text thread from May 13" , 2022 at 1:09 am (UTC time) starts (See attached for full text thread) The screen shot of the Palm Beach County Property Appraisers website with Sergeant Gellin’s address is attached. On May 13". 2022, Officer Harrell accessed the employee profiles of Officers Medina and Rosario, and Sergeant Gellin, even viewing a picture of Officer Medina in her profile. On May 13th 2022, at 11:22 am UTC, Officer Harrell texted Vielma and tells her Medina, Ros: sent a letter and called DCF on her. Vielma makes the comment Harrell responds “Stand by...got more content for you” On February 27", 2022, | was able to go back and get a timeline of Vielma’s post . On May 3", 2022, Vielma appeared to be targeting Sergeant Allison. Vielma came into the lobby to make a complaint on Lieutenant Matthew Bessette. This was posted on her YouTube channel titled “Let's See Lieutenant Liar Try To Copsplain His Way Out Of This Lie With Internal Affairs! “ She refers to Sergeant Allison as dating "Baby Killer Casey Anthony”. On June 17", 2022, Sergeant Allison and Officer Harrell had a text exchange, in which Sergeant Allison told Harrell to give Vielma a message. ‘On June 19%, 2022, Vielma shows up to Sam's Club while Sergeant Allison is working the off-duty detail. On the same day Vielma posted a video on her You Tube channel titled “Casey Anthony Name Drops EX-Boytriend As West Palm Beach Police Sergeant After Fight With Mistress!” . In this video, Vielma edited footage from April 17". 2022, at Renegades and a video from May 24%, 2021 from another source, possibly TMZ, of Casey Anthony's report that Thelma Moya threw a drink on her. Anthony mentions Sergeant Allison and Moya in the video. On June 25", 2022, Vielma shows up to a detail Sergeant Allison is working at the Meyer Amphitheatre. She confronts him about the text message he sent Officer Harrell, regarding her. She posted this confrontation on her You Tube channel titled “Sergeant And Former Boyfriend Of Casey Anthony Gets Confronted After He Threatens Me & My Family!". During the confrontation, Vielma accuses Sergeant Allison of giving her information to Thelma Moya. In a July 8, 2022 video Vielma posted on her you tube channel titled “Mother Of Casey Anthony Reveals Police Officer Casey Dated Was The Center Of Jealous Love Trianglel’, She embedded Facebook messages from June 27" between herself and Thelma Moya. On June 29", 2022, Harrell searches “Moya, T" in the department database. Thelma Moya is the ex-girlfriend of Sergeant Allison. On July 6", 2022 Vielma filed a petition for an injunction against Moya. Officer Harrell also had screen shots on his phone of what appeared to be a Facebook messenger exchange between Sergeant Allison and an unknown person discussing Thelma Moya. He also had screen shots on a text exchange between Moya and an unidentified person. A review of Officer Harrells’ text message with Althouse revealed Harrell and Althouse have a relationship going back to at least 2017. They appeared to be friends and socialize. Four instances of Harrell giving Althouse information he would have only known, by his position as a West Palm Beach Police Officer and access to Police databases were discovered. On September 16", 2017, Harrell asks Althouse “What can you do with f"*" ass Heisser.” Althouse responds later ‘lil check my files at home. You want me to start viewing his files and shit?” Harrell responds “yea” and “do what you do best ..alot of people will thank you". On November 22, 2020, Althouse texted and asked about an Officer involved shooting. Harrell responded, “The truth: upperman wrestled with a cop and reached up and mistakenly jammed his finger in the cops trigger and fired it accidentally.” On February 1, 202, Harrell sends Althouse a text “1/28/21 @ 22:34:33". Althouse asks “ is that a BOLO”. Harrell responds “yeap” Althouse asks “cool. It's on CAD? Can you send it?”. Harrell responds, “It's on digital text messages called 103s”. Althouse text later “Sorry brother, | erased the text with the ndt/103 info. Please resend it” Harrell resends “01/28/21 @ 22:34”. | searched the MDT messages for that timestamp. Officer Rosario sent a message to all “JUST 14 THERE IS AN UNKNOWN W/M FOLLOWING ALL THE NORTHEND UNITS AND FILMING US ON A SCOOTER. IT IS NOT ALTHOUSE BUT APPEARS TO. BE AN AVID FOLLOWER OF HIS WORK”. On August 20, 2021, Harrell text Althouse ‘guy in the lobby complaining on Rosario” ‘claims Rosario bruised his wrist with the cuffs” “He's having pics taken by the LT.” Harrell was aware of Althouse’s criminal past and that he was a convicted felon. On November 16", 2021, Althouse texted Harrell “Id (sic) work for a lawyer for 500 a week salary” “when they find out about my felonies they pass” “Im (sic) a convicted liar. Innocent, but convicted’. Harrell responded, “If I’m not mistaken | saw a group of convicted felons who area lawyers in South Florida now why don't you reach out to them and see if they can find work”. On March 6", 2023, I reviewed supplement reports from WPB PD Case # 2020- 0014433 pertaining to Avens Lemieux. On September 23, 2022 ,OCS Detectives Senior and Bango interviewed Lakeysia Gadson, Avens Lemieux's girlfriend. In her statement, she mentions a meeting Lemieux had , possibly the meeting with Officer Harrell. Detective Bango wrote “ Gadson said she knew that Lemieux got pulled over and that the police took his marijuana and his prescription. Gadson said Lemieux actually went to the WPB Police station to watch a video, regarding officer taking his marijuana and prescription. Gadson stayed in the vehicle as Lemieux went inside to look at the video. She does not know who Lemieux made contact with inside.” Veriato Report Software was installed on Officer Harrell’s department issued laptop called VERIATO. The software captured screen shots every few seconds to monitor the user's activity. The following activity was noted as questionable: May 6", 2022 — MCT search of case # 22-5577. Victim of this case linked to Vielma’s YouTube channel. No known reason for Officer Harrell to be involved. May 9", 2022 — MCT search for Sergeant Gellin's address. May 13", 2022- MCT search “Medina Allen” in phone directory, searched “Medina” and viewed Officer Medinas’ profile data. Searched “Gellin”, viewed officer profile data. Searched “Rosario”, viewed officer profile data. May 31, 2022- MCT search for “Reed, Z” and "R300980840210". This person Is linked to case WPB PD 2021-9077, Shooting at 905 5" Street and Tanksley. June 15", 2022- MCT search for tag “QVEH96" and “L520000852280", both linked to WPB PD case #2022-8656. Avens Lemieux arrested for attempted murder. No known reason for Officer Harrell to be involved. June 19", 2022- MCT search “Allison, Malcom”. Right clicking on detail number to see which Officer is assigned. In this case Officers Medina and Palacios and Allison. June 28t, 2022- AOL email from “AcuraAmandaProductions” FWD: “Riviera Beach police off BFF Casey Anthony” June 29%, 2022- MCT search “Moya, T°. Thelma Moya is Sergeant Allison’s ex-girlfriend. July 7, 2022- Search Palm Beach County Clerk of Courts for “Allison, Malcolm”. ‘Screen shots for all of the above were printed. | was able to compare witness statements with other information gathered over the course of this investigation. | found several inconsistencies and incidents where Officer Harrell was untruthful: 16 . Officer Harrell was asked if he knew Richard Althouse was a convicted felon. He answered, “! was not aware of that” and ‘I have not seen evidence of that”. This is not true, In a text thread dated 41/16/2021, Althouse told Harrell he can't work for a lawyer because of his felonies. Harrell acknowledges and tells Althouse he saw a group of convicted felons who are lawyers in South Florida and encourages him to reach out to them for work. . Officer Harrell was asked if he ever conversed with Althouse regarding any open police investigations and if he ever released any information to Althouse not available to the public. He answered, “to my knowledge, I have not”. This is not true. There are three examples of Harrell giving Althouse information not available to the public. In a text thread from 8/20/21, Harrell text Althouse that a subject was in the lobby making a compliant on Officer Rosario. He told Althouse the nature of the complaint and that photos were being taken of the person by the Lieutenant. On 11/22/20, Harrelll tells Althouse about a use of force, the suspects’ name and what happened the day of the incident. On 2/4/21, Harrell sends Althouse a MCT message in which Officer Rosario messaged all units that there was a person out filming police. Althouse accidentally deleted it and asked Harrell to re send it, which he does. . Officer Harrell was asked why he drove to the 900 block of 5" Street on August 18", 2021, after he met with Althouse. He stated he received a tip from a contact that the shooters responsible for the Homicide of a 1-year-old that occurred on 4" Street were out on the street. He stated he notified Lieutenant Rideau and Detective Sam. This is not true. This is impossible as the homicide occurred on April 7, 2022, (WPB PD Case# 2022- 4954) | confirmed with Lieutenant William Devito that there were no other 1 year old homicide victims on 4" street. . Officer Harrell was asked if he ever gave Vielma any officers personal information . He stated no, she already had it. This is not frue. The text thread between Harrell and Vielma on May 13%, 2022, is clear, Harrell texted Vielma Sergeant Gellin’s address before she sends it to him. Also, Sergeant Gellin’s address in the property appraiser database is confidential, as he is a police officer. If you were to search his name, nothing would come back. Officer Harrell had to type in the address to pull up the parcel information. . Officer Harrell was asked why on June 19", 2022, He searched Sergeant Allison in RMS. He stated there was a pending injunction hearing involving Sergeant Allison where Harrell was a witness, He stated he wanted to see if there was any documentation. This is not true. A search of the clerk of courts records conducted on February 28", 2022, shows Sergeant Allison did not file his petition until July 1, 2022. It should also be noted that Vielma confronted Sergeant Allison on June 19" while working a detail at Sam's club. 6. Officer Harrell was asked why on June 29, 2022, He searched Thelma Moya. He stated he was making a counter complaint on Sergeant Allison, and he looked up Moya to get her ex-boyfriends name from a call he was on a few years ago because he had complained about Sergeant Allison. This is not true. Officer Harrell had screen shots of a private text exchange between Moya and someone who used to live with her, possibly her ex-boyfriend, Donnie Campbell. Campbell stated he exchanged numbers with Harrell. He knew his name and had his number. A check of Officer Harrell’s contacts in his phone revealed “Donny” 561-312-7970, Donnie Campbell's number. During this time frame, Vielma was posting videos with Moya’s name in them. Vielma and Moya were also having heated Facebook message exchanges. Harrell also had screen shots of a private Facebook messenger exchange between Sergeant Allison and an unknown person discussing Moya. 7. Officer Harrell was asked if he knew of any open OCS investigations in the 900 block of 5 Street. He said he did not. This is inconsistent with Sergeant Goetz's testimony. Sergeant Goetz testified that Officer Harrell asked him about OCS overtime. The only active case at the time was the Tanksley Organization in the 900 block of 5" St. Sergeant Goetz testified that Harrell asked him ‘why are you always targeting these guys on 4" and 5 S12". 8. Officer Harrell was asked if he knows Avens Lemieux, a high-level member of the Tanksley Drug Organization. He admitted to meeting with Althouse and Lemieux, however he stated Lemieux stayed outside. This is inconsistent with Lemieux’s’ story. Lemieux stated he was picked up by Althouse and driven to meet with a uniformed Officer, he stated he showed the officer video of his traffic stop his sister had taken with her cell phone, He stated the officer identified the officers on the video. It should be noted, when | met with Lemieux, | showed him a picture of Harrell but he said he did not look like that in person. Lemieux’s girlfriend also gave a statement on September referencing a meeting in which Lemieux went to WPB PD to watch a video. The confidential source, Lemieux’s giririend, and Lemieux all have a similar story that contradicts Officer Harrell. 9. Officer Harrell was asked how he met Amanda Vielma. He stated she approached him while he was working a Walmart detail and that she was alone. This is inconsistent with his taped sworn statement from March of 2022, under case AD 22-003, where he stated he met Vielma with Ray Leung after they set up a meeting at Walmart. 10.Officer Harrell was asked why on July 15%, 2022, he ran Avens Lemieux's drivers’ license number. He stated that he was skeptical about Lemieux and wanted to know if he was ‘on the good team or bad team”. The meeting with Althouse and Lemieux had to be prior to 18 March of 2022, meaning Harrell waited at least 4 months before he decided to investigate Lemieux. Lemieux was arrested on July 15", 2022, for attempted murder of his girlfriend by West Palm Beach Police Department. It seems questionable that Harrell decided to run Lemieux the same day he’s arrested for attempted murder. 11. Officer Harrell was asked why on May 31*, 2022, he searched Zande Reed in RMS. He stated he had no recollection. This is questionable. Zande Reed was listed as suspect in an attempted murder case on 6/18/21 at 905 5" Street. Marcus and Vernon Tanksley are also associated with this case. (WPB PD Case # 21-9077) 12. Officer Harrell was asked why on May 13", 2022, he searched and accessed Officer Rosario and Officer Medina’s employee profile information. He stated he wanted to compare their address with the postmark on an anonymous letter he received. This is questionable. There is no legitimate reason for him to access Officer Medina’s employee profile picture. CONCLUSION s. Internal Affairs Function Ill, Intemal Affairs Function C. In all investigations, Department members, whether a subject of the investigation or a witness, will answer all questions honestly, completely and to the best of their ability. 1. Refusal to answer questions specifically, directly and narrowly related to the performance of his or her official duties or fitness for duty, will result in additional charges of insubordination. Should such charges be substantiated, the member will be terminated. 2s Officer Harrell /ied in his swom statement in this investigation. S.0.P. I-13, Public Inform: Section IV, H., 1, . The following information about an officer will not be released unless a to Florida State Statute: Officer Harrell released Sergeant Gellin's home address to Amanda Vielma. Rules and Regulations 10-1 Truthfulness Members are required to answer questions truthfully and cooperatively by, or render material and relevant statements to, a competent authority in a Departmental reviews or investigations. (SOP IV-22) Officer Harrell did not answer questions in this investigation truthfully. Rules and Regulations 2-1, Standard of Conduct Members will not engage in conduct on or off-duty which adversely affects the morale or efficiency of the Department or engage in conduct on or off-duty which may destroy public respect for the member and/or the Department and/or destroy confidence in the operation of the municipal service. (SOP I-9) 20 C. Exceptions shall exist to this regulation when necessary to perform official duties or when an immediate family relationship exists between the member and the subject, with knowledge and the approval of the Chief of Police. Officer Harrell was aware of Althouse’s felony status and admitted he knew he ‘was rumored to have been affiliated with drug dealers in the city. Officer Harrell also colluded with Amanda Vielma. He admits to providing her information about Officers he had issues with and was aware that she was posting videos that were intended to destroy confidence in the operation of the municipal service, adversely affecting the morale and efficiency of the Department. Rules and Regulations 6-3,Department Documents and Orders- Confidential Members will consider all Department documents and all special orders confidential unless ordered otherwise. Officer Harrell provided Althouse with an MCT message generated and published by another Officer. Rules and Regulations 8-4, Security of Departmental Business Members will not divulge police information outside the Department, except as required by law or competent authority. The information includes, but is not limited to, that which is contained ice_ records Names of informants, complainants, witnesses and other persons known to the police are considered confidential. (SOP IV-22) Any information obtained by any member through any internal process to include, but not be limited to, recruitment, selection, and/or promotion will be considered confidential and will not be divulged to anyone without prior written authorization from the appropriate Division Commander Officer Harrell divulged information to Althouse and Vielma that was ordinarily accessible only to members and employees.
