Dear Sir:

Greetings!

This is in reference to the Summons you sent on May 10, 2023 in relation to Barangay
Case No. __________ filed by Mr. X for Reckless Imprudence Resulting in Damage to
Property and Physical Injuries.

The truth of the matter is that we have already filed a Complaint over the same incident
against Mr. X in Brgy. _________ and a Certificate to File Action (Attached herein as
Annex “1”) has been released by the said barangay in our favor. Hence, we no longer
want to make any settlement or agreement with the opposing parties.

We are the victims in this incident which can be clearly seen in the dash cam recording,
blotter report and sketch of the incident. Furthermore, it was clearly stated in the
conclusion made by the police investigator in his Investigation Report (Attached herein
as Annex “2”), to quote:

“That based on the facts gathered at the scene, and damages incurred to both vehicles, investigation
reveals that the driver of the GRAY YAMAHA MT-03 with plate number 0601-0159226 was
believed to be at fault for violation of Sec. 44 of R.A. 4136 (Rules of Turning) and Section 48
(reckless driving) of R.A. 4136 and Sec. 54 of 4136 (Obstruction of Traffic) considering that the
BLUE FORD RAPTOR PICK-UP with plate number FAE-9359 is running on a direct
line. . . . . . . .”

Finally, we want to make it clear that we no longer want to meet with the parties and
come to any agreement with them. We will proceed in the filing of the criminal case
before the City Prosecutor of Bacolod City.
