LOAN AGREEMENT WITH REAL ESTATE MORTGAGE

KNOW ALL MEN BY THESE PRESENTS:

This LOAN AGREEMENT WITH REAL ESTATE MORTGATE is made and executed
in the ___________________, by and between:

_____________________ Filipino, of legal age and a resident of __________________,


now and hereinafter called as the CREDITOR-MORTGAGEE".

___________________ now and hereinafter called as the "DEBTOR-
MORTGAGORS".

WITNESSETH

That the DEBTOR-MORTGAGORS is desirous of borrowing the amount of THREE


HUNDRED TWENTY FIVE THOUSAND PESOS (P325,000.00), Philippine
Currency while the CREDITOR-MORTGAGEE is willing and able to lend the said
amount, subject to the following terms and conditions:

1.That the CREDITOR-MORTGAGEE shall convey the amount of THREE


HUNDRED TWENTY FIVE THOUSAND PESOS (P325,000.00), to the DEBTOR-
MORTGAGOR upon execution of this contract;

2.That the DEBTOR-MORTGAGORS shall pay the CREDITOR-MORTGAGEE the


aforementioned amount loaned within the period of SIX (6) MONTHS upon the
execution of this agreement;

3.That for and in consideration of the aforementioned indebtedness, and to assure the
performance of said obligation to pay, the DEBTOR-MORTGAGORS do hereby
CONVEY and DELIVER by way of LOAN AGREEMENT WITH REAL ESTATE
MORTGAGE unto the CREDITOR-MORTGAGEE, his heirs, and successors and
assigns the following real property including the improvement standing thereon (if any),
which is more particularly described as follows:

4. That the DEBTOR-MORTGAGORS shall pay the CREDITOR-MORTGAGEE in the
following manner:

5. That the DEBTOR-MORTGAGORS duly executed a Special Power of Attorney to


authorize __________________ to execute and sign a Loan Agreement with Real Estate
Mortgage with_____________________, the hereinafter called CREDITOR-
MORTGAGEE;

6. That the herein Attorney-In-Fact shall deliver or surrender the Katibayan ng


Orihinal na Titulo ______________ to _____________ upon the execution of this
Loan Agreement with Real Estate Mortgage;

7.This Agreement and all other documents pertaining hereto shall be governed and
construed in accordance with the laws of the Republic of the Philippines;

8. This Agreement shall be binding upon and enforceable on the DEBTOR-


MORTGAGORS and the CREDITOR-MORTGAGEE and their respective successors
and assigns. The DEBTOR-MORTGAGORS shall not assign or transfer its rights or
obligations hereunder without the prior written consent of the CREDITOR-
MORTGAGEE;

9. In the event any provision of this Agreement is deemed to be void, invalid, or


unenforceable, that provision shall be severed from the remainder of this Agreement so
as not to cause the invalidity or unenforceability of the remainder of this Agreement. All
remaining provisions of this Agreement shall then continue in full force and effect;

10. Except as otherwise provided in this document, this agreement may be modified,
superseded, or voided only upon the written and signed agreement of the Parties.
Further, the physical destruction or loss of this document shall not be construed as a
modification or termination of the agreement contained herein.

IN WITNESS WHEREOF, we have hereunto set our hands and affix our
