ORDER

By dint of this order, I propose to dispose of an applica-

tion presented before this court by the applicant through his
counsel for release of his vehicle bearing Registration No.
JK01X-8797 seized by the police on the grounds mentioned in
the application.
Heard the learned counsel on Whatsapp for the applicant
I have also perused the application. The LTEM form annexed
with the application transpires that the vehicle in question has
been seized by the Police concerned in connection with case
U/S 207 M.V Act.
At this stage I am convinced that the vehicle in question
is not serving any purpose of investigation, rather if it is
allowed to remained in police station, there is every

apprehension of its damage due to the vagaries of weather
and rusting. Further the release on Supurdnama is not the
absolute release but is only a temporary change of custody
from police to an individual.
In the above facts & circumstances application is
allowed and the seized vehicle bearing Registration No.
JK01X-8797 is directed to be released in favour of applicant,
on supurdnama and with further condition that he will not sell
or change the colour of the vehicle and will produce the same
before this court and the investigating agency as and when
directed or to do so. Further that he will not ply it on road
without complete documents. In case the requisite
Supurdnama is furnished and attested, office shall issue
formal release order directing the SHO P.S Maisuma to release
the vehicle bearing Registration No. JK01X-8797 after
retaining original R/C of the vehicle. The application is
disposed of accordingly and after due compilation shall be
consigned to the records.
