IN THE MATTER OF – An application seeking the direction to the in

charge of the concerned police station i.e.
Police post Domana for the implementation of
the order dated 07.03.2024 passed by this
Hon’ble court in the above titled.
May it please your honor;
The applicant most humbly submits as under: -
1. That the applicant has filed the above titled civil suit which is
pending disposal before this Hon’ble court and in which the
Hon’ble court was pleased to pass an Ad-Interim order dated
07.03.2024 wherein the Hon’ble court has meanwhile
temporarily restrained the non-applicants from interfering
and encroaching upon the suit property viz land measuring 2
Kanals and 10 Marla’s comprising under Khasra no.580,
Khewat No.1, Khata No.55 situated at village Rajpura
Domana, Tehsil Jammu North, District Jammu.Copy of the
Order dated 07.03.2024 Passed by this Hobble Court is
Annexed herewith as Annexure-I.
2. That the applicant has already served the copy of the said
order to the non-applicants through the process server and
the non-applicants are fully aware of the said above
mentioned restraining order passed by this Hon’ble court.
3. That even after knowing about the above-mentioned
restraining order passed by this Hon’ble court the opposite
parties are violating the same openly as yesterday the non-
applicants have started the construction on the suit property
and in connection to this, they had also brought a JCB
Machine onto the suit property for carrying out the
construction work on the suit property. The photograph of the
said JCB machine brought to the suit property by the non-
applicants is annexed herewith as annexure Annexure-II for
the kind perusal of this Hon’ble Court.
4. That the applicant thereafter reported the said incident to the
police station Domana along with the copy of the above-
mentioned order dated 07.03.2024 but the concerned police
officials told the applicant that it is a civil matter and they
can only get the above-mentioned restraining order
implemented if there is an order by court for implementation
of the said order through the police.
5. That if in case the above-mentioned order is not implemented
through police then the non-applicants may continue to
violate the same and there is every apprehension that they
may illegally encroach the suit property.
6. That if in case the present application is not allowed then the
applicant shall suffer an irreparable loss.

An affidavit in support of the present application is annexed

herewith.
In The Premises: -
In the view of the above-mentioned circumstances, it is most
humbly and respectfully prayed that the Hon’ble court may
kindly be pleased to direct S.H.O Police Station Domana to get
the order dated 07.03.2024, passed by this Hon’ble court in the
above titled civil suit, implemented on spot in letter and spirit
and submit the compliance before this Hon’ble court, in the
interest of justice.
