௚th February, 2020 The senior Superintendent of Police,Chandigarh. Subject: - Cheating and
Fraud committed by (1) SATISH GUPTA, Managing Director, GBP (Mobile: 98722-05824)
(2) PRADEEP KUMAR, Director GBP and (3) ANUPAM GUPTA. Director (Mob: 96460-
51525) of M/s GUPTA BUILDER & PROMOTERS PVT LTD, by Selling of Five Hotel
Rooms at their HOTEL-SITE, without having any legitimate right of ownership of the said
land, and No RERA APPROVAL. Regd. Office: SCO No. 196-197, Sector 34 - A, chandigarh.
Respected Sir/ Madam, I am a VICTIM, named Amit Kapoor s/o Sh. K.K.Kapoor R/o of
House No. 1537, Sector 34-D, Chandigarh ( Mob:98150-14349) has been cheated and
dishonestly deceived by the above mentioned persons, for a big amount of Rupees 38,07,457/-
( Thirty Eight Lakhs Seven Thousand Four Hundred and Fifty Seven Only) being the
Principal Amount, Plus Interest Amounting to 9,50,000/- (Nine Lakhs and Fifty Thousand
Only) Total Amounting to Rupees 47,57,457/- (Forty Seven Lakhs Fifty Seven Thousand Four
Hundred & Fifty Seven Only) Till Date. Through this complaint I hereby, submit the details
of the instances and facts, how had i been trapped in their malicious intentions of cheating me.
I was contacted by Raj Sharma (Mob: 82880-88897) who is a Manager in M/s GUPTA
BUILDER & PROMOTERS, in mid of April 2019. He offered me lucrative proposals for
their upcoming Commercial Hotel Rooms situated at Sector 66 A, SAS Nagar (Mohali). Raj
Sharma arranged a meeting with Mr. Anupam Gupta, the Director of the firm. During the
meeting they placed some presentations before me and explained that they are coming with
this on Hotel Site at Sector 66 A Mohali and are selling these hotel Rooms with 12.5 %
assured Returns till the possession of the Hotel Room is given. They further apprised me of
that they have also tie-up with the renowned TAJ Group of Hotels, and that this hotel will be
running in future with the collaboration of TAJ HOTELS, and 30 % profit derived from the
Hotel-Rooms will be given to all the persons those who buy the said hotel rooms. They
convinced me that the Developer of M/s GUPTA BUILDER & PROMOTERS PVT. LTD.,
namely it's Managing Director Mr. SATISH GUPTA,PRADEEP KUMAR and ANUPAM
GUPTA, it's Directors are lawfully entitled to sell the said Hotel land and this land is
earmarked ie. designated for the purpose of Commercial Hotel Site and falls under the
upcoming project of "Aeropolis city" situated at Sector 66-A, S.A.S Nagar (Mohali). The
Developers M/s GUPTA BUILDER& PROMOTERS(GBP) assured me that the title of the
said property upon that this HOTEL-PROJECT is being raised has Clear-ownership title.
The Developers M/s GBP intimated me that they are in the process of obtaining the necessary

permissions from the Chief Town Planner, Punjab and which shall be granted to them very
shortly. On affirm assurances and guarantee given by Mr. SATISH GUPTA, Managing
Director, PRADEEP KUMAR and ANUPAM GUPTA, Directors of M/s GBP, I Amit Kapoor
got influenced by their offers for a secured Life Time Income and agreed to buy FIVE
HOTEL UNITS/ROOMS each measuring 558.75 sq ft in their upcoming Aeropolis City Hotel
- Site situated at Sector-66A, S.A.S.Nagar (Mohali). On 27th April, 2019 M/s GUPTA
BUILDER & PROMOTERS through its Managing Director Mr. SATISH GUPTA &
PRADEEP KUMAR and its Director ANUPAM GUPTA entered into an written agreement
with me that Amit Kapoor s/o Shri K.K.Kapoor r/o of House No. 1537, Sector 34- D,
Chandigarh is buying Five Hotel Rooms bearing Numbers 518, 519, 523, 524 & 525 and all to
be on 5th Floor of Hotel Site of M/s GBP Situated at Sector 66A, SAS Nagar, Mohali. The
agreement was duly Signed by me and the Authorized signatory Mr. PRADEEP KUMAR,
Managing Director/ Partner of M/s GBP as parties to the agreement. All the conditions shown
to me are stipulated in the separate Agreements of Five Hotel Rooms. (Agreements are
available for reference) I paid Rupees 58,75,000/-(Fifty Eight Lakhs & Seventy Five Thousand
Only) from my Loan Account Limit for which l am paying heavy Interest every month. The
details of payments made by me to GBP are as below:- 1. Rupees 5,00,000/- vide Cheque No.
000242, dated 20-04-2019, drawn on HDFC Bank Ltd, Sector 22- B, Chandigarh. 2. Rupees
6,75,000/- vide Cheque No. 000340, dated 27-04-2019, drawn on HDFC Bank Ltd, Sector 22-
B, Chandigarh. 3. Rupees 11,75,000/- vide Cheque No. 000341, dated 27-04-2019, drawn on
HDFC Bank Ltd, Sector 22- B, Chandigarh. 4. Rupees 11,75,000/- vide Cheque No. 000342,
dated 27-04-2019, drawn on HDFC Bank Ltd, Sector 22- B, Chandigarh. 5. Rupees
11,75,000,/- vide Cheque No. 000343, dated 27-04-2019, drawn on HDFC Bank Ltd, Sector 22-
B, Chandigarh. 6. Rupees 11,75,000/- vide Cheque No. 000344, dated 27-04-2019, drawn on
HDFC Bank Ltd, Sector 22- B, Chandigarh. After about 15 days of making the payments to
them, i.e. in the mid of May 2019, I came to know from the reliable sources that M/s GUPTA
BUILDER & PROMOTERS is neither having any sale deed of the said land in their favor nor
are legally entitled to sell this Hotel-site and moreover this land is not even earmarked for the
purpose of Commercial Hotel Site. They do not possess any approval from the Chief Town
Planner, Punjab and this land does not belong to M/S GBP in any manner, whatsoever as per
the Revenue Record. Further, I was also informed through some sources that they are not
enlisted with RERA, jurisdiction, Punjab for the said Hotel Project and that they without
having any legitimate right on the said land provided false information to the people to
mislead and cheat them with malafide intentions to grab/loot the money, in fact it is illegal
exaction of money. I was shocked to know the facts and was mentally perturbed. I met Mr.
Raj Sharma (Manager) and their Director Mr. Anupam Gupta and told them about this
Fraud and Cheating done with me by them. They felt ashamed and assured me that they will
soon refund my money. After repeated visits and requests they did not refund my money but
kept on lingering the matter by giving false assurances on each time I pursue for the refund. I
was getting mentally sick by running here and there to their sites all over Mohali and
Zirakhpur to find out a solution. Then I went to meet Mr. Satish Gupta, MD M/s GBP and he
assured me for immediate refund of all my money with 2% per month Interest on it and
apologized for the same. He asked me to submit an application for refund. On 22, July, 2019 I
submitted the application for the refund of my amount of 58,75,000/- plus 2 % p.m. interest.
After giving the refund application I waited for a week but they did not issue me my refund. I
again requested to Mr. Satish Gupta, Mr. Pradeep Kumar, Mr. Anupam Gupta and Manager
Raj Sharma hundreds of time but they kept on harassing me. Later they started avoiding my
phone calls. But I continued my efforts to pursue for refunds, so after harassed struggle for
more than 5 months, in the month of October, 2019, they somehow issued me the following
cheques of refunds: - 1. Rupees 3,50,000/- vide Cheque No. 600151, Dishonored dated 10-10-
2019, drawn on IDBI Bank, SCO 72-73, Sector 17- B, Chandigarh. 2. Rupees 3,50,000/- vide
Cheque No. 600152, Dishonored dated 10-10-2019, drawn on IDBI Bank, SCO 72-73, Sector
17- B, Chandigarh. 3. Rupees 4,75,000/- vide Cheque No. 600154, Dishonored dated 10-10-

encashed an amount of total 23 Lakhs. Thereafter I have not deposited the remaining
Cheques, as all the previous issued cheques were getting dishonored from the Bank. After the
Cheques got dishonored I repeatedly went to their offices but they kept on making one or the
other lame excuses and started avoiding me and the person present in the office told me that
their Directors are not available in the City. Finally after my repeated follow-ups Mr. Satish
Gupta met me and assured me that this time the Cheques will not get dishonored and he
issued new Cheques to me. The details are under: 1. 25.12.2019 Amount, 10,00,000/- Cheque
No. 621202, IDBI Bank, SCO 72-73, Sector 17 B, Chandigarh. 2. 27.01.2020 Amount,
10,00,000/- Cheque No. 621203, IDBI Bank, SCO 72-73, Sector 17 B, Chandigarh. 3.
30.01.2020 Amount, 10,00,000/- Cheque No. 621204, IDBI Bank, SCO 72- 73,Sector 17 B,
Chandigarh. 4. 12.02.2020 Amount, 8,07,457/- Cheque No. 621205, IDBI Bank, SCO 72-
73,Sector 17 B, Chandigarh. Mr. Satish Gupta also Assured me of 2 % Interest will be given
to me on my payment for this duration after encashment of the above Cheques. For the first
Cheque issued was 25 Dec 2019 dated amounting to Rs. 10 Lacs, I received a call from Mr.
Satish Gupta cautioned me not to present the Cheque as he is sending money through RTGS
in my given Bank Account. Again that was a clever tactics played by him to avoid my
payment of refund. I kept on asking Mr. Satish Gupta for the RTGS and he kept on making
excuses again and again. Then I met Mr. Anupam Gupta and again requested for the
payment. He asked me to deposit the Cheques in the bank and assured that this time all
Cheques will be Honoured and Encashed. As told by Anupam Gupta, on 13th Jan, 2020 I
Presented the Cheque dated 25th Dec 2019 amounting to Rs. 10,00,000/- ( Ten Lakhs Only)
and the same Cheque has also been Dishonored with the remarks "INSUFFICIENT
FUNDS". Further all Given Cheques for 27th January and 30th Jan 2020 are also
Dishonored. Whereas, this is a clear case of fraud, cheat, loot, criminal breach of trust and
dishonest inducement to deceive to grab the money. I feel they have not only cheated and
looted me but hundreds of more other Individuals are also being cheated by their Racket. It is
therefore, requested that the complaint against them be registered under the relevant
provisions of law and dealt with stern legal actions. 1. SECTION 120 A: criminal conspiracy
2. SECTION 415, 418, 420: fraudulently inducing the person so deceived (to deliver a
property) 3. And any other provisions of law. It is requested and hoped that justice would
