RESOLUTION

On March 7, 2023, the Court issued a Resolution noting the Compliance


of the prosecution admitting that it failed to notice the error in the name of
one of the accused 1 in the Information. In the same resolution, the prosecution
was granted a period of five (5) days within which to file an amended
information.

The resolution was served on the prosecution, through the OSJ


Prosecution Staff, NPS Docket Section, Department of Justice, on March 24,
2023. 2 The prosecution, therefore, had until March 29, 2023 to file its
amended information.

Records, however, revealed that the prosecution failed to comply with


the Court's Resolution dated March 7, 2023 as per Records Verification
Report dated April 26, 2023.

WHEREFORE, premises considered, CTA Crim. Case No. 0-961 is


DISMISSED.
