EXTRA JUDICIAL SETTLEMENT OF ESTATE WITH WAIVER OF RIGHTS OF MOISES LEONOR

Know All Men by These Present:

WE, EVANGELINE B. LEONOR, widow of the late Moises Leonor, Filipino, of legal age
and her son MELBERT BORJA DUMALASA, married, of legal age, Filipino, both with residence
and postal address at 524 Vera Cruz St., Barangay Poblacion, Calauag, Quezon and her daughter
MARICEL DUMALASA- ESPENILLA, married, of legal age, Filipino and with postal address at
Polangui, Albay herein referred to as the HEIRS;
WITNESSETH:
WHEREAS, the foregoing parties are the surviving heirs of the late MOISES LEONOR who
died on December 10, 2008 at Saint Peter General Hospital, Calauag, Quezon, Philippines;
WHEREAS, said decedent died intestate, without leaving any last will or testament;
WHEREAS, said decedent likewise died without leaving any outstanding debts in favor of
any third party or entity;
WHEREAS, EVANGELINE B. LEONOR through her son MELBERT B. DUMALASA her
appointed Attorney in-Fact having a duly signed and notarized Special Power of Attorney and
her daughter MARICEL DUMALASA- ESPENILLA are the true and lawful heirs of a particular
properties in the Municipality of Calauag Province of Quezon more particularly described as
follows;
"A parcel of land (Lot No. 998-B of the subdivision plan, Psd-04-040537, being a
portion of Lot 998, Cad-206, Calauag Cadastre, L.R.C. Record No.), situated in the
Poblacion, Municipality of Calauag, Province of Quezon. Bounded on the SW,
along line 1-2 by Lot 958, Cad-206, Calauag Cadastre; on the NW., along line 2-3
by Lot 998-A of the subdivision plan; on the NE., along line 2-3 by Calle A.
Bonifacio (10.00 m. wide); on the SE., along line 4-1 by Lot 1001, Cad-206,
Calauag, Cadastre. Beginning at a point marked "1" on plan, being S. 83deg.
50W, 210.14 m. from BLLM No. 1, Cad-206, Calauag Cadastre. thence N. 18deg. 08W.,
5.21 m. to point 2; thence N. 72deg. 32'E., 13.83 m. to point 3; thence S. 17deg.
35'E., 5.33 m. to point 4; thence S. 73deg. 02W., 13.78 m. to the point of
beginning, containing an area of SEVENTY TWO SQUARE METERS AND FIFTY
SQUARE DECIMETERS (72.50). All points referred to are indicated on the plan
and are marked on the ground by P.S. cyl. conc. mons. 15x60 cm., Pts. 4,1 by Old
BL., bearings true; date of original survey, April 1922-Feb. 1927 and that of the
subdivision survey Dec. 26, 1989 and was approved on Nov. 7, 1990."

"A parcel of land (Lot 1001-A of the subdivision plan (LRC) Psd-208022, being a
portion of Lot 1001, Calauag Cad., LRC Cad. Rec. No. 885), situated in the
Poblacion, Municipality of Calauag, Province of Quezon, Island of Luzon. Bounded
on the NE., points 2 to 3 by Andres Bonifacio St.; on the SE., points 3 to 4 by Lot
1001-B of the subdivision plan; on the SW., points 4 to 1 by Lot 958 and on the
NW., points 1 to 2 by Lot 998, both of Calauag Cadastre. Beginning at a point
marked "1" on plan being S. 83deg. 50W, 210.14 m. from BLLM 1, Calauag Cad.;
thence N. 73deg. 02 E., 13.78 m. to point 2; thence S. 17deg. 05'E., 4.30 m. to
point 3; thence S. 72deg. 05W., 13.62 m. to point 4; thence N. 19 deg. 05 W., 4.53
m. to the point of beginning; containing an area of SIXTY (60) SQUARE
METERS, more or less. All points referred to are indicated on the plan and are
marked on the ground as follows points 1 to 2 by Old B.L. Cyl. Conc. Mons. 15 x
60 cm.; bearings true; date of the Original Survey, April 1922-Feb. 1927 and that
of the Subdivision Survey, executed by Pompeyo Q. Garcia, Geodetic
Engineer, on Sept. 2, 1974."
WHEREAS, since I, EVANGELINE B. LEONOR, is the compulsory owner, heir and
beneficiary of our properties of my late husband MOISES LEONOR, by virtue of and pursuant to
Sec 4 Rule 74 of the Rules of Court I do hereby agreed to divide and do hereby RENOUNCING,

WAIVING ALL MY RIGHTS and QUITTING ALL MY CLAIMS over my share as co-owner and my
share as a legal heir of said properties in favor of my son MELBERT B. DUMALASA and my
daughter MARICEL B. DUMALASA- ESPENILLA and do hereby agreed to divide and do hereby
divide and adjudicate among themselves the above properties as they agreed upon in equal
sharing however to the contingent liabilities to creditors, heirs and other person who might
have been deprived of their lawful participation in the estates of the decedents for a period of
two (2) years from and after the distribution and settlements in accordance with the provisions
of Sec 4 Rule 74 of the Rule of Court.
That these lots are not covered by CARP.
