with WAIVER AND DONATION OF THE SURVIVING
SPOUSE’S ABSOLUTE COMMUNITY SHARE

KNOW ALL MEN BY THESE PRESENTS:

This EXTRAJUDICIAL SETTLEMENT OF ESTATE is made and


entered into by and between:

LETICIA ADRIANO DEL CASTILLO, Filipino, of legal


age, widow, and a resident of No. 73 M.R. Luna Street, BF Homes
Phase 3, Parañaque City (Surviving Spouse); and

ANA KATRINA ADRIANO DEL CASTILLO, Filipino, of


legal age, single, and a resident of No. 73 M.R. Luna Street, BF
Homes Phase 3, Parañaque City (Daughter);

– WITNESSETH that –

WHEREAS, the late ROBERTO FERNANDEZ DEL CASTILLO


(Decedent), married to Leticia Adriano Del Castillo, died on 4 October 2021 as
evidenced by his Certificate of Death, a copy of which is hereto attached as
Annex “A”;

WHEREAS, the Decedent, at the time of his death, was a resident of their
family home located at No. 73 M.R. Luna Street, BF Homes Phase 3, Parañaque
City;

WHEREAS, the Decedent died intestate leaving no debts or obligations;

WHEREAS, the Decedent has an estate consisting of one-half (1/2)


portion of a parcel of land with improvement –utilized as their family home–,
which is considered by law as the spouses’ absolute community property,
located No. 73 M.R. Luna Street, BF Homes Phase 3, Parañaque City, covered
by Transfer Certificate of Title No. (S-103658) (49507) 010-2021001000 (subject
property), with the following technical description:

WHEREAS, the parties are the only surviving legal heirs of the Decedent;

WHEREAS, being the only surviving legal heirs, the parties became the
true and absolute owners of the above-mentioned Decedent’s estate by operation
of law;

ADJUDICATION OF INHERITED SHARE

NOW THEREFORE, pursuant to the provisions of Rule 74, Section 1 of


the Rules of Court and other pertinent provisions of the New Civil Code, the
parties agree settle and adjudicate, as they hereby settle and adjudicate unto and

amongst themselves, pro-inidviso and in equal shares, the above-mentioned
estate of the Decedent;

This Extrajudicial Settlement of Estate of the Decedent executed by the


parties shall be subject to contingent claims of creditors, heirs or other persons
who might have been unlawfully deprived participation in the estate of the
Decedent, if any, for a period of two (2) years from the date hereof pursuant to
the provisions of the Rules of Court.

Notice of this Extrajudicial Settlement of Estate shall be published in a


newspaper of general circulation in the Philippines once a week for three (3)
consecutive weeks.

and DONATION OF ABSOLUTE COMMUNITY PROPERTY SHARE
OF THE SURVIVING SPOUSE

FURTHER, the Surviving Spouse LETICIA ADRIANO DEL


CASTILLO, out of her deep love and affection to their only daughter, hereby
gratuitously WAIVES, CEDES, TRANSFERS, CONVEYS and DELIVERS
by way of DONATION unto her daughter and co-heir ANA KATRINA
ADRIANO DEL CASTILLO all her rights, title and interest over the property
relative to her inherited share in the estate of the Decedent.

FURTHERMORE, the Surviving Spouse LETICIA ADRIANO DEL


CASTILLO, by virtue of this presents, likewise out of her deep love and
affection to their only daughter, hereby gratuitously CEDES, TRANSFERS,
CONVEYS and DELIVERS by way of DONATION unto her only daughter
ANA KATRINA ADRIANO DEL CASTILLO all of her rights, title and
interest over the subject property relative to her absolute community property
share.

foregoing Extrajudicial Settlement of Estate of the Late Roberto Fernandez Del

voluntary act and deed.

This instrument, consisting of four (4) pages, including the page on which
this Acknowledgment is written, was executed before me and signed by all the
parties and their instrumental witnesses in each and every page hereof.
