MEMORANDUM OF AGREEMENT AMONG HEIRS

OF BALDOMERO KILAB MILA AND ANGELINA EBREO ADECIR

KNOWN BY ALL MEN THESE PRESENTS:

This Memorandum of Agreement made and executed in Quezon City, Philippines, on


December 26, 2019 by and among:

Myrna Mila Lambojon Filipino of legal age, married to Concordio Luga


Lambojon residing at B13 L1 Ph, C-1, Francisco Homes, Barangay Mulawin, City of San Jose
Delmonte, Bulacan

Godrey Adecir Mila, Filipino of legal age, married to Rowena Arsenio Mila
residing at Baras Purok Daisy, Tacurong, Sultan Kudarat

Rowel Adecir Mila, Filipino of legal age, married to Veronica Balubugan Mila
residing at RH 8, B3 Notre Dame Village, Cotabato City

Evelyn Mila Gerona, Filipino of legal age, married to Jerome P. Gerona


residing at Jaro, Ilo-Ilo City

Melcer Adecir Mila, Filipino of legal age, separated, temporary residing at B9

Emelia Adecir Mila, Filipino of legal age, single residing at RH 8, B3 Notre Dame
Village, Cotabato City

WITNESSETH:

1. That the above-named parties are the sole heirs of Baldomero Kilab Mila and
Angelina Ebreo Adecir, being the latter’s legitimate children, respectively. (“Heirs of
Mr. & Mrs. Baldomero K. Mila”)

2. The father Baldomero Kilab Mila passed away on August 3, 20015 , and at the time
of his death, was residing at RH 8, B3 Notre Dame Village, Cotabato City. The mother
Angelina Ebreo Adecir passed away on November 27, 2019, was residing at B13, Lot
1, Ph. C-1, Francisco Homes, Barangay Mulawin, City of San Jose Delmonte, Bulacan;

3. That the decedents left no will;

4. That to the best knowledge and information of the parties hereto, the said deceased
left no debts;

5. That the deceased, at the time of their death, owned a two hundred one square
meters (201sq.m) parcel of land and house situated in Barrio Kakar, City of
Cotabato, Island of Mindanao now Notre Dame Village, Cotabato City and covered
by Transfer Certificate of Title (TCT) No. T-13599 of the Register of Deeds of
Cotabato City , registered in Book 1, Page 24 , together with all the existing
improvements thereon consisting of [a house of light materials), particularly
described as follows:

A parcel of land (Lot 8, Block 3 of the consolidation-


subdivision plan (LRC) Pcs-14856, being a portion of the
consolidation of Lots 571-C and 570-C; (LRC) Psd-60574,
LRC Cad. Record No. 296, situated in the Barrio of Kakar,

City of Cotabato, Island of Mindanao. Bounded on the NE.,
points 1 to 2, by Lot 7, Block 3; on the SE. and SW.,
points 2 to 5, by Road Lot 1; and on the NW., points 5 to 1,
by Lot 9, Block 3, all of the consolidation-subdivision plan.
Beginning at a point marked “1” on plan being N. 54 deg.
28’E., 2326.89 m. from BLLM-1, Cotabato Cadastre; thence
S. 68 deg. 02’E. , 12.89 m. to point 2; thence S. 21 deg. 57’
W., 13.00 m. to point 3; thence S. 66 deg. 57’ W., 4.24 m. to
point 4; thence N. 68 deg. 03’W., 9.84 m. to point 5; thence
N. 21 deg. 47’E., 16.00 m. to the point of beginning,
containing an area of TWO HUNDRED ONE(201) SQUARE
METERS, more or less. All points referred to are indicated
on the plan and are marked on the ground by PS. Cyl. Conc.
Mons., 15 x 60 cm.; bearing true; declination 2 deg. 00’E.,
date of the Original Survey, Sept. 1915-April 1917, and that
of the Consolidation-Sub-division Survey, executed by
Geodetic Engineer Francisco N. Obed, Sept. 2, 1966-April
16, 1967.

6. That, pursuant to Section 1 of Rule 74 of the Revised Rules of Court of the


Philippines, by agreement between the parties herein, the entire interest of the
decedents in the above-described property shall be divided and settled among them
in equal shares divided into 33.5 sq.m each heir;

7. Said Transfer Certificate of Title (TCT) No. T-13599 cannot be sold or leased to other
person outside of family heirs to preserve the property to the sole heirs of
Baldomero Kilab Mila and Angelina Adecir Ebreo.

8. The above stated sole heirs has authority to occupy the equal 33.5 sq. meter shares.
And the stated heirs can sell his/her share on equivalent to the latest market value of
the real state only to the sole heirs of the family.

9. The heirs presently occupant of the land must pay (mandatory to pay) the yearly
Real State Tax
Said property (house and lot). And they are oblige to maintain the repair and
maintenance of the same property;

10. As agreed upon, the heirs will not demand for their shares of rent income of said
property for (three) 3-year period, or from December 15, 2019 to December 14,
2022. Provided, however, that Godfrey Adecir Mila is obliged to give shares to the 2
(two) sole heirs, namely: Melcer Adecir Mila and Evelyn Mila Gerona, the monthly
share of one thousand five hundred pesos only (P1,500.00), considering of their
present situation. And the same shall be enforced effective immediately.

11. Any violation on the above stated agreements shall be dealt accordingly.

IN WITNESS WHEREOF, the parties have hereunto set their hands this 26th day of
December, 2019 at Quezon City, Philippines.

Memorandum of Agreement Among Heirs of Baldomero Kilab Mila and Agelina Ebreo
Adecir consisting of three (3) pages including this page, and they acknowledged to me that
the same is their free and voluntary act and deed.
