CONTRACT OF LEASE

This CONTRACT OF LEASE is made and entered into by and between:

The HON. ARON CABANACAN BALAIS, MD, FPCEM, duly represented by the
MUNICIPAL MAYOR herein referred to as the LESSOR;

-and-

______________________________, of legal age, Filipino, single/married/widow and a


resident of __________________________, Philippines hereinafter referred to as the LESSEE;

WITNESSETH

That the Local Government Unit of Barugo is the owner of the public markets situated at
the_________________________________.

That for and in consideration of the agreement hereinafter stipulated the herein named
LESSOR do hereby LEASE unto the qualified LESSEE, who has/have been awarded Stall
No.____ of Building No. _____ of the Public Market of Barugo by the Market Committee through
raffle/bidding conducted for the purpose and has/have secured first its business permit as
required by the Municipality prior its operation and is subject to the following terms and
conditions, to wit:

1. DURATION OF THE LEASE. –

The term of this Contract of Lease shall be one (1) year or less which shall commence
from the date of the execution of this Contract until December 31 st of the current year
which shall be renewable upon the execution of another contract;

2. MONTHLY RENTAL

That the LESSEE agrees to pay a monthly of ______________ (P__________) for the
Market stall that the LESSEE shall occupy, to be paid in advance within the 1 st to the 20th
day of the month and the succeeding months thereafter;

That an advance deposit equivalent to two (2) months rental shall be made and
receipted by the Office of the Municipal Treasurer for the stall that the LESSEE is
occupying and shall give due notice to the Office of the Municipal Mayor two (2) months
before the LESSEE intended to vacate the said stall.

3. USE OF THE LEASED PREMISES. –

That the LESSEE shall use the leased premises exclusively for business and shall have
no right to use the same for dwelling purposes, cooking, sleeping quarter, bodega, or
storage and the like;

That the LESSEE shall not be allowed to occupy space/stall/block other than those
leased to them;

That the LESSEE shall keep the premises at all times in good sanitary condition and
comply with all sanitary market rules and regulations now existing or which hereinafter
be promulgated including the provision of garbage cans in the lease premises and the
observance of proper waste segregation;

4. REPAIRS. –

That all ordinary repairs within the leased premises that may arise through ordinary use
of the facilities herein, shall be for the sole account and expense of the LESSEE without
right to reimbursement from the LESSOR. No repairs shall be made without the consent
of the Municipal Mayor or through his/her authorized representative;

5. IMPROVEMENTS/EMBELLISHMENT. –

That for all improvements in and to the premises, including alterations, the LESSEE shall
acquire permit first from the LESSOR, and shall remain without reimbursement from the
LESSOR for the said improvements. The LESSEE shall have the right to remove the
improvement/s only in case he/she can do so without injury or damage to the leased
premises.

6. SELL, SUBLEASE, OR TRANSFER THE RIGHT OR PRIVILEGE GRANTED NOT


ALLOWED.

That the LESSEE shall NOT in any way sell, sublease or transfer his/her right or
privilege to occupy the leased premises or permit another person to conduct business
therein. Any person other than the lessee or his/her helpers found selling or conducting
business in the latter’s space/stall/block shall be considered as prima facie evidence of
subleasing and shall subject the lessee to outright revocation of his/her lease contract;

A goodwill fee is hereby imposed and collected from the transferor in the amount of
Twenty Thousand Pesos (P20,000.00) and Ten Thousand Pesos (P10,000.00) from the
transferee to a right to lease a stall. This must be paid immediately upon the approval by
the Market Committee/Municipal Mayor of the subject transfer of right. However, no
goodwill fee will be collected if the transferee is an immediate member of the family of
the preceding market holder. For purposes of this Code, the phrase “Immediate member
of the Family” shall refer to an offspring of the stallholder.

7. REVOCATION OF THE LEASE. –

In the event that the LESSEE fails to pay his/her rentals for two (2) consecutive months,
the LESSEE’s business license shall be revoked/cancelled and shall cause the closure if
the leased premises within (10) days from receipt of the last and final demand of
payment and closure;

That the violation of any of the above terms and conditions will automatically or ipso
facto cause the revocation/cancellation of the license and/or permit to operate business
in the market without prejudice to the collection of any unpaid rentals and charges
through legal processes.

8. USE OF THE PREMISES BY THE LGU

That in any event the Local Government Unit of Barugo, represented by the LESSOR
would need to use the said premises for improvement or economic development, the
LESSEE shall vacate their rented stalls;

That the LESSOR shall provide a temporary relocation area for the LESSEE with option
not to avail by the latter;

9. VACANCY OF THE LEASE PREMISES. –

That the LESSEE shall notify the LESSOR at least thirty (30) days in advance, should
the former decide to abandon and/or vacate the leased premises and to surrender
his/her business at the Office of the Municipal Mayor;

10. EFFECT OF DEATH OF LESSEE. –

Upon the death of the LESSEE of the space/stall/block the contract of lease covering
said premises shall be deemed terminated. However, if the deceased is survived by
his/her spouse or legal heirs and desires to continue the business of the deceased, the
lease may be transferred to the deceased’s spouse or legal heirs and shall be only up to
the unexpired portion of the lease contract. Should the spouse and legal heirs wanted to
continue after the expiry of the lease contract, they may do so through filing a new
application thereof;

Provided, that the local market authorities shall be notified within thirty (30) days after
the death of the original lessee of the desire of the spouse and legal heirs to succeed;

11. FINAL CLAUSE. -

That the LESSOR and LESSEE hereby agree and covenant to fully abide and comply
with the provisions of ordinances, laws, decrees, rules and regulations, including this
contract of lease affecting the operation of the lessee’s business and/or occupancy in
the market;
