CONTRACT OF LEASE

KNOW ALL MEN BY THESE PRESENTS:

This CONTRACT OF LEASE, made and entered into this ___day of ____________,
________ at the Municipality of Montalban, Rizal, by and between:

__________________________, of legal age, married/single and residing at


___________________________________, and hereinafter referred to as the
LESSOR,

-and-

__________________________, also of legal age, married/single and residing at


___________________________________, and hereinafter referred to as the
LESSEE,

WITNESSETH: That

WHEREAS, the LESSOR is the lawful and authorized administrator of the house and lot
owned by JOCELYN D. MERCADO situated at #3 Mt Apo St., Amityville Subd,
Montalban Rizal;

WHEREAS, the LESSEE is willing to lease a portion of said property consisting of two
(2) rooms, and two (2) common areas which may serve as living or dining areas or any
other residential purpose from the LESSOR under the following terms and conditions:

1. That the lease shall be for a period of six (6) months from ________________
up to ___________________;

2. That the LESSEE shall pay a monthly rental of

Philippine Currency, payable every ______ day of the month in cash or any
mode agreed upon by herein parties;

3. That the LESSEE shall deposit to the LESSOR upon signing of this contract
and prior to move-in an amount equivalent to the rent for three (3) months or
_______________________________________, (P__________) representing
two (2) months deposit and one (1) month advance. That the deposit shall not be
considered as payment for rental but will be reimbursed by the LESSOR upon
the termination of this contract, unless the leased property suffers damages or
the LESSEE has unpaid utility and water bills in which case, said bills and
damages will be paid out of the deposit and advance;

4. That electric and water bills shall be for the account of the LESSEE, the exact
amount of which will be based on the electric and water reading for each month;

5. That the leased premises shall be devoted exclusively for residential purposes
only;
6. That all improvements and alterations to be made or introduced on the
premises shall require the prior consent of the LESSOR and that improvement
that can no longer be removed by the LESSEE shall become the property of the
LESSOR;

7. That any expenses for repair arising from the negligence, or damages willfully
and knowingly caused by the LESSEE on the premises shall be shouldered by
the LESSEE;

8. That under no circumstance will the leased premises be subleased to any


other person or entity without the written consent and approval of the LESSOR;

9. That the LESSOR or its authorized agent, after giving due notice to the
LESSEE, shall have the right to enter the premises in the presence of the
LESSEE or its representative at any reasonable hour to examine the same or
make repairs therein or for the operation and maintenance of the building or to
exhibit the leased premises to prospective LESSEE, or for any other lawful
purposes which it may deem necessary.

10. That the LESSEE hereby agrees to return the leased premises, movable
furniture, articles, and effects of any kind with all corresponding keys at the
expiration of the contract in as good a condition as reasonable wear and tear will
permit without any delay whatsoever. Non-compliance with the terms of this
clause by the LESSEE will give the LESSOR the right, at the latter's option, to
refuse to accept the delivery of the premises and compel the LESSEE to pay rent
therefrom at the same rate plus Twenty-Five (25) % thereof as a penalty until the
LESSEE shall have complied with the terms hereof. The same penalty shall be
imposed in case the LESSEE fails to leave the premises after the expiration of
this Contract of Lease or termination for any reason whatsoever.;

11. The LESSOR has the right to terminate this lease contract, to padlock the
gates, enter the leased premises, and/or remove the LESEE’s properties from
the leased portion of the house when the LESSEE is in default of payment for
Three (3) months and may forfeit whatever rental deposit or advances that may
have been given by the LESSEE.

12. That in case the leased premises shall be abandoned, vacated or deserted
for a period of one (1) week, without any previous notice to the LESSOR and
during the time the LESSEE is in default in the payment of the monthly rental,
then under such circumstances, the LESSOR can consider the leased premises
as legally abandoned and may enter the premises and take possession thereof
without prejudice to its right of action against the LESSEE;

13. The LESSOR reserves the right to increase the rental rate by a maximum of
seven (7%) percent after one (1) year and the contract is renewed by mutual
agreement of the parties;

14. That the LESSEE is obliged to observe cleanliness and maintain peaceful
conditions inside and outside the premises and consideration for other tenants’
privacy, comfort, and well-being must be observed;
15. That the LESSOR, as a form of incentive, will allow a rental payment holiday
every December of the year following at least twelve-month continuous on-time
payments. For this purpose, no grace periods shall be considered.

17. That the LESSEE hereby warrants that he read and understood all the
foregoing provisions of this contract and shall abide by the same, otherwise, any
violation will subject the LESSEE to ejectment and other legal sanctions.
