Cell phones are considered illegal while you're driving well, so is in New York.The
commercial drivers cannot use cellphones while their vehicle is in motion. The
non cdl drivers are fined $100 for their first offense, $200 for their second offense
and $300 for their third offense which also includes 3 points to the record. The cdl
drivers are fined $2500 for their first offense and for their second offense the
charges are doubled and the court fees repeat for every other offense.

for the second time offenders, they are fined $5000 and also get 5 day-4 year
suspension.

new/ teen drivers or first time offenders are very strict. Strict laws are needed for
distracted driving and i think the laws for distracted driving in west virginia are
perfect.

(drinking) or a lit smartphone screen?

I think using an automobile is more dangerous because when a person is on their


phone they cannot focus on anything other than the phone whereas a person
who has an open bottle of alcohol can focus on driving and wont hit someone as
long as they're not completely drunk. The chances of hitting someone while the
driver is on their phone is high compared to the person who is drinking. Both
using their phone and drinking while their vehicle is in motion is considered
against the law. A person who's using their phone while driving wont have their
eyes on the road which may lead into an accident.
