Form of agreement to be executed between Gram Panchayat & Gram Anshkaleen

Jalvahaks under Gram Anshkaleen Jalvahaks Yojna 2001.

An agreement is made between the PTWC…………………………….on ………day

of……………….in the year ……… (herein called the contractual worker and First
Party) and the Gram Panchayat (Herein called the Second Party. Whereas the Gram
Panchayat has engaged the first party and the first party has agreed to serve as Gram
Anshkaleen Jalvahaks on the terms & conditions herein after for contained.

Where by it is agreed as follows:-

That the Anshkaleen Jalvahk shall remain in the services of the Govt. Primary
School……………….Village………………Gram Panchayat………………… for a
period commencing on the day of ………………….and ending on the day of
……………….. It is specifically mentioned and agreed upon by both the parties that the
contract of the employment of the first party shall ipso-facto stand terminated on the
second party conveying the same shall be necessary. That the employee shall submit
himself to the orders of the Gram Panchayat or the officers and the authorities under
Panchayat and the Primary education development from time to time.
That he shall employee himself efficiently and diligently and the best of his ability as
Gram Anshkaleen Jal Vahak and he shall devote himself timely to the duties and services
and shall not engage directly in any period (except in case of accident or sickness
known, certificate by the surgeon / authorized medical officer to be given) absent himself
of his said duties without having obtained prior permission from the immediate officer.
The Gram Anshkaleen Jal Vahak will not be entitled for any remuneration for the period
of absense.

The service of first party shall terminate as follows:-

Automatically at the end of the term given in the appointment letter by the Gram
Panchayat without previous notice and if the Gram Panchayat notice any medical
evidence of first party then first party is unfit and in liable for period to continue.
That the decision of the Gram Panchayat that the first party is likely to continue unfit
shall be conclusive binding on the party and thereupon his services shall be terminated
by the Gram Panchayat by its officer having proper authority without any previous
notice; if the first party is to be prima-facie guilty of any insubordination in tempera
moral turpitude or other misconduct or of other conduct or of any breach or not otherwise
found unsuitable for the efficient performance of his duties.

By one month notice in writing given at any time during service under this agreement or
there by Gram Anshkaleen Jalvahak the Gram Panchayat or by the competent authority to
the Anshkaleen Jalvahak . Provided always that the Gram Panchayat may pay Gram
Anshkaleen Jalvahak for one month is remuneration in lieu of month notice and there
upon agreement shall stand terminated forthwith.
Gram Panchayat shall pay the Gram Anshkaleen Jalvahak as the employees shall remain on
contract and actually perform duties assigned to him, consolidated remuneration of
Rs…………….per month shall be paid for the period of contract. No other allowances shall be
admissible.
In respect of any other matter of which no provision has been made in this agreement, the Gram
Anshkaleen Jalvahak Yojna 2001 shall be dealt with as per the instructions issued by the Govt.
from time to time.
The Gram Anshkaleen Jalvahak shall have to execute the work assigned to him by the competent
authorities other than his own duties in public interest.
It is expressly stated and agreed to by the first party that any duration of the service under this
agreement shall be the way or give him any right to claim for absorption in regard vacancies that
exist or may arrive in future in particulars. Outstanding anythings herein before contained in this
agreement in the Govt. shall be free to make departure from the terminated conditions of this
agreement in the exigencies of public interest if the circumstances so warrant.This after of
appointment is non-government all a fixed remuneration and it does not entitle him for any
government services.
First party shall have to furnish a declaration to the office.
First party will have to furnish attested copies of certificates on support of his date of birth
academic qualification etc, at the time of joining the contract.
First party will have to produce medical certificate of his fitness from a govt. medical officer
before joining. No TA/DA will be paid to the first party for the contract.
In witness where of first party and Pradhan Gram Panchayat on behalf of the Second party have
herein to set their hand the day, month and year first, above written.
