ORDER

Subject:- Proposal for diversion of 0.201891 ha of forest land for improvement/widening to 2-lane
with paved shoulder of Kailashahar to Fultali section of NH-208 under Unakoti District
(Package-I, Km 21.100 Km to Km 29.200) by NHIDCL, PMU Agartala.
User Agency (NHIDCL) submitted a proposal for diversion of 0.201891 ha of forest
land for improvement/widening to 2-lane with paved shoulder of Kailashahar to Fultali section of
NH-208 under Unakoti District (Package-I,Km 21.100 Km to Km 29.200) by NHIDCL seeking
approval of the central Government under section 2(ii) of Forest Conservation Act, 1980 for
diversion of 0.201891 ha of forest land for improvement/widening to 2-lane with paved shoulder of
Kailashahar to Fultali section ofNH-208.

The MoE,F&CC, Shillong issued In-Principle Approval subject to fulfillment of certain


conditions under section-2(ii) of the Forest (Conservation) Act, 1980 vide letter No.3-TR B
043/2020-SHIIl171-72 dated 03/09/2021. Accordingly User Agency deposited NPV & CA etc. in
favour of Ad-hoc CAMPA and submitted the condition wise compliance report vide letter
F.No.NHIDCLIPMUKgtlDPRlNH-208/KLS-Khw/9(3)/2021-22/402dated 2011112021.

Based on the compliance report MoEF&CC, Shillong issued Final Approval under Section-
2(ii) of the Forest (Conservation) Act, 1980 vide No.3-TR B 043/2021-SHI/2045-46 dated
07112/2021.
The Compliance of the Hon'ble National Green Tribunal order vide dated 07/1112012and
Ministry's letter dateg 2'!{0]/2013, it was stated that State Government to pass a reasoned order
for transferring and / or allowing the land in question for being used Tor non-forestry
purpose, hence this order is being issued.
The final order along with the conditions imposed in the approval by the Central
Government is mandatorily required to be displaced in the website. The conditions are as follows:-

1. The legal status of the land shall remain unchanged.


2. The Compensatory Afforestation shall be raised and maintained by the Forest Department over
0.40001 ha identified by the Forest Department in CS Plot 554, Khatian number 02 in
Chandipur Range, Kailashahar Forest Division in Unakoti District as per the funds deposited by
the user Agency. As far as possible, mixture of local indigenous species shall be planted and
monoculture of any species may be avoided.
3. The User Agency shall restrict the felling of trees to minimum number in the diverted forest
land and the trees shall be felled under the strict supervision of the State Forest Department and
the cost of the felling trees shall be deposited by the user Agency with the State Forest
.Department.
4. Chain link fencing should be constructed over 1.0 km stretch as per the fund deposited by the
User Agency.
5. The KML file of the area to be diverted, the CA area shall be uploaded on the e-green watch
portal before the issue of the final approval by the State Government.
6. The complete compliance of the-FRA, 2006 shall be ensured by way of prescribed certificate
from the concerned District Collector.
7. All other clearance/ NOes under different applicable rules/regulations/ local laws and under
Forest Dwellers (Recognition of Forest Rights) Act, 2006.as required vide MoEF, New Delhi
guideline No. l1.-9/1998-FC(Pt) dated 05.02.2013 shall be complied with.
8. User agency shall raise strip plantation on both sides of the road as per IRC norms.

10. The user agency shall provide suitable under lover
wherever applicable, as per recommendations of CWLW 1 NBWL 1 REC. \

11. The User Agency shall obtain the Environmental Clearance as per the provisions Environment
(Protection) Act 1986, if applicable.
12. The layout plan of the proposal shall not be changed without prior approval of the central
Government.
13. No labour camp shall be established on the forest land.
14. Sufficient firewood, preferably the alternate fuel, shall be provided by the User Agency to the
labourer after purchasing the same from the State Forest Department or the Forest Development
Corporation or any other legal source of alternate fuel.
15. Boundary of the diverted forest land shall be suitably demarcated on the ground at the project
cost, as per the direction of the concerned Divisional/District Forest Officer.
16. The overburden shall not be dumped outside the diverted land. The muck generated in the earth
cutting will be disposed of at the designated dumping sites and in no case the muck/debris will
be allowed to roll down the hill slopes.
17.No additional or new path will be constructed inside the forest area for transportation of
construction materials for execution of the project work.
18. The period of diversion under this approval shall be co-terminus with the period of lease, is
any, to be granted in favour of the user agency or the project life, whichever is less.
19. The forest land shall not be used for any purpose other than that specified in the proposal.
20. The forest land proposed to be diverted shall under no circumstances be transferred to any
other agency, department or person without prior approval of Government of India.
2l. Violation of any of these conditions will amount to violation of Forest (Conservation) Act,
1980 and action would be taken as the MoEF&CC Guideline F.No.11-42/2017-FC dated
29/01/2018.
22. The User Agency will have to obtain the Forest (Conservation) Act, 1980 for removal, if any,
of stone, of river sand, river boulders in forest land.
23. Any other condition that the Ministry of Environment, Forests & Climate Change, IRO,
Shillong may stipulate from time to time in the interest of conservation, protection and
development of forests & wildlife.
24. This approval may be revoked if the above conditions of approval are not complied to the
satisfaction of the Integrated Regional Office, Shillong.
25. Any other conditions as may be found appropriate in future for the betterment of environment
& wildlife, may be imposed by Integrated Regional Office, Shillong.

Copies of the forest clearance and this order should be submitted to all head of local bodies,
Panchayats/Municipal bodies etc. for wide publicity.
The District Forest Officer, Unakoti is also requested to submit the monitoring report time to
time to the Nodal Officer, FCA ensuring compliance of all conditions. -
The District Forest Officer, Unakoti is also requested to take immediate action in respect of uploading
the KML files of the area tobe diverted, the CA shall be uploaded on the e-green watch portal.at SI.No.5.

.~ Now therefore, the land is to be handed over to the user agency and certificate to this effect is
to be submitted to the Nodal Officer FCA along with GPS coordinates over the area.

This has got reference to the Slate Government of Tripura


2021/374-77 dated 19.07.2021 and even
on the subject mentioned above, seeking prior approval of
