MODULE 1: LAW OF TORT
Answer ONE question from this section.
EITHER
1. Jack, aged 24, and Johnny, aged 12, are playing football on the village playing field which is next
to Mr Grumpie’s fenced fruit orchard. The boys jump over the fence to retrieve the ball. Jack falls
into a deep pit dug by Mr Grumpie as a trap for thieves who have been stealing his fruits. Jack
breaks his foot and is bleeding from a huge cut on his head. Johnny’s foot is caught in a trap and
he falls, breaking his hand and one of his toes. When confronted by Jack and Johnny’s parents,
Mr Grumpie mutters, “What were they doing in my yard? They looked for that! I am tired of
thieves and trespassers!”
(a) ith reference to ONE decided case or statute, briefly explain EACH of the following

2. Feng and Ojara attend a party at the end of June. Feng consumes several alcoholic drinks and
offers to take Ojara home after the party. At first she refuses, but because the road is dark, wet and
lonely, she accepts. On the way Feng drives at a high speed and, as the road is wet, the car skids
and crashes into a bridge. Ojara, who is not wearing her seatbelt, is thrown through the windscreen
and sustains major head injuries. Feng sustains minor injuries. Ojara’s relatives accuse Feng of
breach of duty of care.
(a) (i) Define the term ‘duty of care’. [2 marks]
(ii) Identify TWO criteria for the imposition of a duty of care. [2 marks]
(b) Outline ONE defence that Feng may raise. Use TWO decided cases to support your answer.

(c) Three members of a ship’s crew desert the ship. The captain promises John and Peter,
crew members, that they would share the wages of the three deserters if they get the ship
home safely. John and Peter complete the task. The captain refuses to pay John and Peter
the additional wages. Using TWO decided cases to illustrate your answer, advise John
and Peter on whether or not they can sue for breach of contract. [15 marks]

SECTION C
MODULE 3: REAL PROPERTY

5. In 2011, Mikale and his wife Morganie purchased White Mountain Castle as joint tenants. They
held the property as co-owners until Mikale died of cancer leaving his wife. Three months after
her husband’s death, Morganie died of grief. Morganie had one daughter, Angie, before she
married Mikale and he had two children, Kenny and Johnny, by a previous marriage. Mikale and
Morganie had no children together. Just before he died, Mikale made a will leaving his share in
the castle “to my good friend Rosie for her own use absolutely”.
(a) (i) Define the term ‘co-ownership’. [2 marks]
(ii) Outline TWO differences between ‘joint tenancy’ and ‘tenants in common’.
[4 marks]
(b) Rosie has a copy of the will and comes to you for advice on how to claim the castle.
Explain to her whether or not she has any legal right to the castle. [4 marks]
(c) Kenny and Johnny (children of Mikale) and Angie (child of Morganie) want to get their
inheritance from their parents and come to seek your advice. With reference to TWO
decided cases, explain to them whether or not they are entitled to the castle.

6. Mrs Annestina leases Mr Ramsingh’s house for five years. In the lease, she covenants to pay the
rent and to keep the building in good repair. The lease also included a covenant not to assign the
lease or sublet without first getting the consent of the landlord. The lease also reserved to the
landlord a right of re-entry on breach of any of the covenants. Mrs Annestina owes three months’
rent. When Mr Ramsingh goes to the house to speak to her about it, he finds out that Mrs Annestina
has rented two rooms without his knowledge or premission. Mr Ramsingh is very angry about
this and comes to you for advice.
(a) Distinguish between ‘freehold estate’ and ‘life estate’. [4 marks]
(b) Explain briefly ONE implied covenant of the landlord under a lease. Use ONE decided
case to illustrate your explanation. [6 marks]
(c) Advise Mr Ramsingh on any legal remedies that are available to him. Refer to ONE case
or example in your answer. [15 marks]
