COMPLAINT AFFIDAVIT

I, Marsha Mallari, with live-in partner, 36 years old, call center agent, and
residing at 113 Legarda Street, Sampaloc, Manila, after having been duly sworn to in
accordance with the law, do hereby depose and state THAT:

1. I am the mother of Phoebe Kaye Mallari (deceased), also known as “PHIB”, 13

years old, Grade 7 pupil at Legarda Elementary School, Sampaloc, Manila and a
resident of 113 Legarda Street, Sampaloc, Manila;

2. On November 20, 2022, at 9:15 AM, I received a call from one of our neighbors,
Mrs. Pricilla Dimaguiba, telling me that she found Phib lying naked in our living
room. She also told me that she saw my live-in partner, Maximo Burandim who
seemed to be drunk, entered our house while she was opening her store at 4:00
AM of the same morning then left at 6:00 AM and drove his taxi bearing plate
number ABC 123 towards Figuera Street, Sampaloc, Manila;

3. I immediately informed my supervisor and rode a taxi cab going to our residence.
I reached home at about 10:00 AM and I was met by Mrs. Dimaguiba together
with a police officer who tried to calm me. After a while, the female police officer
asked me for any information that may aid for the immediate arrest of Maximo
Burandi;

4. At about 12:00 noon, I informed the police about my willingness for the conduct
of autopsy on my daughter then asked my mother to assist them. I was then
informed that my former live-in partner was already in the custody of Sampaloc
Police Station 4;

5. I went together with the police to their office and confirmed that the man whom
they apprehended is Maximo Burandi whom I had been living with for about two
(2) years. I informed the investigator-on-Case that I will file a complaint against
Maximo Burandi and will give my statement after the autopsy;

6. On November 21, 2022, at about 3:00 AM, the Investigator-on-Case called and
told me that the results of the autopsy are ready and asked for my presence in
their office. I proceeded to Sampaloc Police Station 4 together with Mrs.
Dimaguiba where I was informed that my daughter was raped before she was
killed;

7. I am executing this affidavit to file a complaint against Maximo Burandi for the
crime of Rape with Homicide committed against my daughter, Phoebe Kaye
Mallari.
 IN WITNESS WHEREOF, I have hereunto affixed my signature this 21st day
