SYNOPSIS OF OVERTIME

(THE FACTORIES ACT, 1948)

The object of this Act is to secure to the workers employed in the factory health, safety,
welfare, proper working hours, Overtime, leave and other benefits. The Act aims at
protecting workers employed in factories from unfair exploitation by the employer.
Section 59 of The Factories Act, 1948 talks about the provisions of Overtime. The
Maharashtra Welfare Officers Rules, 1966 are prescribed under rule 101 of the Act. Some
provisions that mentioned in these rules are as follows: -
Overtime (Section 59): -
 If a worker workers more the 9hrs per day or 48hrs per week, then they will get the
overtime.
 The overtime is double(2X) rate of ordinary rate of wage
 Where a worker are paid on Piece-Rate basis then time rate shall be calculated on
their average daily rate by Day/Month.
 Calculating the earnings for the days on which the worker actually worked, including
the cash equivalent to workers of food grains and other articles may be prescribed
on the basis of the maximum quantity of food grains and other articles admissible to
a standard family.
{”Standard family” means a family consisting of the worker, his or her spouse and two
children below the age of fourteen years requiring in all three adult consumption units.}
{”Adult consumption unit” means the consumption unit of a male above the age of
fourteen years; and the consumption unit of a female above the age of fourteen years
and that of a child below the age of fourteen years shall be calculated at the rates of 0.8
and 0.6 respectively of one adult consumption unit}
 If an employer send his workers on tour which is related to the companies work then
the workers are eligible for the daily and travel allowances.

The Maharashtra Welfare Officers Rules, 1966: -


Overtime Slip (Rule 96): -
 If a worker has done overtime at factory then manger has to maintain it in overtime
slip and a slip given to the worker after overtime.

New Labour Code: -


Workers cannot be required to work for more than 6 days / week and will be entitled to one
day off for every 20 days of work & one day off every week
