INTRODUCTION

JURISDICTION

is the define area over which authority and responsibility extence. Jurisdiction
draws its substance from internal law, conflict law, Constitutional law and power
of the executive and legislative branches of government to allocate resources to
best serve the need of society. The following are the Jurisdiction which governs
the Ward Tribunal Act, Road Traffic Act, The National Defense Act, The law of the
child of the Criminal matters.

THE WARD TRIBUNAL ACT.

The Ward Tribunal are established under section 3 of the Ward Tribunal Act (cap
206. R.E 2002), and the said provision have note been repealed. It's the
Jurisdiction of the Ward Tribunal Act over land matters which is now limited to
mediation and that has along being primary function of the Ward. The Ward
Tribunal Act Jurisdiction in Criminal matters is provided under section 10(1)(a). In
Criminal matters a fine not exceeding ten thousand shillings foristance of the
offense going armed in public or is established section 84 of the Penal Code a fine
of 800/= or 2years imprisonment

THE LAW OF THE CHILD ACT

The Tanzania Law of the Child Act in Criminal matters Jurisdiction is the Power
which the sovereign authority of state has vested in the Courts and other Tribunal
established by law to determine questions which arise out crime committed in
that state. The Law of the child Act Jurisdiction is Provided under section 98(1)
which states "the Juvenile Court shall have power to hear and determine;

a) Criminal charges against the Child

b) the application relating to a Child care, maintenance and protection. Whereas


section 98(2) states, " the Courts shall have Jurisdiction and exercise powers
conferred upon to a Child care maintenance and protection.

THE NATIONAL DEFENSE ACT


The National Defense is the main program for military and energy production or
construction Military or critical infrastructure existence to any foreign Nation
home land security, stock keeping place and any directly related activities. The
National Defense Act Jurisdiction of Criminal matters is Provided under first
schedule C 90-(1). A commanding officer may in his direction try an Accused
person by summary trial but only if all of the following conditions are satisfied;

a) The Accused person is either a subordinate officer or man below the rank of
Ward Officer.

b) Having regard to the gravity of offense, the commanding officer considers that
his power of punishment are adequate.

c) The commanding officer is not precluded from trying the accused person of his
creation under Defense regulations to be tried by Court Martial,

d) the offense is not one that, in accordance with Defense force regulation, the
commanding officer is precluded from trying,

(I) subject to the conditions set out in this section and in part II of this code
relating to the punishment, a commanding officer at a summary trial may pass a
sentence in which any one or more of the following punishment will may be
included

i) detention for the period not exceeding ninety days subject to the following
provision

 A punishment of detention imposed by a commanding officer or a non


commissioned officer shall not carry into effect until approved, and
 Where a commanding officer imposes more than thirty days detention, the
petition on the excess of thirty shall be effective only if approved by and to
the extent approved by an approving authority

ii) reduction in rank, but a punishment of reduction in rank is imposed by a


commanding officer shall be effective only if approved by and tot he extent
approved by an approving authority.
THE ROAD TRAFFIC ACT

An Act to prove for control and regulations of road Traffic. The act may be be
cited as the Road Traffic act. Administrative consolidation of the Road Traffic Act
2002. It is prepared by the Law reform commission in accordance with Act of 1975
(3/1975) to keep the law under take revision and consolidation of statutes law.
Jurisdiction of Criminal matters to this act I'd Provided under section 46(2)(a) to
the road Traffic Act which states "in respect of an offense under paragraph a or b
of that subsection for imprisonment for a term not exceeding six months or to a
penalty not exceeding one hundred thousand shillings or to both such
imprisonment and penalty.

Generally, when speaking on the term "Jurisdiction" it is the wide word which
may formulate many definitions and meanings although its basic definition
remains as to what is called the power of the Courts to exercise its power and
determine different cases brought before it. This is to say through the Courts is
where justice peace are found. Exceptions to this many problems may occur when
the Court may not stand strong to maintain justice in the state.
