AGENCY AGREEMENT

owner of the plot) and LUX COMMERCIAL AGENCIES (herein after called the Agents) of POST OFFICE BOX 35,
KERICHO aforesaid of the other part whereas the flats, rooms constructed thereon are let to various tenant and
whereas the agents to collect all rent and pay the same to the owner .ITS IS HEREBY AGREED between the
parties as follows:

1. The owner hereby agrees with the agent to collect rental income from the aforesaid mentioned premises.
2. In CONSIDERATION, the owner agrees that the Agent will be paid …..…….of all such rent collected. The
agent will collect the rent and pay the same to the owner by………Every month or deposit

4. The Landlord shall receive the total amount due and the agent shall follow up the arrears and Take
the necessary legal steps in line with the provisions of the Government laws on tenancy
, which include;
a) A notice to pay within seven days in writing and failure to do so,
b) A notice to vacate followed by the tenant submitting an item or items equivalent to the
Arrears accrued, to be held by the agent awaiting a full settlement within the legal time
Frame and failure to pay within the stipulated time, the items shall be sold and the
Landlord given his/her dues.
5. This agreement shall commence on. ………………. And will expire after…………

Party by giving to the other notice in writing
6. This agreement may be extended by mutual agreement of both parties
7. The owner shall be responsible for maintenance and upkeep of the building unless the Landlord/landlady orders
the agency to do so.
8. The land lord has no right to collect money on behalf of the agents after signing this agreement and Any
advance payment to the landlord will attract 12% interest thereof.
