Facts:
Petitioner Pua filed a complaint for a Sum of Money against spouses Benito and
Caroline. She alleged that the spouses obtained several loans from her without
collateral, except for post-dated checks bearing the borrowed amounts. When the
checks were presented to the drawee bank, all were dishonored. Later, the respondents
delivered to petitioner Asiatrust Check No. BND057750 with the amount of Php
8,500,000, which was also dishonored by the bank.
Respondent-spouses, on the other hand, denied obtaining loan from petitioner.
They allege that the checks issued were not intended for Pua, but for the benefit of other
persons.
The RTC ruled in favor of petitioner, stating that the possession by petitioner of
the checks signed by Caroline raises the presumption that they were issued and
delivered for a valuable consideration. On appeal, the CA reversed the RTC’s decision,
holding that the bank check was incomplete delivered instrument and that petitioner has
failed to prove the existence of the indebtedness. Hence, this petition.

deemed evidence of indebtedness.
