COLLECTIVE AGREEMENT

THIS AGREEMENT is made 6 April 2009 between the Society of London


Theatre/Theatrical Management Association (SOLT/TMA) of the one part
and Equity of the other part.

Whereby it is agreed as follows:


1 SCOPE OF AGREEMENT
This Agreement sets forth in the Standard form of Contract annexed hereto (hereinafter called
‘the Annexed Contract) minimum terms and conditions which shall be observed by members
of SWET/TMA (hereinafter called “the Manager) for the employment of Stage Management for
Opera and Ballet at theatres in any part of the United Kingdom.

2 DURATION OF AGREEMENT
The Agreement shall commence on 6 April 2009 and shall subsist until terminated on or after
the expiry of 3 years thereafter by either party giving the other not less than 6 months’ prior
written notice accompanied by detailed proposals for its revision. Provided that either party
hereto shall be entitled to give the other not less than 3 months written notice before each
anniversary of this Agreement seeking such revision to the minimum salaries set out in Clause
3 as shall be specified in such notice and such revisions as shall be agreed by the parties
hereto shall take effect as from the anniversary of this Agreement to which they relate or the
expiration of the said notice (whichever shall be the later).

3 MINIMUM SALARY FROM 6 APRIL 2009


The Artist’s minimum weekly salary shall be:

SCHEDULE 1
1 HOURS COVERED BY WEEKLY SALARY
1.1 The Artist’s weekly salary hereunder shall cover his/her services for not more than 44 hours per
week (Monday to Saturday inclusive) between 9.00am and midnight exclusive of breaks but
inclusive of travel.

1.2 Provided that:


1.2.1 The Artist’s time and a half hourly rate shall be payable for each hour (or part thereof)
he/she works in excess of 44 hours per week (Monday to Saturday inclusive).

1.2.2 The Artist’s double time hourly rate shall be payable for each hour (or part thereof) he/she
works in any week (Monday to Saturday inclusive) between 11.30pm and 9.00am.

1.2.3 If the Artist is called to work on a Sunday or Statutory Holiday he/she shall be paid
therefore at his/her double time hourly rate for not less than 4 hours and his/her
double time hourly rate for any hour (or part thereof) of work thereafter.

2 BREAKS DURING WORKING DAY


2.1 Missed Break Payment
If two breaks per day (Monday to Saturday) each of at least one hour’s duration (not part of
working time and free of all duties including any setting or clearing away of props etc before or
after rehearsals, and free of all travel), are not given to an Artist between 12 noon and 3pm. (first
break) and between 5.00pm and 8.00pm (second break) then the Artist shall be paid for an hour
at his/her double time hourly rate for each such one hour break(s) (or part thereof) as is not given.

2.2 The Manager shall give the Artist a break (not part of working time) of at least 15 minutes in
every 4 hour rehearsal period and if the Artist does not receive such break(s) then he/she shall
be paid for half an hour at his/her single time hourly rate for such break(s) (or part thereof) as
is not given

2.3 If a break of at least 11 hours is not given to the Artist between the end of one day’s work and
his/her first call on the following day then such Artist’s double time hourly rate shall be payable
per hour (or part thereof) of such 11 hour break as is not given (save to the extent that the Artist
is required to work between 11.30pm and 9.00am, or on Sunday, when his/her double time
hourly rate is already payable.

2.4 Broken Weeks


A full week’s salary shall be payable to the Artist for a broken week at the commencement or
termination of his/her engagement hereunder unless such midweek commencement or
termination is at his/her request when one-sixth of his/her weekly salary shall be payable for
each day worked.

3 OVERTIME
3.1 The Artist’s single time hourly rate shall be calculated by dividing his/her weekly salary under
Clause 4 of the Annexed Contract by 44 and shall be payable per hour (or any part thereof).
Such single time rate shall be multiplied by 1½ and 2 respectively for the calculation of the
Artist’s time and a half and double time hourly rates respectively.

3.2 Any period worked by an Artist for which he/she is paid overtime hereunder shall not be
included in the said 44 hours.

4 TRANSPORT/TRAVEL
4.1 The Manager shall (subject as hereinafter provided) provide the Artist’s transport from the
station nearest to the Artist’s address to the town where the Opera or Ballet shall be produced
and thence from place to place where it is performed during the engagement and back to the
station nearest to the Artist’s address and also incidental transport whilst crossing London
and other Centres. The Manager shall not be liable for any railway fares through the termination
of the engagement unless such termination is caused by the Manager or is mutually agreed.

Provided that:
4.1.1 The Artist may travel independently and the Manager shall pay him/her a sum equal
to the appropriate second class fare for the journey or such concessionary rail fare
for the journey as the Manager may have obtained.

4.1.2 When the Artist is required to travel overnight by rail the Manager shall provide and
pay for a second class sleeper (where such facility exists).

4.1.3 For journeys to and from Northern Ireland, the Manager shall provide an air ticket
(unless the Artist specifies otherwise).

4.2 Late Night Transport


If the Artist is required to remain in the theatre or in any place where he/she may be required
to perform his/her duties after 11.30pm, or the hour at which his/her normal public transport
ceases, whichever shall be the earlier, the Manager shall pay any reasonable expenses which
the Artist shall incur for transport to his/her place of residence. Should the Artist be working
in London hereunder this obligation shall be limited to the provision of transport up to a
maximum of 25 miles and if working in the provinces to a maximum of 15 miles.

4.3 Sunday Travel


If the Artist is required to travel on any Sunday he/she shall be paid per hour (or part thereof)
at his/her double time hourly rate.

5 EXCLUSIVE SERVICES
5.1 The Artist is engaged exclusively by the Manager and shall not during the engagement perform
or otherwise exercise his/her talent for the benefit of any other Company, institution or person
without the written consent of the Manager first having been obtained but such consent shall
not be unreasonably withheld.

5.2 The Artist shall declare in writing to the Manager before the signing of his/her Contract all
engagements previously entered into which have to fulfilled during either the rehearsal or the
playing period.

6 SOUND BROADCAST AND TELEVISION RELAYS


An Artist required to perform duties for a sound broadcast or television relay shall be paid an
additional sum not less that the appropriate minimum fee which may from time to time be
agreed between Equity and the British Broadcasting Corporation or the appropriate television
Company. The Manager shall inform the Equity Office in advance of any such sound broadcast
or television relay.

7 ILLNESS OF ARTIST AND ABSENCE WITHOUT CAUSE


7.1 An Artist absent from a rehearsal or performance through incapacity or illness shall inform the
Manager of such incapacity/illness as soon as it is practicable. For each day of absence due
to illness the Artist shall furnish the Manager with reasonable evidence of his/her incapacity,
eg, a self-certificate for spells of up to 7 days or a doctor’s statement for spells of more than
7 days. The said evidence shall be supplied to the Manager within 72 hours of the Artist’s
informing the Manager of being incapacitated. If such evidence is not supplied within 72 hours
the Manager may by notice in writing forthwith terminate the engagement.

7.2 During the Artist’s engagement hereunder notwithstanding any such medical certificate as
above mentioned the Manager shall be entitled by notice in writing forwith to terminate the
engagement if the Artist shall by reason of incapacity by illness or accident have been absent
during his/her engagement hereunder for more than an aggregate of ten weeks in one year.

7.3 No deduction may be made by the Manager from the Artist’s salary for an aggregate of five
weeks of absence in one year due to illness or accident and not more than one half of the
Artist’s salary may be deducted by the Manager in respect of an aggregate of a further five
weeks of the Artist’s absence in such year due to illness or accident, provided that during each
of the first 3 of such further 5 weeks the Manager shall pay the Artist Statutory Sick Pay in
addition to one half of his/her salary.

7.4 Absence from work for any cause other than illness or accident shall entitle the Manager to
deduct from the Artist’s salary for the week(s) in question a proportion thereof representing the
number of hours or parts thereof missed proportionate to the number of hours called and/or
to terminate the engagement forthwith or to report the matter to the appropriate Theatre
Council for consideration and recommendation in accordance with Schedule 2 hereof.

7.5 The Artist shall if required by the Manager submit to examination by a fully qualified medical
practitioner nominated by the Manager and the cost of such examination shall be borne by the
Manager.

7.6 The word “Illness” shall include any bodily or mental infirmity of the Artist.

8 APPEARANCE ON STAGE
8.1 In Costume
In the event of the Artist being required, in the course of his/her duties, to appear in a
performance on stage in costume designed for the production he/she shall be paid the sum
of £15.00 for each performance and shall be provided by the Manager with any makeup
required. The senior stage manager shall not be required to appear on stage in costume.

8.2 In Blacks/Flower Presentation


The customary presentation of flowers on stage at the end of a performance and any
announcements from the stage shall not attract the said £15.00 payment, nor shall any
appearance in ‘blacks’ (other than black costume).

8.3 Maintenance
All costumes, hairpieces, wigs and “blacks” shall be provided, cleaned and maintained by the
Manager and shall not be removed from the theatre by the Artist without the consent of the
Manager.

8.4 An Artist shall not normally be required to wear another person’s costume, hairpiece, wig,
boots or shoes unless they have been properly cleaned and the Manager shall ensure that the
same are clean, sanitary and in good repair.

8.5 An Artist shall not be required to wear body make-up unless adequate shower facilities for the
removal thereof are provided for by the Manager.

19 DRESS
If an Artist is required to wear a particular form of formal dress the Manager will make a
contribution of £10.00 per week (to be increased annually by the RPI% figure published in
March) to the cost of the same for the duration of the Artist’s Contract.

10 FORCE MAJEURE
No salary shall be payable for any performance during which any theatre at which the
Company may or should be performing is closed by reason of royal demise, national mourning,
enemy action, fire, strikes or lock-outs, or by reason of the order of any licensing or other
public authority having jurisdiction or for any cause beyond the control of the Manager.

11 HOLIDAYS
11.1 The Artist shall be entitled to 28 days annual paid holiday, pro rata. The 28 days includes
statutory holidays.

11.2 Provided that:


11.2.1 a Manager can at the expiration of the engagement pay the Artist salary in lieu of any
holiday of up to 4 days to which he/she shall have become entitled but shall not have
taken.

11.2.2 the Artist shall not be required to take holiday during his/her engagement of less than
6 working days notwithstanding that holiday entitlement accrued may be less than 6
working days.

11.2.3 the Manager shall give the Artist not less than 8 weeks written notice of any holiday
period he requires the artist to take during his/her engagement (written notice of holiday
for the whole Company may be given by a notice on the Theatre’s notice board).

12 TOURING ALLOWANCE
12.1 Touring Allowance
If the Manager requires the Artist to perform his/her duties other than in the town in which the
Company is based and if the Manager requires the Artist to remain there overnight the Manager
shall pay the Artist such amount as shall from time to time be agreed between Equity and
SOLT/TMA.

12.2 Subsistence Allowance


If the Manager requires the Artist to perform his/her duties in the town in which the Manager
is based for an engagement of less than 52 weeks, and
12.2.1 the Artist’s home address is more than 25 miles from such town

12.2.2 the Artist does not normally commute to such town as a substantial part of his/her
working pattern.

the Manager shall pay the Artist a subsistence allowance of £78.00 per week (to be increased
annually by the RPI% figure published in March) for the first twelve weeks of such engagement
during which the weekly touring allowance is not payable.

12 TRANSFER OF DUTIES
If the Artist is required to undertake the duties of another Artist senior to him/her on account
of such senior Artist’s absence he/she shall be paid not less than the appropriate minimum of
that senior grade provided that this need not apply in the case of occasional brief absences
not exceeding 24 hours.

13 HANDLING OF PRODUCTION SCENERY


Whether the Company is rehearsing in the Theatre or in rehearsal rooms with scenery and/or
props the Manager shall provide Stage Hands to move the scenery and/or props when the
Artist and the Manager mutually agree that this is necessary.

14 STAFFING
A Stage Management Team for an Opera Company shall comprise a team of three, normally
consisting on one Stage Manager, one Deputy Stage Manager and one Assistant Stage
manager. A Ballet Company shall engage at least one member of Stage Management at no
less than the minimum salary for a Stage Manager.

Subject to discussion between the Manager and Equity on each occasion this minimum
staffing may be reduced (Opera) or augmented (Opera and Ballet) in recognition of the
requirements on a particular production and/or special circumstances in which a particular
production may be presented.

15 MEMBERSHIP
The provision of Schedule 3 hereto shall apply to the engagement of Stage Management staff.
A non-member ASM engaged under the provision of Schedule 3 hereof shall on signing the
Contract be encouraged to apply for Equity membership.

16 GENERAL PROVISIONS
16.1 The Artist shall before the first performance in each town notify the Company Manager of
his/her address and shall immediately notify any change thereof.

16.2 All notices referring to the Company in general shall be placed on the Company Manager’s
Notice Board and the placing of such notices on the said board shall be deemed to be valid
notices to every Artist of the Company currently appearing. All other notices or
communications shall be in writing and addressed to the Manager at the Office of the Manager
or to the Artist at any theatre or place where the Company may be rehearsing or performing
or the address of the Artist entered in the Company Manager’s book or to the address of the
Artist stated herein.

16.3 The Artist shall comply with and conform to the rules of any theatre or building at which the
Company may be rehearsing or performing and all rules made by the Manager (insofar as such
last-mentioned rules do not conflict with the terms of his/her Contract or any house agreement)

16.4 The Artist shall appear at all performances and perform the services required of the Artist under
his/her Contract in a diligent and painstaking manner, provided that the Artist shall not be
required to render services of a hazardous or dangerous nature or which involve an
unreasonable degree of risk.

16.5 No public press announcement relating to the Opera or Ballet or any incident arising therefrom
shall be made by the Artist directly or through any press agent without the written permission
of the Manager, which permission shall not be unreasonably withheld.

17 CONDITION OF VEHICLES
It shall be the responsibility of the Manager to ensure that any Company vehicle is maintained
in a fully safe, roadworthy and lawful condition, and that all vehicles are comprehensively
insured.

If the Artist at the Manager’s request or specific permission uses his/her own transport for
duties in connection with a production such Artist shall be reimbursed therefore any costs
incurred in up-grading his/her insurance cover to Comprehensive Class 1 Motor Insurance for
the period of such use on the Manager’s behalf and reimbursed for actual fuel costs incurred.

18 NATIONAL INSURANCE CONTRIBUTIONS


The Manager shall issue to the Artist a certified statement of National Insurance contributions
paid in respect of the Artist during his/her engagement.

19 PAYMENT OF SALARY
Subject to any different arrangements made by the Manager and agreed by Equity the Artist’s
weekly salary shall be made available not later than 13.00 hours on Friday of the week to
which it relates.

The Manager shall supply each week to the Artist a payslip showing the date, the Artist’s
name, gross cumulative pay (including allowances and other payment, which shall be clearly
identifiable) deductions and net pay.

20 HEALTH AND SAFETY


In accordance with the Health and Safety at Work Act 1974, the Manager will provide and
maintain safe and healthy conditions of work. A written statement of general policy regarding
health and safety matters will be posted at the place of work.

21 EQUAL OPPORTUNITIES
The parties to this Agreement are committed to Integrated Casting and to the development of
positive policies to promote equal opportunities regardless of sex, marital status, colour, race,
creed, ethnic origin, age, sexual orientation or physical disability. The principal criteria for
selecting an Artist for a particular job shall be that Artist’s ability and the requirement of the job.
The parties agree that they will review from time to time the operation of this policy.

22 MATERNITY LEAVE
The Artist shall be entitled to statutory maternity rights in accordance with the relevant
legislation from time to time in force.

23 PATERNITY LEAVE
The Artist shall be entitled to statutory paternity rights in accordance with the relevant legislation
from time to time in force.

SCHEDULE 2
The provisions of the Arbitration Clauses within the West End and Commercial Theatre Agreements
shall be deemed to be included and shall form part of this Agreement.

SCHEDULE 3
1 The Manager agrees in the normal course of events, not to offer engagements for any Opera
or Ballet Production to a C&SM, SM or DSM who have not less than 30 weeks professional
experience (Full Membership of Equity shall be deemed to be proof of the necessary
experience), and/or ASMs who have no professional experience (Full or Provisional
Membership of Equity shall be deemed to be proof of the necessary professional experience),
subject to the Manager’s right.

1.1 To employ one ASM per Stage Management Team per year who has no previous professional
experience; but the Manager will use his best endeavours to engage Registered Graduates.

1.2 Of appeal as set out in (2) below.

2 Any Manager wishing to engage a C&SM, SM or DSM for Opera and Ballet who has not had
at least 30 weeks professional experience or an ASM who has no previous professional
experience, in excess of the quota stated in (1) above, shall write to Equity giving his reasons
therefore and Equity shall advise the Manager, within one week, whether they accept or reject
the validity of such reasons.

In the event of a rejection the Manager may appeal to the meeting of the appropriate Theatre
Council to take place within one week and if the Council finds in the Manager’s favour, or fails
to reach a decision, the Manager may engage the person concerned, but if the Council rules
against the Manager, then he may not engage such person.
