Notice of Censure Vote on

24 Republicans who
Voted to Remove Liz Harris

Concerning the Voting of Disorderly behavior by the Ethics Committee, the vote for Expulsion
by the House and the Decision by the Maricopa County Board of Supervisors to Replace, the
Executive Board of LD23 has decided to call for a vote to Censure all 24 Republicans that voted
in favor of what ultimately resulted in the removal of the LD13 Representative Liz Harris.

FACTUAL BASIS FOR CENSURE OF ETHICS COMMITTEE REPUBLICANS:


The Ethics Committee on March 30th, 2023, voted in deciding that Liz Harris committed
Disorderly behavior regarding House Rule 1 and damaged the institutional integrity of the
House. The term "disorderly behavior" used in House Rule 1 solely defines a member who
refuses participation or otherwise disrupts a roll call vote. At no time during this hearing or in
the report by the committee, demonstrated that House Rule 1 was ever violated in such a
manner. Instead, the hearing and report focused on illegally obtained private text messages
that were negligently allowed into the hearing. Furthermore, a cease-and-desist letter was
submitted to the committee chair prior to their ruling from Mr. Thaler for using such material.
Finally, as mandated in ARS 38-519b, the Ethics Committee is required to propose a Code of
Conduct, which they have failed. Rule 37 Code of Conduct, which was not brought up as a
violation, says that the Code of Conduct must be written. However, this Code of Conduct does
not exist, and is a violation of ARS 38-519b and their own House Rule 1, thereby committing
Disorderly Behavior themselves.

FACTUAL BASIS FOR CENSURE OF HOUSE REPUBLICANS:
On April 12th, 2023, the House of Representatives voted to Expel Liz Harris. Based solely on a
report from the Ethics Committee. The Representatives failed to do their own investigation,
understand their own House Rules or lack thereof and apply the Arizona Constitution
correctly. The House of Representatives has failed to have a written Code of Conduct, which is
required in House Rule 37 and is in violation of ARS 38-519b and their own House Rule 1,
thereby committing Disorderly Behavior themselves.
FACTUAL BASIS FOR CENSURE OF MARICOPA BOS REPUBLICANS:
On May 5th, 2023, The BOS chose Julie Willoughby to replace Liz Harris based on the Ethics
Committee results, vote of the House Members and interviews of candidates with the main
question centering around their stance on elections. The BOS failed to investigate on their
own the legitimacy of the expulsion and still had the opportunity to undo the wrongful
termination and reappoint Liz Harris, who continues to receive the highest level of support
from LD13.
ARS 38-519b - Each ethics committee shall propose, and each house of the legislature shall adopt, not later
than thirty days after the beginning of the first regular legislative session, a code of ethics and conflict of
interest requirements as part of the rules of the respective house in the same manner as other rules are adopted.

House Rule 1 - A. The House may punish its members for disorderly behavior and may, with the concurrence of two-thirds
of the members elected to the House, expel any member (Arizona Constitution, Article IV, Part 2, Section 11). A violation
of any of the House Rules shall be deemed disorderly behavior. When a roll call vote is ordered on the floor of the
House and subject to the provisions of Rules 6 and 14, members are required to vote after a reasonable time, as
determined by the Chair, and may be punished for disorderly conduct if the member fails to vote after a reasonable
time.

RULE 37 CODE OF CONDUCT - A. The House shall have a written code of conduct applicable to members. This code of
conduct shall be adopted, and may be amended, upon vote of the majority of the members of the House. B. The House
shall have a written harassment prevention policy applicable to member behavior. This policy shall be adopted, and
may be amended, upon vote of the majority of the members of the House.

THE ETHICS COMMITTEE, HOUSE MEMBERS AND MARICOPA BOS:

Violated the Arizona Constitution in Article 2 Section 1 “A frequent recurrence to


fundamental principles is essential to the security of individual rights and the perpetuity
of free government.” and Article 2 Section 2 “All political power is inherent in the people,
and governments derive their just powers from the consent of the governed, and are
established to protect and maintain individual rights”. Upon taking their Oath of Office,
they Consented to be Governed by the Arizona Constitution and any Statute, Rule or Policy
that is not repugnant to such Constitution. Instead, they placed House Rules above the
Constitution and have failed to maintain individual rights.

Violated the Arizona Constitution in Article 2 Section 5 “The right of petition, and of the
people peaceably to assemble for the common good, shall never be abridged,” By
participating in expelling process of Liz Harris as a Representative of LD13 over
bringing in a person to Petition their government to redress their grievances, they have
violated this Article by intimidating any future Representatives.

Violated the Arizona Constitution in Article 2 Section 6 “Every person may freely speak,
write, and publish on all subjects, being responsible for the abuse of that right.” By
participating in the process of expelling Liz Harris as a Representative of LD13 the
people are no longer free to speak freely without the fear of retribution.

They are in violation of Maladministration, Maleficence, the Arizona Constitution, Oath of


Office to which they consented to be governed and have furthermore lost the Trust of the
PCs of Maricopa in LD23.

With a Unanimous Vote of Approval and a quorum present, the PCs of Maricopa in LD23
approve this Public Censure of the 24 Republicans and that such censure includes:
1. All 24 Republicans no longer have the support nor the assistance in re-election efforts
going forward from the PCs of Maricopa in LD23.
2. All 24 Republicans are expelled from attending any Maricopa LD23 meetings.
3. All 24 Republicans are encouraged to withdraw their Candidacy for re-election.
4. All 24 Republicans are encouraged to resign from office immediately, so that another
Republican willing to Honor their Oath and Uphold the Arizona Constitution can take
their place.
