Sanggunian, Office of the Sangguniang Panlalawigan, the herein Municipal Ordinance No. 2018-
001, of the Sangguniang Bayan of Rizal, Palawan entitled, “AN ORDINANCE
PRESCRIBING A UNIFIED FORM OF CITATION TICKET TO BE USED IN THE
ENFORCEMENT OF ORDINANCES WITH PENAL PROVISIONS, PROVIDING
FUNDS THEREFOR AND FOR OTHER PURPOSES”, with the following comments to wit:

Ordinances with penal provision are very complex to put into practice on the part of the
implementing arm; however, it is the duty of the Sanggunian to see to it that implementation and
compliance of all laws with penal clause it has enacted shall be practical, rational and
expeditious, and availing the strong arm of the law.

A unified form of citation ticket is probably the most sensible way in handling the complexity of
local law enforcement. The issuance of the said ticket can be regarded as an insinuated act which
is necessary, appropriate and incidental in order to enforce ordinances with penal sanctions.

The Sangguniang Bayan, as the legislative body of the municipality, shall enact ordinances for
the general welfare of its inhabitants and the municipality pursuant to Section 16 of the Local
Government Code, viz:

“Section 16. General Welfare. - Every local government unit shall exercise the powers expressly granted, those
necessarily implied therefrom, as well as powers necessary, appropriate, or incidental for its efficient and
effective governance, and those which are essential to the promotion of the general welfare. Within their
respective territorial jurisdictions, local government units shall ensure and support, among other things, the
preservation and enrichment of culture, promote health and safety, enhance the right of the people to a balanced
ecology, encourage and support the development of appropriate and self-reliant scientific and technological
capabilities, improve public morals, enhance economic prosperity and social justice, promote full employment
among their residents, maintain peace and order, and preserve the comfort and convenience of their inhabitants.”

Thus, the power to prescribe a unified form of citation ticket in the enforcement of local
ordinances with penal sanction is viewed as powers necessary, appropriate, and incidental for
the efficient and effective municipal governance, and making it to appear as valid and well
within the authority of the Sangguniang Bayan of Rizal to enact.
