recollection. Drew reported that Jeff did show him text messages. Jeff indicated his
rationale for speaking with Drew was that Jeff did not believe the punishment for Tom fit
the crime. Jeff discussed two other situations (one involved a department of aviation
employee and another involving a DFS employee) involving touching that resulted in
written warnings. Jeff wanted to bounce his opinion off Drew to see if Jeff was off base
with his thinking. Jeff denied his intent was to have Drew do anything or influence
anything with respect to Jeff’s son’s situation. Jeff was asked if he recalled in response
to Drew telling Jeff that he should not speak to Lisa about Tom’s situation telling Drew, “I
know you are just trying to protect me,” and said he probably did say that, yes.

Jeff spoke with Lisa on January 17th. He called Lisa in the afternoon and asked if he
could speak to her about a personal matter. She said “yes” and the two of them met.
Lisa told him she did not know much about Tom’s situation because she was not involved
in the investigation and did not see the investigation report. Jeff told Lisa that he wanted
to see if REDACTED issue involving Tom could be settled before a Step 1. The
settlement proposal would be REDACTED
with the understanding that if the County preferred that Tom no longer be
in the Public Defender Office that there was likely a position for him with the DA on the
criminal side. Jeff indicated most settlements occur either at Step 1 or Step 2. Lisa told
him that she would find out. According to Jeff, the next morning Lisa called him and told
him that settlement could be discussed at any point. Note, there is a slight discrepancy
between what Lisa and Jeff reported in that Lisa indicated she did not take Jeff’s calls on
Wednesday.

Jeff and Lisa spoke on Thursday and Jeff understood that Lisa had communicated with
Kevin and Kevin was not happy they had spoken about his son’s situation. Lisa informed
Jeff that he should have a lawyer and go through the normal process. Jeff reported that
he asked Lisa if the investigation report was similar to two other cases that had recently
been discussed by the REDACTED .

According to Jeff, as a result of this communication, his son retained Adam Levine to
represent him on Thursday (January 19th).

Jeff spoke with Kevin and was informed by Kevin that it was not fair to either him/Jeff or
Lisa that Jeff spoke with her about his son’s situation.

Jeff reported having no communications with the DA’s office about Tom potentially going
to work for the criminal division (setting aside his communication with Lisa informing her
that the criminal side was interested in having Tom work there). Jeff’s understanding is
the criminal division has put everything on hold as far as his son potentially working there
until his situation is resolved. Jeff also denied speaking with anyone in the Public
Defender office, Letty Bonilla or anyone else at OOD other than Drew, or anyone in senior
management about his son’s situation.
