OTHER FACTS
● Applicability: This right is available to both citizens and non-citizens.
● Provides protection: It protects the individual not only against the State but also against private
persons.
● Implementation by law: Any violation of this provision shall be an offence punishable in
accordance with law. That means this fundamental right doesn't have self-implementation, the
legislature has to make law for its implementation. In pursuance of Article 23, Parliament has
passed the Suppression of Immoral Traffic in Women and Girls Act, 1956, for punishing human
trafficking.
EXCEPTIONS
Article 23(2) provides that nothing in this article shall prevent the State from imposing compulsory
service for public purpose, and in imposing such service the state shall not make any discrimination
on grounds only of religion, race, caste or class or any of them.
● Reflected in Fundamental duty: This clause reflects in Article 51A(d) as a fundamental duty of
citizens that It shall be the duty of every citizen of India to defend the country and render
national service when called upon to do so.
● Empowers the State: The State is permitted to impose compulsory service to serve any public
purpose, for example, the state can provide for compulsory military service or social service for
which it is not bound to make any payment.
● No discrimination by State: While imposing such compulsory service, the state cannot make any
discrimination on grounds of religion, race, caste, class or any of them.
should be set up at the union level to make suggestions regarding prevention of sexual
exploitation of children.
● Gaurav Jain vs Union of India (1997): In the case comprehensive directions were given by the
court regarding the issue of rehabilitation of prostitutes and their children in society. The court
ruled that women involved in prostitution were not offenders, instead they should be viewed as
victims of their unfavourable socio-economic conditions. The court emphasized making the
women economically independent through self-employment and vocational training, setting up
juvenile homes for their children to ensure their rehabilitation and safety and directed for
composition of a committee to study the issue and formulate schemes for the upliftment of the
victims.
The Indian concept of secularism is different from the west. The Indian constitution contains
provisions regulating the manner of separation between state and religion. These provisions do not
look to create strict separation between the state and religion, instead maintain a ‘principled
distance’ from religion. However, the Indian state can intervene in practices of religion if they
contravene public order, morality and health. The Indian model of secularism protects all religions
with equal regard but under the overall framework of creating a welfare state, egalitarian society
and maintenance of human dignity.
The right to freedom of religion can be found in Article 25 to Article 28 of the Indian constitution.
These are available to both citizens and non – citizens. The word secular was explicitly added to the
Indian preamble by the 42nd constitutional amendment act.
ARTICLE 25: FREEDOM OF CONSCIENCE AND FREE PROFESSION, PRACTICE AND PROPAGATION OF
RELIGION
Article 25 (1) - Subject to public order, morality and health and to other provisions in this part, all
persons are equally entitled to freedom of conscience and the right to freely profess, practice and
propagate religion.
● Freedom of conscience: It refers to the inner freedom of an individual to mould his relation with
God or creatures in whatever way he desires. An individual has the freedom to decide whether
to be a believer or an atheist.
● Right to profess: It refers to the right to declare one’s religious beliefs and faith openly and
freely.
● Right to practice: It refers to the Right to perform religious worship, rituals, ceremonies and
exhibition of beliefs and ideas.
● Right to propagate: It allows for the transmission and dissemination of one’s religious beliefs to
others or exposition of the tenets of one’s religion.
● Coverage: Article 25 covers not only religious beliefs (doctrines) but also religious practices
(rituals).
● Not an absolute right: The right to religious freedom is not an absolute right and is subject to
reasonable restrictions. These restrictions are: Public order, Morality, Health and other
provisions in Part Three of the Indian constitution.
EXCEPTIONS
Article 25(2) states that nothing in this article [article 25(1)] shall effect the operation of any existing
law or prevent the State from making any law –
a) regulating or restricting any economic, financial, political or other secular activity which may be
associated with religious practice;
b) providing for social welfare and reform or the throwing open of Hindu religious institutions of a
public character to all classes and sections of Hindus.
Thus, Article 25 (2) provides power to the state (specifically legislature with regards to the following
● Regulation of secular activities: The state has the right to make law with respect to secular
activities which are associated with religion. Secular activities associated with a religious practice
are those activities which are not directly connected with religious precepts or beliefs. For
instance management of personnel at temples or charging fees for certain activities to be
performed at a religious place can be regarded as secular activities.
● Provides access to Hindu religious institutions: This means that the state has the right to provide
accessibility to Hindu religious institutions of public character to all sections of Hindus. Also steps
can be taken for bringing about social welfare and reform in such institutions.
● Qualified right: Reasonable restriction of public order, morality and health has been provided by
the constitution.
● Religious denomination: The term ‘religious denomination’ was not defined in the constitution.
The Supreme Court through its judgments, in the Shirur Mutt case and S.P Mittal vs Union of
India case, has defined the term. A religious denomination needs to satisfy certain conditions
before it can avail the benefits given under Article 26 of the Indian constitution.
1. Common Faith: There should be a collection of individuals who have a system of beliefs or
doctrine which they regard as conducive to their spiritual well-being. In addition, the
religious denomination must arise from a particular religion. A group of people having a
common set of beliefs which do not arise from a particular religion cannot be deemed to
constitute a religious denomination. This was the reason in S.P Mittal vs Union of India
wherein the followers of Sri Aurobindo were not considered as a religious denomination as
the followers did not come together for the purpose of one religion.
2. Different traditions: The common system of beliefs followed by the religious denomination
must include religious tenets or principles peculiar to itself. This means that the
denomination must also follow practices and beliefs that are not exclusively a part of that
religion, but are followed in addition or in the place of other practices and beliefs of that
religion. For example; In Ratilal vs State of Bombay the courts decided that Swetambar Jains
constitute a separate religious denomination as they have practices which are unique and
different from practices followed by Digambars – the other branch of Jainism.
3. Common organization designated by a distinct name: The denomination should identify
itself with a distinct name for example Ramakrishna mission, ISCKON temple possess a
distinct name, in addition they are followers of one religion and have certain traditions
unique to them.
● Right to property: The right to property is a fundamental right for religious denomination but
not for citizens. This right to acquire movable and immovable property given in clause (d) is
different from the right to manage its own affairs in matters of religion given in clause (b). The
religious denomination's right to manage its religious affairs is a fundamental right protected by
the constitution. Thus, no legislation can violate it except for health, morality and public order.
But the right to administer property associated with religion can be exercised only in ‘in
accordance with law’. This means the state can regulate the right to administration of religious
property by way of legislation. The parliament has passed the Places of Worship (Special
Provisions) Act, 1991 in this regard.
ARTICLE 27: FREEDOM AS TO PAYMENT OF TAXES FOR PROMOTION OF ANY PARTICULAR RELIGION
No person shall be compelled to pay any taxes, the proceeds of which are specifically appropriated in
payment of expenses for the promotion or maintenance of any particular religion or religious
denomination.
● It ensures that no person shall be compelled to pay any taxes for the promotion or maintenance
of any particular religion or religious denomination.
● In other words, the State should not spend the public money collected by way of tax for the
promotion or maintenance of any particular religion.
● This provision prohibits the State from favouring, patronising and supporting one religion over
the other. This means that the taxes can be used for the promotion or maintenance of all
religions.
IMPORTANT JUDGEMENTS
Background:
Reverend Stanislaus of Raipur challenged the Madhya Pradesh Dharma Swatantrya Act as it refused
to register conversions. Similarly, the Orissa Freedom of Religion Act was challenged in the Orissa
High Court. In the case it was held by the High court that the definition of the word ‘inducement’ was
too broad and only the Parliament has the right to enact such legislations and state legislature should
not have such rights. The Supreme court heard both these cases together and gave its judgment
upholding the validity of both these acts.
Judgment:
The court held that the right to propagate does not grant the right to convert another person to
one’s own religion. This right allows for transmission or spreading of one’s religion by
comprehensively explaining and describing its tenets. It was held that provisions of Article 25 (1)
apply to every citizen and not only one particular religion. It was held that if a person purposely
undertook conversion of a person to his religion this would impinge on the ‘freedom of conscience’
guaranteed to all citizens of the country.
Importance:
The term ‘religious denomination’ was first defined in this case. Besides this the court gave the
‘essential religious doctrine”.
Background:
Shirur Mutt is a Hindu monastery and one of the Ashta mathas of Udupi. The Ashta mathas of Udupi
are a group of eight mathas or Hindu monasteries which were established by Shri Madhavacharya.
This was to be headed on a rotational basis by swamis. Thus, all swamis were responsible for the
administration of Shrirur Mutt. A ceremony known as ‘Pariyayam’ takes place every alternate year in
Sri Krishna Matha of Udupi. The puja and administration of Krishna Matha is distributed among the
Swamijis of Ashta Mathas. Each Swamiji of every matha gets a chance to perform puja to Udupi Sri
Krishna by rotation for a period of two years. Shirur Math had appointed Lakshmindra Thirtha
Swaminar as the Swami. He handled the ceremonies of 1931 and 1946. He incurred huge liability in
the form of debt through the ceremonies. The Madras Hindu Religious and Charitable Endowments
Act, 1951 empowered the Government authorities to undertake certain actions if a public religious
institution was suspected of monetary misappropriation of its endowments. The 1951 Act had
appointed a Madras Commissioner of Hindu Religious Endowments. In pursuant of its powers under
the act the commissioner started intervening in the debt situation sensing a mismanagement of the
Matha. Clashes arose between the swami and the agent as the agent ignored the authority of the
swami in many instances. Due to this Swami Lakshmindra Thirtha Swaminar filed a petition in the
high court and eventually the case was heard by the Supreme court.
Judgment:
The court ruled the case in favour of Swami Lakshmindra Thirtha Swaminar. The Judgment had two
important outcomes, first it gave the definition of ‘religious denomination’ (discussed above) and
came up with essential religious doctrine.
SABARIMALA CASE
Background:
Women of menstruating age (i.e. those aged between 10 – 50) were prohibited from entry in the
Sabarimala Temple. In 2006, Indian Young Lawyers Association filed a public interest litigation
petition before the Supreme Court challenging the ban. Some major questions raised in the case
were –
1. Did the prohibition on menstruating women’s entry in the Sabarimala Temple violate the Right to
Equality (Article 14), Right against discrimination (Article 15) and the abolition of untouchability
(Article 17) ?
2. Are Lord Ayyappa’s devotees a separate religious denomination?
3. Is women’s exclusion from an ‘essential religious practice’ under Article 25 justified?
4. It was questioned whether Rule 3 of Kerala Hindu Places of Public Worship (Authorisation of
Entry) bans entry of women between age 10 – 50.
Judgment:
The prohibition was done away with and Sabrimala Temple was made open to women in the age
group of 10 – 50. The court decision was based on the following basis –
● Sabarimala’s exclusion of women violated the fundamental rights of women (Aged 10 – 50)
especially it was discriminatory as per the provisions of Article 15. Also it was held that the scope
of right to untouchability is vast and includes social exclusion on the notion of purity.
● It was also held that the devotees of Lord Ayyappa did not fulfil the criteria to be called a
separate religious denomination.
● On the question of Essential religious practice it was held that Ayyappans are Hindus, and the
practice of excluding women cannot be held to be an essential religious practice.
● It was held that Rule 3 (b) of Kerala Hindu Places of Public Worship is violative to the constitution
as it allows public hindu places of worship to exclude women on the basis of customs.
The five-judges constitutional bench’s decision in the Sabarimala case was challenged by more than
fifty petitioners. The supreme court has agreed to review its decision in the Sabarimala case and has
referred it to a larger constitutional bench. However, the review of the decision is pending in the SC
as of March, 2023.
Hijab issue
▪ There was a petition in the Karnataka High court in which it had upheld the ban on wearing Hijab
by Muslim students in educational institutions. This was challenged in the Supreme court before
a two-judges bench where a split verdict was delivered. This meant one Judge was in favour of
the ban and one was against it. Now the case would be held by a larger bench.

अनुच्छेद 23
मानव दु र्व्ाापार और बिात् श्रम का प्रलतषेि
अनुच्छेद 23(1) मानव दु र्व्ाा पार, बेगार (बलात् श्रम) और इसी तरह के अन्य बलात् श्रम कार्यों को प्रततबंतित
करता है ।
अनुच्छेद 23 के तहत लनलषद्ध कार्ा :
● मानव दु र्व्ाापार: इस शब्द का तात्पर्या लोगों को एक र्व्क्ति से दू सरे र्व्क्ति को बेचने और खरीदने से है ,
कभी-कभी तनजी संम्पति की तरह तकसी र्व्क्ति को एक दे श से दू सरे दे श में भी बेचा जा सकता है । मानव
दु र्व्ाा पार शब्द में शातमल है ैः पुरुषों, मतहलाओं और बच्ों की वस्तुओं की तरह खरीद और तबक्री;
वेश्यावृति, दे वदासी और गुलामी सतहत मतहलाओं और बच्ों का अनैततक र्व्ापार।
● बेगार और बिात् श्रम के अन्य रूप: र्यह एक अजीबोगरीब भारतीर्य र्व्वस्था थी तजसके तहत स्थानीर्य
ज़मींदार कभी-कभी अपने काश्तकारों को तबना तकसी भु गतान के सेवाएँ प्रदान करने के तलए मजबूर करते
थे। पीपुल्स र्यूतनर्यन फॉर डे मोक्रेतिक राइि् स बनाम र्यूतनर्यन ऑफ इं तडर्या के मामले में इस शब्द की र्व्ाख्या
न्यार्यालर्य ने की थी। र्यह माना गर्या तक ''बेगार'' बलात् श्रम का एक रूप है जहाँ र्व्क्ति को पाररश्रतमक के
तबना कार्या करने के तलए मजबूर तकर्या जाता है । अनुच्छेद में 'बल' शब्द तववशता की भावना से संबंतित है
अथाा त तकसी र्व्क्ति को उसकी इच्छा के तवरुद्ध कार्या करने के तलए मजबूर करना। र्यहाँ बल में शारीररक
र्या कानूनी बल ही शातमल नहीीं है ; बल्कि इसमें आतथाक परिल्कथितिय ीं से उत्पन्न बाध्यिा भी शातमल है , ज
एक र्व्क्ति को श्रम करने के तलए तििश करता है ।
अन्य तथ्य:
● प्रर्ोज्यता: र्यह अतिकार नागररकों और गै र-नागररकों दोनों के तलए उपलब्ध है ।
● संरक्षण: र्यह न केवल राज्य बक्ति तनजी र्व्क्ति के तवरुद्ध भी र्व्क्ति की रक्षा करता है ।
● कानून द्वारा कार्ाान्वर्न: इस प्राविान का कोई भी उल्लंघन कानू न के अनुसार दं डनीर्य अपराि होगा।
अथाा त इस मौतलक अतिकार का स्व-कार्याा न्वर्यन नहीं है , इसके तक्रर्यान्वर्यन के तलए तविातर्यका को कानून
बनाने की आवश्यकता होती है । अनुच्छेद 23 के अनुसरण में, संसद ने मानव दु र्व्ाा पार से सं रक्षण तथा
दं तडत करने के तलए मतहलाओं और लड़तकर्यों के अनैततक र्व्ापार अतितनर्यम, 1956 को पाररत तकर्या है ।
अनुच्छेद 23(2) प्राविान करता है तक इस अनुच्छेद में कुछ भी राज्य को सावाजतनक उद्दे श्य के तलए अतनवार्या
सेवा लागू करने से नहीं रोकेगा और ऐसी सेवा लागू करने में राज्य केिल िमा, मूलिींश, जातत र्या वगा र्या इनमें से
तकसी के आिार पर कोई भेदभाव नहीं करे गा।
● मौलिक कतार्व् में पररिलक्षत: र्यह खंड अनुच्छेद 51A (d) में नागररकों के मौतलक कतार्व् के रूप में
शातमल है तजसमें यह कहा गया है तक र्यह भारत के प्रत्येक नागररक का कतार्व् होगा तक जब उसे ऐसा
करने के तलए कहा जाऐ तो वह दे श की रक्षा करें और दे श के तलर्ये सेवाएँ प्रदान करें ।
● राज्य को सशक्त बनाता है : राज्य को तकसी भी सावाजतनक उद्दे श्य की पूतता के तलए अतनवार्या सेवा प्रदान
करने की अनु मतत है , उदाहरण के तलए, राज्य अतनवार्या सैन्य सेवा र्या सामातजक सेवा प्रदान कर सकता है
तजसके तलए वह कोई भुगतान करने के तलए बाध्य नहीं है ।
● राज्य द्वारा भेदभाव रलहत: इस तरह की अतनवार्या सेवा लागू करते समर्य, राज्य िमा , नस्ल, जातत, वगा र्या
इनमें से तकसी के आिार पर कोई भेदभाव करने के तलए अनुमतत नहीं है ।
● गौरव जैन बनाम भारत संघ (1997): इस मामले में न्यार्यालर्य द्वारा समाज में र्यौनकतमार्यों और उनके
बच्ों के पुनवाा स के मु द्दे के सं बंि में र्व्ापक तनदे श तदए गए थे। न्यार्यालर्य ने फैसला सुनार्या तक वेश्यावृति में
शातमल मतहलाएँ अपरािी नहीं हैं , बक्ति उन्हें उनकी प्रततकूल सामातजक-आतथाक पररक्तस्थततर्यों के कािण
पीतड़त के रूप में दे खा जाना चातहए। न्यार्यालर्य ने स्वरोजगार और र्व्ावसातर्यक प्रतशक्षण के माध्यम से
मतहलाओं को आतथाक रूप से स्वतंत्र बनाने पर जोर तदर्या, बच्ों के पुनवाा स और सुरक्षा को सुतनतित करने
के तलए तकशोर गृहों की स्थापना और इस मुद्दे का अध्यर्यन करने और पीतड़तों के उत्थान के तलए र्योजनाएँ
तैर्यार करने के तलए एक सतमतत गतठत करने का तनदे श तदर्या।
अनुच्छेद 24
कारखानों आलद में बच्चों के लनर्ोजन पर प्रलतबंि:
14 वषा से कम आर्यु के तकसी भी बच्े को तकसी कारखाने र्या खान में कार्या करने के तलए तनर्योतजत नहीं तकर्या
जाएगा र्या तकसी अन्य खतरनाक रोजगार में नहीं लगार्या जाएगा।
● लनषेि: अतितनर्यम 14 वषा से कम आर्ु के बच्ों के तनर्योजन पर प्रततबं ि लगाता है ।
● अपवाद:लेतकन र्यह तकसी भी हातनरतहत र्या अस्पृह कार्या में उनके तनर्योजन को प्रततबंतित नहीं करता है ।
● लविान:बाल श्रम (तनषेि और तवतनर्यमन) अतितनर्यम, 1986 इस तदशा में सबसे महत्वपू णा कानून है ।
कारावास 6 महीने से 2 वषा तक। बार-बार अपराि करने पर 1 वषा से 3 वषा तक कारावास
का प्राविान है
कल्याणकारी राज्य, समतावादी समाज और मानव गररमा के रखरखाव के समग्र ढाँ चे के तहत सभी िमों के
एक समान रूप से सम्मान की रक्षा करता है ।
िमा की स्वतं त्रता का अतिकार भारतीर्य संतविान के अनु च्छेद 25 से अनुच्छेद 28 में तनतदा ष्ट् है । र्ये नागररकों और
गैर-नागररकों दोनों के तलए उपलब्ध हैं । 42वें संवैिातनक संशोिन अतितनर्यम द्वारा भारतीर्य प्रस्तावना में स्पष्ट्
रूप से िमातनरपेक्ष शब्द जोड़ा गर्या था।
अनुच्छेद लवषर्वस्तु
अनुच्छेद 25 अंतैः करण की और िमा की अबाि रूप से मानने, आचरण और प्रचार करने की स्वतं त्रता।
अनुच्छेद 26 िातमाक मामलों के प्रबंिन की स्वतंत्रता।
अनुच्छेद 27 तकसी तवशेष िमा के प्रचार के तलए करों के भु गतान के संबंि में स्वतंत्रता।
अनुच्छेद 28 कुछ शैक्षतणक संस्थानों में िातमाक तशक्षा र्या िातमाक उपासना में शातमल होने की स्वतं त्रता
अनुच्छेद 25
अंतः करण की और िमा की अबाि रूप से मानने, आर्रण और प्रर्ार करने की स्वतंत्रता।
अनुच्छेद 25 (1) सावाजतनक र्व्वस्था, नैततकता और स्वास्थ्य और इस भाग में अन्य प्राविानों के अिीन, सभी
र्व्क्तिर्यों को अंतैः करण की और िमा की अबाि रूप से मानने, आचरण और प्रचार करने की स्वतंत्रता का
अतिकार है ।
● अंतः करण की स्वतंत्रता: र्यह तकसी र्व्क्ति की आं तररक स्वतंत्रता को संदतभात करता है तक वह ईश्वर र्या
सृजनकताा के साथ अपने संबंि को तजस तरह से चाहे , ढाल सकता है । एक र्व्क्ति को आक्तस्तक र्या नाक्तस्तक
होने का तनणार्य लेने की स्वतं त्रता है ।
● आस्था रखने की स्वतंत्रता: र्यह तकसी के िातमाक मान्यताओं और आस्था को खुले तौर पर और स्वतं त्र
रूप से घोतषत करने के अतिकार को संदतभात करता है ।
● आर्रण करने की स्वतंत्रता: र्यह िातमाक पूजा, अनुष्ठान, समारोह और तवश्वासों एिीं तवचारों के मानने के
अतिकार को संदतभात करता है ।
● प्रर्ार का अलिकार: र्यह तकसी के िातमाक तवश्वासों को दू सरों तक पहुँ चाने और प्रसाररत करने र्या तकसी के
िमा के तसद्धां तों की र्व्ाख्या करने की अनु मतत दे ता है ।
● लवस्तार:अनु च्छेद 25 न केवल िातमाक तवश्वासों (तसद्धां तों) बक्ति िातमा क प्रथाओं (अनुष्ठानों) को भी शातमल
करता है ।
● लनरपेक्ष अलिकार नही ं: िातमाक स्वतंत्रता का अतिकार पूणा/तनरपेक्ष अतिकार नहीं है और उतचत प्रततबंिों
के अिीन है । र्ये प्रततबंि हैं : भारतीर्य संतविान के भाग 3 में ितणषि सावाजतनक र्व्वस्था, नैततकता, स्वास्थ्य
और अन्य प्राविान।
अनुच्छेद 25(2):इस अनुच्छेद की क ई बाि तकसी मौजू दा कानून के संचालन को प्रभातवत नहीं करे गा र्या राज्य
को कोई भी कानून बनाने से नहीं रोकेगा -
a) तकसी भी आतथाक, तविीर्य, राजनीततक र्या अन्य िमातनरपे क्ष गतततवति को तवतनर्यतमत र्या प्रततबंतित करना जो
िातमाक तक्रर्याकलाप से जुड़ा हो सकता है ;
b) सामातजक कल्याण और सु िार के तलए र्या सावाजतनक प्रकार की तहं दुओं की िातमाक संस्थाओं को तहं दुओं
के सभी वगों और अनुभागों के तलए खोलने का उपबंि करती है ।
इस प्रकार, अनुच्छेद 25 (2) तनम्नतलक्तखत के संबंि में राज्य को शक्ति प्रदान करता है (तवशेष रूप से तविातर्यका)
● िमालनरपेक्ष गलतलवलिर्ों का लवलनर्मन: राज्य को िमा से जुड़ी िमातनरपेक्ष गतततवतिर्यों के संबंि में कानू न
बनाने का अतिकार है ।
● तहं दू िातमाक संस्थानों तक पहुँ च प्रदान करता है : इसका तात्पर्ा र्यह है तक राज्य को तहं दुओं के सभी वगों को
सावाजतनक चररत्र के तहं दू िातमाक संस्थानों तक पहुँ च प्रदान करने का अतिकार है । साथ ही ऐसी संस्थाओं में
समाज कल्याण और सुिार लाने के तलए कदम उठाए जा सकते हैं ।
अनुच्छेद 26
िालमाक मामिों के प्रबंिन की स्वतंत्रता
सावाजतनक र्व्वस्था, नैततकता और स्वास्थ्य के अिीन, प्रत्येक िातमाक संप्रदार्य र्या उसके तकसी भी वगा को
अतिकार होगा-
(ए) िातमाक और िमाा था उद्दे श्यों के तलए सं स्थानों की स्थापना और रखरखाव का;
(बी) अपने िमा के मामलों में स्वर्यं प्रबं िन करने का;
(सी) चल और अचल संपति के स्वातमत्व और अतिग्रहण का; और
(डी) कानून के अनुसार ऐसी संपति का प्रशासन करने का
● अलिकार पर प्रलतबन्ध: संतविान द्वारा सावाजतनक र्व्वस्था, नैततकता और स्वास्थ्य पर उतचत प्रततबंि प्रदान
तकर्या गर्या है ।
● िालमाक संप्रदार्: 'िातमाक संप्रदार्य' शब्द को संतविान में पररभातषत नहीं तकर्या गर्या था। सवोच् न्यार्यालर्य
ने अपने तवतभन्न तनणार्यों अथाा त तशरूर मठ मामले, एसपी तमिल बनाम भारत संघ के माध्यम से इस शब्द
को पररभातषत तकर्या है । भारतीर्य संतविान के अनुच्छेद 26 के तहत तदए गए अतिकारों का लाभ उठाने से
पहले एक िातमाक संप्रदार्य को कुछ शतों को पूरा करने की आवश्यकता होती है ।
1. साझा आस्था पद्धलत: ऐसे र्व्क्तिर्यों का समूह होना चातहए तजनके पास तवश्वास र्या तसद्धां त की एक
प्रणाली है तजसे वे अपने आध्याक्तत्मक कल्याण के तलए अनुकूल मानते हैं । इसके अलावा, िातमाक
संप्रदार्य एक तवशेष िमा से उत्पन्न होना चातहए। लोगों का एक समूह जो तकसी तवशेष िमा से उत्पन्न नहीं
होता है , उसे िातमाक संप्रदार्य का संगठन नहीं माना जा सकता है । एसपी तमिल बनाम भारत संघ में
र्यही कारण था तजसमें श्री अरतबंदो के अनु र्यातर्यर्यों को एक िातमाक सं प्रदार्य के रूप में नहीं माना गया
था क्ोंतक अनु र्यार्यी तकसी तिशेर् िमा के उद्दे श्य से संगतठत नहीं हुए थे।
2. लवलभन्न परं पराएँ : िातमाक संप्रदार्य द्वारा अपनाई जाने वाली मान्यताओं की साझा प्रणाली में िातमा क
अनुर्यातर्यर्यों र्या तसद्धां तों को अपने आप में शातमल करना चातहए। इसका तात्पर्या र्यह है तक सम्प्रदार्य को
उन आचरणों और तवश्वासों का भी पालन करना चातहए जो तवशेष रूप से उस िमा का तहस्सा नहीं हैं ,
लेतकन उस िमा की अन्य प्रथाओं और मान्यताओं के अततररि र्या उसके स्थान पर पालन तकर्या जाता
है । उदाहरण के तलए; रततलाल बनाम बॉम्बे राज्य में अदालतों ने फैसला तकर्या तक श्वेतां बर जै न एक
अलग िातमाक संप्रदार्य का गठन करते हैं क्ोंतक उनके पास ऐसी प्रथाएँ हैं जो अतद्वतीर्य हैं और जैन िमा
की दू सरी शाखा तदगंबरों द्वारा अपनाई जाने वाली प्रथाओं से अलग हैं ।
3. एक लवलशष्ट नाम से लनलदा ष्ट सामान्य संगठन: संप्रदार्य को एक अलग नाम के साथ अपनी पहचान
बनानी चातहए, उदाहरण के तलए रामकृष्ण तमशन, इस्कॉन मंतदर का अलग नाम है , इसके अलावा वे
एक िमा के अनुर्यार्यी हैं और उनके तलए कुछ खास परं पराएँ हैं ।
● संपलि का अलिकार: संपति का अतिकार िातमाक संप्रदार्यों के तलए एक मौतलक अतिकार है , लेतकन
नागररकों के तलए नहीं। अनु च्छेद 26(d) में तदर्या गर्या चल और अचल संपति के प्रशासन का र्यह अतिकार
अनुच्छेद 26(b) में तदए गए िमा तिर्यक कायों के प्रबंिन के अतिकार से अलग है । अपने िातमाक मामलों
का प्रबंिन करने के तलए िमा संप्रदार्य का अतिकार संतविान द्वारा संरतक्षत एक मौतलक अतिकार है । इस
प्रकार, स्वास्थ्य, नैततकता और सावाजतनक र्व्वस्था को छोड़कर कोई भी कानून इसका उल्लंघन नहीं कर
सकता है । लेतकन िमा से जु ड़ी संपति के प्रशासन के अतिकार का प्रर्योग केवल 'कानून के अनुसार' ही
तकर्या जा सकता है । इसका अथा है तक राज्य कानू न के माध्यम से िातमाक सं पति के प्रशासन के अतिकार
को तवतनर्यतमत कर सकता है ।
अनुच्छेद 27
लकसी लवलशष्ट िमा की अलभवृक्तद्ध के लिए करों के संदार् के बारे में स्वतंत्रता
तकसी भी र्व्क्ति को ऐसे कर का भुगतान करने के तलए बाध्य नहीं तकर्या जाएगा, तजसकी आर्य तवशेष रूप से
तकसी तवशेष िमा र्या िातमाक संप्रदार्य के प्रचार र्या रखरखाव के तलए खचा के भुगतान में तवतनर्योतजत की जाती
है ।
● र्यह सुतनतित करता है तक तकसी भी र्व्क्ति को तकसी तवशेष िमा र्या िातमाक संप्रदार्य के प्रचार र्या रखरखाव
के तलए तकसी भी कर का भु गतान करने के तलए मजबू र नहीं तकर्या जाएगा।
● दू सरे शब्दों में , राज्य को कर के माध्यम से एकतत्रत सावाजतनक िन को तकसी तवशेष िमा के प्रचार र्या
रखरखाव के तलए र्व्र्य का अतिकार नहीं है ।
● र्यह प्राविान राज्य को तकसी िमा का दू सरे िमा के मु काबले पक्ष लेने, संरक्षण दे ने और समथा न करने से
रोकता है । इसका तात्पर्या र्यह है तक करों का उपर्योग सभी िमों के प्रचार र्या रखरखाव के तलए तकर्या जा
सकता है ।
अनुच्छेद 28
कुछ शैलक्षक संस्थानों में िालमाक लशक्षा र्ा िालमाक उपासना में उपक्तस्थत होने की स्वतंत्रता
● अनुच्छेद 28 (1) र्यह सुतनतित करता है तक राज्य-तनति से पूरी तरह से संचातलत तकसी भी शै क्षतणक
संस्थान में कोई िातमाक तशक्षा प्रदान नहीं तकर्या जाएगा।
● अनुच्छेद 28 (2) यह सुतनतित करता है तक खींड (1) में कही गयी क ई बाि उन तशक्षा सींथिान ीं पि लागू
नहीीं ह गी तजसका प्रशासन राज्य द्वारा तकया जा िहा ह लेतकन उसकी थिापना तकसी तिन्यास या न्यास के
तहत हुई ह ।
● अनुच्छेद 28 (3) र्यह सुतनतित करता है तक राज्य द्वारा मान्यता प्राप्त र्या राज्य-तनति से सहार्यता प्राप्त करने
वाले तकसी भी शैक्षतणक संस्थान में जाने वाले तकसी भी र्व्क्ति को उसकी सहमतत के तबना उस संस्थान में
तकसी भी िातमाक तशक्षा र्या उपासना में शातमल होने की आवश्यकता नहीं होगी। नाबातलग के मामले में
उसके अतभभावक की सहमतत जरूरी है ।
अनुच्छेद 28 चार प्रकार के शै क्षतणक संस्थानों के बीच अंतर स्पष्ट् करता है :
पृष्ठभूलम:
रार्यपुर के रे वरें ड स्टै तनस्लास ने मध्य प्रदे श िमा स्वातंत्र्य अतितनर्यम को चुनौती दी क्ोंतक इसने िमाां तरण दजा
करने से इनकार कर तदर्या। इसी तरह, ओतडशा िमा की स्वतंत्रता अतितनर्यम को ओतडशा उच् न्यार्यालर्य में
चुनौती दी गई थी। इस मामले में उच् न्यार्यालर्य ने कहा था तक 'प्रलोभन' शब्द की पररभाषा बहुत र्व्ापक थी
और केवल सं सद को ही ऐसे तविान बनाने का अतिकार है और राज्य तविानमंडल को ऐसे अतिकार नहीं होने
चातहए। उच्तम न्यार्यालर्य ने इन दोनों मामलों की एक साथ सुनवाई की और इन दोनों अतितनर्यमों की वैिता
को बरकरार रखते हुए अपना फैसला सुनार्या।
लनणार्:
न्यार्यालर्य ने कहा तक प्रचार करने का अतिकार तकसी दू सरे र्व्क्ति को अपने िमा में पररवततात करने का
अतिकार नहीं दे ता है । र्यह अतिकार तकसी के िमा के तसद्धां तों की र्व्ापक र्व्ाख्या और वणान करके उसके
प्रचार र्या प्रसार की अनुमतत दे ता है । र्यह माना गर्या तक अनुच्छेद 25 (1) के प्राविान प्रत्येक नागररक पर लागू
होते हैं न तक केवल एक तवशेष िमा पर। इसके िहि र्यतद कोई र्व्क्ति तकसी प्रर्योजन से तकसी र्व्क्ति का
िमाां तरण करता है तो र्यह दे श के सभी नागररकों के तलए गारं िीकृत 'अंतैः करण की स्वतंत्रता' का उल्लंघन
होगा।
आर्ुक्त, लहं दू िालमाक वृलिदान, मद्रास बनाम श्री लशरूर मठ के िक्ष्ी ंद्र तीथा स्वामी(िोकलप्रर् रूप से ''
लशरूर मठ मामिा'' के रूप में जाना जाता है )
महत्त्व:
इस मामले में पहली बार 'िातमाक संप्रदार्य' शब्द को पररभातषत तकर्या गर्या था। इसके अलावा न्यार्यालर्य ने
'आवश्यक िातमाक आचरण का तसद्धां त' तदर्या।
पृष्ठभूलम:
तशरूर मठ एक तहं दू मठ है और उडु पी के अष्ट् मठों में से एक है । उडु पी के अष्ट् मठ श्री मािवाचार्या द्वारा
स्थातपत तकए गए थे। र्यह स्वामी द्वारा एक आवतानशील आिार पर नेतृत्व तकर्या जाना था। इस प्रकार, सभी
स्वामी तशरूर मठ के प्रशासन के तलए तजम्मेदार थे। उडु पी के श्री कृष्ण मठ में हर एकां तर वषा में 'पररर्यार्यम' के
रूप में जाना जाने वाला एक समारोह होता है । कृष्ण मठ की पूजा और प्रशासन अष्ट् मठ के स्वामीजी के बीच
तवतररत तकर्या जाता है । प्रत्ये क मठ के प्रत्येक स्वामीजी को दो साल की अवति के तलए बारी-बारी से उडु पी
श्रीकृष्ण की पू जा करने का मौका तमलता है । तशरूर मठ ने लक्ष्ींद्र तीथा स्वामीनार को स्वामी तनर्यु ि तकर्या था।
उन्होंने 1931 और 1946 के समारोहों को संभाला। उन्होंने समारोहों के माध्यम से ऋण के रूप में भारी दे नदारी
उठाई। मद्रास तहं दू िातमाक और िमाा था वृतिदान अतितनर्यम, 1951 ने सरकारी अतिकाररर्यों को कुछ कारा वाई
करने का अतिकार तदर्या, अगर तकसी सावाजतनक िातमाक संस्था को अपनी वृतिदान के मौतद्रक दु रुपर्योग का
संदेह था। 1951 के अतितनर्यम ने तहं दू िातमाक वृतिदान के मद्रास आर्यु ि को तनर्यु ि तकर्या था। अतितनर्यम के
तहत अपनी शक्तिर्यों के अनुसरण में आर्युि ने मठ के कुप्रबंिन को भां पते हुए ऋण की क्तस्थतत में हस्तक्षे प
करना शुरू कर तदर्या। स्वामी और एजें ि के बीच झड़पें हुईं क्ोंतक एजेंि ने कई उदाहरणों में स्वामी के
अतिकार की उपेक्षा की। इसके कारण स्वामी लक्ष्ींद्र तीथा स्वामीनार ने उच् न्यार्यालर्य में एक र्यातचका दार्यर
की और अंततैः इस मामले की सुनवाई सवोच् न्यार्यालर्य ने की।
लनणार्:
न्यार्यालर्य ने मामले में स्वामी लक्ष्ींद्र तीथा स्वामीनार के पक्ष में फैसला सुनार्या। तनणार्य के दो महत्वपू णा पररणाम
थे, पहला इसने 'िातमाक संप्रदार्य' की पररभाषा दी और दू सिा आवश्यक िातमाक आचरण के तसद्धां त क प्रस्तु त
तकर्या।
● 'आवश्यक िालमाक आर्रण' का लनिाारण: एक आवश्यक िातमाक आचरण क्ा है र्या क्या नहीं हैं , इसका
तनणार्य स्वर्यं न्यार्यालर्य द्वारा तलर्या जाता है । न्यार्यालर्य र्यह तनिाा ररत करने के तलए िमा के तसद्धां तों का
उपर्योग करता है तक कोई आचरण आवश्यक है र्या नहीं।
इस आचरण का उपर्योग न्यार्यालर्य द्वारा अपने तवतभन्न तनणार्यों में तकर्या गर्या है -
सबरीमािा मामिा
पृष्ठभूलम:
सबरीमाला मंतदर में रजस्वला उम्र की र्युवततर्यों/मतहलाओं (अथाा त 10 से 50 वषा की उम्र की मतहलाओं) का
प्रवेश वतजात था। 2006 में, इं तडर्यन र्यंग लॉर्यसा एसोतसएशन ने प्रततबंि को चुनौती दे ते हुए सवोच् न्यार्यालर्य के
समक्ष एक जनतहत र्यातचका दार्यर की। मामले में उठे कुछ प्रमुख सवाल थे-
1. क्ा सबरीमाला मंतदर में मातसक िमा वाली मतहलाओं के प्रवेश पर प्रततबंि समानता के अतिकार (अनुच्छेद
14), भेदभाव के क्तखलाफ अतिकार (अनुच्छेद 15) और अस्पृश्यता के उन्मूलन (अनुच्छेद 17) का उल्लंघन
करता है ।

3. क्ा अनुच्छेद 25 के तहत मतहलाओं का बतहष्कार एक 'आवश्यक िातमाक प्रथा' है ?
4. र्यह सवाल तकर्या गर्या था तक क्ा केरल तहं दू सावाजतनक पूजा स्थलों (प्रवेश का प्रातिकरण) के तनर्यम 3 में
10 से 50 वषा की आर्यु के बीच मतहलाओं के प्रवेश पर प्रततबंि है ।
लनणार्:
तनषेि को हिा तदर्या गर्या और सबरीमाला मंतदर को 10 – 50 आर्यु वगा की मतहलाओं के तलए खोल तदर्या गर्या।
न्यार्यालर्य का फैसला तनम्नतलक्तखत आिार पर आिाररत था –
● सबरीमाला में मतहलाओं के बतहष्कार ने मतहलाओं के मौतलक अतिकारों (उम्र 10-50) का उल्लंघन तकर्या,
तवशेष रूप से र्यह अनुच्छेद 15 के प्राविानों के अनुसार भेदभावपूणा था। र्यह भी माना गर्या तक अस्पृश्यता
के अतिकार का दार्यरा बहुत बड़ा है और इसमें शुद्धता की िारणा पर सामातजक बतहष्कार शातमल है ।
● र्यह भी माना गर्या तक भगवान अर्यप्पा के भिों ने एक अलग िातमाक सं प्रदार्य कहलाने के मानदं डों को पूरा
नहीं तकर्या।
● आवश्यक िातमाक प्रथा के सवाल पर र्यह माना गर्या तक अय्यप्पन तहं दू हैं और मतहलाओं को बाहर करने की
प्रथा को एक आवश्यक िातमाक प्रथा नहीं माना जा सकता है ।
● र्यह माना गर्या तक केरल तहं दू सावाजतनक पूजा स्थलों का तनर्यम 3 (b) सं तविान का उल्लंघन है क्ोंतक र्यह
सावाजतनक तहं दू पूजा स्थलों को पिम्पिा के आिार पर मतहलाओं को बाहर करने की अनुमतत दे ता है ।
लहजाब मुद्दा:
● कनाा िक उच् न्यार्यालर्य में एक र्यातचका दार्यर की गई थी तजसमें शै क्षतणक संस्थानों में मुक्तस्लम छात्रों द्वारा
तहजाब पहनने पर प्रततबंि को बरकरार रखा गर्या था। इसे 2 न्यार्यािीशों की पीठ के समक्ष उच्तम
न्यार्यालर्य में चुनौती दी गई थी जहाँ तवभातजत फैसला सुनार्या गर्या था। इसका तात्पर्या र्यह था तक एक
न्यार्यािीश प्रततबंि के पक्ष में थे और एक इसके क्तखलाफ थे। अब इस मामले की सुनवाई बड़ी पीठ करे गी।
