Temin Assistant Director Human Resources Division g U.S. Department of Justice Federal Bureau of Investigation Washington, D.C. 20535 Cost Transfer: This transfer order will authorize leave and travel expenses for you and your dependents who will relocate with you, as well as applicable allowances and benefits incidental to this transfer as provided by the Administrative Expenses Act of 1946, as amended, the General Services Administration Federal Travel Regulation and implementing regulations prescribed by this Bureau, shall be paid to you or on your behalf. You agree to remain in the service of the Government for 12 months following the effective date of this transfer. It is understood that the effective date of this transfer is the day you report for duty at the new duty station. You further acknowledge your electronic signature of this, offer constitutes the written service agreement. Itis also understood that, should you violate this agreement, you become obligated to refund the Government all costs incurred on your behalf for travel and related expenses to your transfer as described in the Federal Travel Regulation, unless separated for reasons beyond your control and acceptable to the FBI. Taxes: Please be advised that expenses paid on your behalf are taxable to you and will require fling a RITA voucher. Additionally, you may incur a debt to the FBI in relation to your cost transfer (explained further in the benefit guide provided with this transfer order). ‘On December 22, 2017, the President signed into law the Tax Cuts and Jobs Act. This law may impact your transfer. © This legislation made previously non-taxed moving expense reimbursements taxable as of January 1, 2018. Please see HR Link fora list of the FBI's current understanding of the applicable tax changes. However, this may change upon receipt of official guidance from GSA and DO\, © Current law provides the FBI with the authority to compensate employees for much of the tax burden caused by a transfer through the Withholding Tax Allowance (WTA) and Relocation Income Tax Allowance (RITA) process. At this time, itis unclear whether this authority addresses the full impact of the recent change in the tax law. GSA and DON are currently reviewing the Federal Travel Regulation (FTR), including the RITA process, in an effort to identify ‘ways to minimize the additional tax burden on transferring employees. If you are being transferred into or between duty stations in the National Capital Region (FBIHQ/Quantico and WFO), your state tax withholding may default to the state in which your office is located. Itis your responsibilty to verify that your state tax Js accurate and updated. If you decide to reside in Virginia, Maryland, or Washington, DC, you will need to complete the appropriate state tax form and submit prior to your arrival. You can submit your completed form, with a note indicating that it is to be processed after the arrival action, to PMU, JEH-Room 10983. Forms may be found on the PMU website: Human Resources Division > Employee & Medical Services Section > Payroll Management Unit > Additional Resources > Forms > State Tax Forms. You may email the completed tax form to your PMU POC (Found on the PMU website). Administrative Leave: You may be granted up to 40 hours of administrative leave for general relocation matters associated with a permanent change of station. The respective management in either the losing or receiving office is responsible for approving the use of administrative leave. Profile Manager: You should ensure your HR Source profile is complete and up to date as itis used in transfer selection decisions. Please contact your local (field or FBIHQ) HR representative for instructions on how to update your profile SES: You must contact the Leadership Selection Unit (LSU) to coordinate your contemplated arrival date. Employees must report to their new office within 90 calendar days of their transfer letter, Any relocation incentive associated with this position will be processed through the LSU. Requests for delay in reporting must be coordinated with and agreed to by the losing and receiving offices. Employees must arrive at their new duty station at the beginning of the pay period Federal law prohibits the use of public office for private gain. Accordingly, employees are obligated to account for any aif, gratuity, or benefit received from private sources incident to the performance of official duty. Aside from frequent fiyer benefits, which are expressly permitted by law, employees may not retain incentives in connection with any expense that is paid for or reimbursed by the Government, or under any circumstance that increases the cost to the Government. Any incentive paid under these circumstances is Government propeity. For example, an employee may not keep a cash rebate from a real estate broker if the employee is participating in the FBI's home sale program, because the selection of an out of network increases the cost to the FBI. Note that this provision does not prohibit an employee from selecting an out of network broker; it only precludes the employee from retaining a cash incentive for doing so. Similarly, fan employee sells their residence outside of the home sale program, he/she may only claim reimbursement from actual expenses — less any cash incentive or rebate, because an employee may not claim reimbursement for an expense not actually incurred, If a private source offers a cash incentive in connection with an expense that is paid for or reimbursed by the FBI, the employee must remit the full amount to the FBI ‘An employee may, however, retain a cash incentive if eamed in connection with an expense not paid for or reimbursed by the FBI, so long as the incentive does not result in any expense to the FBI. For example, if a real estate agent offers a cash rebate in connection with the purchase of a home, the employee may accept the incentive because the FBI does not reimburse brokerage expenses on the purchase of a home and this does not result in any expense to the FBI In addition, you agree that you and/or your immediate family have not accepted, and will not accept, duplicate reimbursement for relocation expenses, and to the best of your knowledge, no third party has accepted duplicate reimbursement for your relocation expenses.
