Cherryl K. Ontalan, Assistant Secretary of Health, as the Overall
Data Protection Officer for the Department of Health (DOH)
Central Office pursuant to Republic Act (RA) No. 10173, otherwise
known as the ‘Data Privacy Act of 2012 (DPA)’”

This is to endorse for your review and clearance the attached subject draft.

This issuance is pursuant to the instruction from the DOH Executive Committee during their
11th Regular Meeting for “KMITS to issue a separate Department Personnel Order for the
designation of the Data Protection Officer,” and part of the transition activities of the Data
Protection Office from KMITS to OLA.

Kindly take note that the indicated functions for the designated overall Data Protection
Officer of the DOH are based on the stipulated duties and responsibilities in the attached
National Privacy Commission (NPC) Advisory No. 2017-01 on “Designation of Data
Protection Officers,” DOH Department Memorandum (DM) No. 2017-0137 on “Designation
of Data Protection Officer or Compliance Officer for Privacy,” and DPO No. 2018-0389 and
20180389-A on Designation of Data Protection Officer or Compliance Officer for Privacy of
DOH Central Offices pursuant to DM No. 2017-0137.”

We hope to receive your concurrence on or before 23 March 2023 so this Office can already
facilitate the routing for approval and signature of this issuance.
