3. Retail- if ever na magfail yung
distributor at manufacturer na i-honor
yung warranty, magiging subsidiarilg
liable si retailer. I-shoshoulder po ni
retailer yung expenses at costs na
kailngan para ma-honor yung warranty.
4. Enforcement of warranty or
guarantee- para ma-enforce yung
warranty, kailangan mapresent yung
claim. So para maclaim yung warranty
ay dapat na dalin ni buyer yung
warranty card kasama yung item or
ibalik nya agad sa seller. Kung yung
pinagbilan ay mismong gumawa or
manufacturer, or kahit distributor,
accepted agad dapat ung warranty.
However, kapag retailer, hindi siya yung
directly responsible sa cost nung
warranty, ang gagawin niya lang ay siya
magpapakita ng claim sa distributor.
5. Record of purchases- Dapat
itabi ng distributors or retailers lahat ng
record of purchase covered by warranty
hanggang sa kung gaano katagal yung
warranty ng product.
6. Contrary stipulation- null and
void. Lahat ng stipulations,
agreements, or covenants contrary sa
provisions under this article ay walang
legal effect.
C. Third provision is tungkol sa
designation of warranties- dapat
yung warranty ay clearly designated as:
1. Full Warranty- kapag yung
warranty ay nameet yung minimum
requirements sa next provision po; or
2. Limited warranty- kapag naman
yung warranty ay hindi nameet yung
minimum requirements.
D. Fourth provision is yung minimum
requirements or standards for
warranty – para ma-meet ng
warrantor yung minimum requirements
dapat ay:
1. Una dapat ayusin nya kung ano
yung pinapaayos ni buyer within
reasonable time at withour
charge kay buyer.
2. Pangalawa if ever hindi maayos o
magawa yung product, kelangan
bigyan ni warrantor ng
option si buyer, kung
rerefund nya ba or rereplace
without charge ulit kay
buyer.
Hindi na kelangan iperform ni
warrantor yung mga duties above kung
mapapatunayan nya na yung defect,
malfunction, or failure ay caused by
damage due to unreasonable use.
E. Fifth provision, duration of
warranty
Si seller or buyer ay pwedeng mag
stipulate kung hanggang kelan
pwede maging enforceable yung
express warranty. Kapag yung
implied warranty sa merchantability ay
may express warranty din, both will be
an equal duration.
Any other implied warranty ay di
dapat bababa ng 60 days pero di
lalagpas ng 1 year.
