Pursuant to the directions of the Commission, a
reply has been received from the Deputy
Secretary, Administration, stating therein that
as per the report submitted by SP, Bharatpur,
allegations of ragging and giving poison to the
deceased could not be substantiated. A final
report has been submitted on the ground of
mistake of fact. In these circumstances, it is not
appropriate to give compensation of Rs. 10
lakhs to the NOK of the deceased in this present
case.
A report from SP, Bharatpur has also been
received in the Commission, stating therein that
in the present case, after the investigation, a
final report has been submitted in the
concerned court of ACJM, Bair.

5 Ramlagan Bhojpur 3438/4/6/2022 4 Lakhs The Commission received a complaint from Dr. Lenin
Ray Raghuvanshi, a human rights activist alleging that a
35 years old man in Bhojpur district of Bihar got
electrocuted and died when a high-tension wire
snapped on him. The complainant thus, requested
the Commission to intervene into the matter.
Accordingly, the Commission vide proceeding dated
16.10.2022 called a report from the relevant
authorities. Pursuant thereto, report(s) has been
received wherein it stated that the deceased went
to the fields for grazing his animals when high-
tension wire fell on him due to which he died on the
spot. Further, the report of the South Bihar Power
Distribution Company divulges that the wife of the
deceased, Ms. Rina Devi, has been paid a
compensation of Rs. 4 Lakhs. However, the
Commission deems the aforesaid compensation as
inadequate. Accordingly, let the State Government
through the Ld. Chief Secretary, Bihar show cause
within 6 weeks, as why an additional compensation
of Rs. 3 lakhs should not be recommended by the
commission for the to the NOK of the deceased.
6 Maalik Foolpur 16728/24/72/20 5,00,000/- I am directed to say that the matter was considered
Patel Varanasi 22 by the Commission on 31/03/2023 and the
Commission has directed as follows.: The
complainant, based on media reports, has alleged
that one Maalik Patel, aged 55 years, R/o Village-
Foolpur, District- Varansai, Uttar Pradesh died due
to electrocution, on 24.2.2022, after coming in
contact with broken high tension wire which was
lying in his farm. The complainant has alleged
negligence on part of the officials of Power
Corporation and is seeking Commission's
intervention for payment of compensation to the
family of the victim and other necessary action. Vide
proceedings dated 02.01.2023 this Commission has
observed/directed as under:- “The complainant,
based on media reports, has alleged that one Maalik
Patel, aged 55 years, R/o Village- Foolpur, District-
Varansai, Uttar Pradesh died due to electrocution,
on 24.2.2022, after coming in contact with broken
high tension wire which was lying in his farm. The
complainant has alleged negligence on part of the
officials of Power Corporation and is seeking
Commission's intervention for payment of
compensation to the family of the victim and other
necessary action. The Commission took cognizance
on 27.06.2022 and directed its Registry to transmit a
copy of the complaint to the Senior Superintendent
of Police, Varanasi, Uttar Pradesh and Chairman-

the instant case despite direction dated 27.06.2022
and reminders dated 31.08.2022 and 19.10.2022,
the Senior Superintendent of Police, Varanasi, Uttar
Pradesh and Chairman-Cum-Managing Director,
Lucknow, Uttar Pradesh Power Corporation Limited,
Uttar Pradesh have not submitted any report till
date. Taking serious view of the same, the
Commission directs its Registry to issue summons to
the Senior Superintendent of Police, Varanasi, Uttar
Pradesh and Chairman-Cum-Managing Director,
Lucknow, Uttar Pradesh Power Corporation Limited,
Uttar Pradesh, u/s 13 of the Protection of Human
Rights Act, 1993 to appear before the Commission
on 15.2.2023 along with requisite action taken
report. Should however the requisite reports be
received by the Commission on or before 8.2.2023,
the personal appearance of the concerned
authorities shall stand dispensed with. The copy of
instant proceeding be forwarded to the Chief
Secretary, Govt. of Uttar Pradesh for information
and for ensuring compliance of direction of the
Commission by aforesaid authorities.” Pursuant to
same various communications received including
report dated 28.01.2023 of DCP, Headquater of
Varanasi. As per same the complainant’s brother
stated that he does not want any police action in the
matter. Further report dated 10.02.2023 of
Purwanchal Vidhyut Vitran Nigam Limitedis also on
record. As per same the LRs of deceased have been
granted Rs.5,00,000/- (Rupees five lakh) as
compensation in the matter. It also mentions about
the negligence of Purwanchal Vidhyut Vitran Nigam
Limited. In totality facts and circumstance let fresh
report be called from Commissioner of Police,
Varanasi, Uttar Pradesh. He is directed to specifically
clarify as to whether any cognizable offence has
happened in the incident or not. Let additional
report be submitted within four weeks. 2. It is
therefore, requested that the additional/complete
report as directed by the Commission in the matter
be sent latest by 08/05/2023, for futher
consideration by the

the Chief Secretary, Government of Uttar Pradesh as
to why the Commission should not grant monetary
compensation of Rs. 25,000/- (Rupees Twenty Five
Thousand) to the NOK of the deceased prisoner

Prisons Adm & Reforms Services, Uttar Pradesh vide
communication dated 27.12.2022 submitted that
the 84-year-old was taken to the District Hospital,
Etah on 10.05.2021 where one of his legs was
handcuffed with bed by the Jail Warder, and photo
of same was circulated in social media. Accordingly,
the jail warder Sh. Ashok Kumar was dismissed from
his post, however, in appeal, vide order dated
31.08.2022 he has been taken back in service. He has
been punished with stoppage of increment for one
year and vide order dated 13.05.2021, “warning”
was issued to another Prison Warden Sh. Kuldeep
Singh. It is further submitted that later the prisoner
died and in magisterial enquiry, the Enquiry
Magistrate did not find any negligence and hence,
there is no justification to grant of Rs. 25,000/- to the
NOK of deceased. The cause of death was
“Septicemia due to chronic lung disease” and no
external or internal was found to be mentioned in
postmortem. In this matter, the Commission vide
proceedings dated 13.1.2023 has observed and
directed as under:- "The Commission has considered
the reply to its show cause notice u/s 18 of PHRA
whereby it is submitted that there is no justification
to grant compensation of Rs. 25,000/- to the NOK of
deceased as there was no negligence in death of
deceased and in magisterial enquiry also the Enquiry
Magistrate did not find any negligence. However,
from the perusal of records of the case, it is evident
and admitted fact that the leg of the deceased was
tied with handcuff to his bed frame during
treatment and for this unlawful act of prison staff,
departmental action was taken against two jail
warden which strengthens the fact that there was
negligence and violation of human rights of victim.
In view of such facts, the Commission confirms it
show cause notice and directs to the Chief Secretary,
Government of Uttar Pradesh to release
compensation of Rs. 25,000/- (Rupees Twenty-Five
Thousand) to the NOK of the deceased prisoner
Babu Ram Pradhan and submit compliance report
along with proof of payment within eight weeks.
