SUBJECT : Request for legal opinion as regards the letter of intent of Ms.
Marilou B. Tibay to operate an on-line sabong under the name of
Lucky 8 Star Quest.
REMARKS : Referred to this Office by Mayor Florencio C. Garay, requesting the
City Legal Office to render a legal opinion on the subject matter.

In response to his request, this Office renders its legal opinion on

the following issue/s:

ISSUE: Whether or not the request of Ms. Marilou B. Tibay should be

granted.

Comment/s: Yes, her request should be granted.

The Philippine Amusement and Gaming Corporation (PAGCOR) operates

as a casino and gaming regulatory body. The Company authorizes and licenses
games of chance. Electronic Sabong is among the games of chance that has
been given the license to operate in the Philippines.

Under the Regulatory Framework for Electronic Sabong (E-Sabong) of

PAGCOR, E-Sabong is defined as the online/remote or off-site wagering/betting
on live cockfighting matches, events, and/or activities streamed or broadcasted
live from cockpit arena/s licensed or authorized by the Local Government Units
having jurisdiction thereof1.

Upon examination of the attached documents in the letter of Mrs.

Marilou B. Tibay, it was found out that Lucky 8 Star Quest is a holder of a
license to operate E-Sabong duly issued by Ms. Andrea D. Domingo, chairman
and chief executive officer of PAGCOR, bearing E-Sabong Operations License
No. 21-002. Moreover, the Mrs. Tibay was granted by the Lucky 8 the authority
to contract, develop and operate Offsite Cockpit Betting Stations in the Province
of Surigao de Sur.

I. General Provisions No. 1 of Regulatory Framework for Electronic Sabong (E-
Sabong)
 Thus, based on the foregoing premises, Mrs. Tibay has the personality to
apply for a permit to operate E-Sabong in the City of Bislig.
