RECONSTRUCTION OF CONSUMER DISPUTE SETTLEMENT

ARRANGEMENTS THROUGH A CONSUMER DISPUTE SETTLEMENT

BODY (BPSK) BASED ON JUSTICE VALUE: A NORMATIVE STUDY

Abstract:

This study aims to reconstruct consumer dispute settlement arrangements

through the Consumer Dispute Settlement Agency (BPSK) based on the value of
justice. This study uses a normative research method based on an analysis of legal
sources and documents related to the problem under study. This study discusses
consumer dispute settlement arrangements through BPSK contained in Law Number
8 of 1999 concerning Consumer Protection and related BPSK laws and regulations.
In addition, this study also discusses the value of justice which must be the basis for
resolving consumer disputes through BPSK.

This research was conducted by collecting data from various sources related
to the problem under study, such as statutory documents, court decisions related to
consumer disputes, as well as related articles and journals. After that, the data that has
been collected is analyzed systematically and critically to obtain accurate and valid
results.

The results of this study indicate that the regulation of consumer dispute
resolution through BPSK based on the value of justice needs to be reconstructed so
that it is more in line with the needs of the community. This reconstruction can be
carried out by increasing the transparency, accountability and independence of BPSK
and prioritizing the principle of justice in resolving consumer disputes. The results of
this study are expected to provide recommendations related to the reconstruction of
consumer dispute resolution arrangements through BPSK based on values of justice
that are more in line with community needs. In addition, this research is also expected
to contribute to the development of legal knowledge, especially in the field of
consumer protection and consumer dispute resolution.
