However, if no appeal has been filed or pending, then the above said judgment has attained finality. The view expressed by JAG's Department that the individual is entitled to pay and allowances for the period spent in Custody/Civil Jail on the ground of his acquittal. If a Person is acquired from a murder case, the presumption will be that the Prosecution has failed to prove it's case against him. He will be relegated to the same position as was before the registration of case against him. The net result would be that NK Muhammad Khalid is entitled to pay and allowances for the entire period spent in Custody/Civil Jail in view of his acquittal by a competent court. Col/Equivalent and thon bopt constant for higher ranks in the light of rules governing the grant of these allowances as mentioned in the relevant regulations which were frozen equal to the amount drawn on 31/05/1994 in terms of Para-6 to JSI ~ 4/94. Ministry of Defence (Defence Division) Rawalpindi vide their letter No. F.3/9/D-31(PP&R)/2001 dated 30/10/2001 revised the subject allowances by 50% on existing amount drawn w.e.f. 01/12/2001 and introduced Appendix ‘A’ to calculate the subject allowances. These allowances were further revised w.e.f. 01/07/2005 by giving 100% increase on the existing amount vide Para-9 of Ministry of Defence (Defence Division) Rawalpindi letter No. 3/10/D-31(PP&R)/2005(A) dated 28/07/2005. However, it has been observed from M & E Reports that these allowances are being paid to the ‘Armed Forces Personnel at different rates in the CsMA. 2. In order to maintain uniformity while making payment of the subject allowances to the Armed Forces Personnel it is clarified that these allowances where applicable to entitled officers who fulfill the prescribed conditions of their grant may be fixed in the light of criteria given in Appendix ‘A’ to Ministry of Defence letter dated 30/10/2001 respecting those Armed forces Personnel who were granted commission prior to 01/12/2001. However, the Armed Forces Officers, who were granted commission as 2 LUCaplEquivalent after 01/12/2001, will draw the subject allowances as mentioned against the 1% stage of the relevant rank of Appendix ‘A’ to Ministry of Defence letter dated 30/10/2001 ie. Rs. 1884/- and Rs. 2271/- respectively and if granted commission after 01/07/2005 they will draw the allowances as Rs. 3768/- and Rs. 4542/- respectively which will stand frozen at the same level till their promotion to higher rank. 3. In case of promotion after 31/05/1994, these allowances are to be calculated on the basis of Presumptive Pay Scale of higher rank in which the officers are promoted as applicable on 31/05/1994. The case has been examined in the light tn. this connection it is mentioned that this office vide letter No. MUATIPOSETLIK axed : 08. 06-2012 clarified that the pay of those Army officers who are granted commission as temporary Captain in the light of Corrigendum No.2 to Al-147/59 are to be fixed at the minimum of Capt rank as per Rule-6 (a) (1) of Pay and Allowances Regulations Vol ~ | (Army) 1998 and subsequent annual increments may also be allowed to them in terms of Rule-14 of Pay and Allowances Regulations Vol- (Army) 1998. However, it is pointed out that while referring the subject case, the ITD Dte has ignored the last sentence of our clarification wherein it has clearly been pointed out that “at the time of their promotion to the higher ranks, their pay will then be fixed according to the rank and years of commissioned service on the date of promotion in the light of Rule-6 (b) (1) of Pay and Allowances Regulations Vol-! (Army) 1998. 02. Kind attention is further drawn to Appendix-1 to JSI-6/2007 and _JSI- 2/2008 which indicates that Pay of a “Major” starts from the 10” years of commissioned service. However, to cover the back log / deficiency of “Major” rank, approximately 3000 — 3500 Capts were promoted as Majors in 2007 and 2008 in their 9" and 8" year of commissioned service respectively, which means they were promoted prior to completion of the prescribed service limit. As no stage exists against 8'" and 9" years of commissioned service for the rank of “Major” in the pay matrix of JSIs mentioned above, MAG's office already clarified vide letter No. 89-91/AT/PO/5981-LI-Pt dated 22-01-2009 that Pay of the officer who is promoted to higher rank before completion of prescribed years of commissioned service will be fixed at the minimum of the rank to which promoted and annual increment will only be allowed when he has completed the required number of commissioned service. 03. Keeping the above mentioned facts in view, it is stated that the case of temporary Capts who were allowed annual increments vide this office lelter dated 09-06-2012 and the instant case are totally different from each other.
