Whereby it is agreed as follows:

1. OTK (GENTING) SDN BHD agrees to appoint ……………………………………..to supply outsourced

manpower services on a fixed term contract basis.

2. ……………………………………hereby agrees to supply legal and permitted cleaning workers to the

company under the Terms and Condition herein.

3. This Agreement will supersede the entire verbal or any written Agreement (s) made earlier.
 TERMS AND CONDITIONS

1.0. DURATION OF CONTRACT

i. This Agreement shall commence on Apr 2023 and shall remain in force for a minimum
contract period of Two (2) years from its date of commencement.

ii. In the absence of any formal extension, this Agreement shall deem to be expired.

iii. The contract is subject to an option to renew for another One (1) years upon mutual Agreement
by both parties.

2.0. NUMBER OF WORKERS

i. ………………………………….will supply to the Company (15) workers as per the Company’s

requirement at this time.

3.0.WORKERS’ SOURCE OF COUNTRY

i. …………………………………….will recruit suitable workers from Nepal.

4.0. OTK (GENTING) SDN BHD OBLIGATIONS

4.1. WORKING PERMITS

i. ………………………………guarantees that all workers are legal and with proper documentations
(Working permitts and Visa. All working permit is under ……………………………….and a copy is
to be provided to the Company.
ii. ………………………………..must undertake an adequate third party risk insurance coverage and
provide a copy of the policy to the Company.

5.0. THE COMPANY’ OBLIGATIONS

5.1. PROVISIONS OF JOB AND SALERY
i. The Company is responsible in providing the workers jobs to carry out on a day to day basis. The
Company will observe all the labour laws and try to provide OT for the workers.

ii. The Company will reimburse ……………………………………..for the salary as well as any statutory
contributions that was paid to the workers. This salary is calculated based on a basic rte of RM
1500 per month. The Company also undertakes to try and provide a minimum of 3hours of OT
per day.

5.2. MONTHLY PAYMENTS

i. ……………………………………will be paid a fixed amount of Rm520 per person per month, which
includes payment for levy and insurance.

ii. FOMEMA and medical costs will be borne by OTK (GENTING) SDN BHD.
 6.0.FEES AND CHARGES

The workers working permits are to be renewed by ……………………………….on a yearly basis and the
levy to be paid by …………………………………….

7.0. WORK PLACE ,HOSTEL AND TRANSPORT

OTK (GENTING) SDN BHD shall provide a suitable working conditions,hostel for the workers to stay in
as well as transport. The hostel will have to comply with the government’s requirement and
regulations.

8.0. WORKERS TIME SHEET AND WORKING HOURS

i. OTK (GENTING) SDN BHD shall maintain the attendance for the workers and shall submit to
…………………………………..not later than the 03th of every month.

ii. …………………………………...will submit the invoice to OTK (GENTING) SDN BHD not later than the
05th day of the calender month.

8.1. MODE OF PAYMENT

i. Upon receiving the invoice from………………………………, the Company shall pay to

…………………………………………the sum calculated at the rate specified/agreed 30 days from the
date of accepted invoice.

ii. All payment should be made in favour of “…………………………….………….”

9.0. TERMINATION OF WORKER’S SERVICE

OTK (GENTING) SDN BHD and …………………………………may terminate the agreement provided their
either OTK (GENTING) SDN BHD or …………………………………..has a written notice sent by registered
mail and same not less than three (03) months counted from the date received the notice.
Termination notice can only be sent upon the expiry of the minimum contract term of Two (02) years
and during the extended period of one year.

10.0 AMENDMENT
Any amendment to this Agreement shall be in writing and signed by both parties herein.

11.0 LANGUAGE
English shall be the official language of this Agreement.

12.0 SPECIAL CONDITIONS (S)

The terms and conditions in this offer are not exclusive but are subject to additional and alteration for
further documentation or changes as and when deemed necessary at the absolute discretion of
…………………………………and OTK (GENTING) SDN BHD.This should be done via a supplementary
agreement signed by the same parties as this agreement.
This contract is valid for one month from the date hereof and it shall automatically lapse one(1)
month from the date hereof in the event if OTK (GENTING) SDN BHD fail to execute terms
stipulated and revert an approved endorsed stamped copy to OTK (GENTING) SDN BHD.
