ABSTRACT
The rules and regulation framed by town planning authorities covering the requirements of
building, ensuring safety of the public through open spaces, minimum size of rooms and height
and area limitation, are known as building bye-laws. For the preparing of the Bihar building
byelaws it has taken the references from the Section 321 of the Bihar Municipal Act and Section
81(2)(w) and Section 82(2)(e) of the Bihar Urban Planning and Development Act 2012 and in
supersession of all the existing rules on the subject, the Government of Bihar hereby issue the
following rules applicable to all Municipal Area and all Planning areas including Gram
Panchayat Area under various Planning Authority. This shall also be applicable to all
Metropolitan areas.

It havening 12 chapter, describing about the administration setup, land use classification,
general building requirements and rules, integrated township, multi storied building or group
housing, development of land regulations, compounding and penalties, E-governance and
service delivery, and savings or repeals. Also it consists three annexure, describing about the
required qualification of engineer and technical persons and builders, annexure(2) is talks about
the exactions from NBC 2005, and annexure(3) is talking about the installation of Solar water
heating system.
CHAPTER -I: DEFINITIONS
These byelaws may be called the Bihar Building Byelaws 2013. It shall apply to all ULBs,
Gram panchayat and all other building activities. There are many definitions provided for the
the key words that is used in it.

CHAPTER -II: ADMINISTRATION


It talks about the Applicability of the bye laws subject to the provisions of the Act and the
Municipal Act.

Deemed Permission- Where any building has been constructed without an approved plan or
with deviation of an approved plan, the provisions of these bye laws shall be insisted upon.

Application- Any person who intends to erect, re-erect or make additions or alterations in any
building or demolish any building shall apply to the Authority in Form-I Part-I. Based on this,
the Authority may prescribe separate formats for different categories of buildings and group
housing.

Fees.-The Authority shall levy for every application for permission for building operation or
development , any approval, fees towards premium FAR, fees for retention of structures, fees
for change of occupancy. fees for change of land use. Also provision for the security deposits,
Signing the Plans, Duration of Permission, Completion of construction, also according to the
Art commission it is provides and restricted the constructions near important buildings and rive
front development.

CHAPTER-III: LAND USE CLASSIFICATION AND


PERMISSIBLE USES
In this chapter it is given that for different land use zones, which activities will be permitted
and which activities will not be permitted and which one will be prohibited in that specific
zone.
CHAPTER-IV: GENERAL
Without prejudice to any other stipulation in these bye laws, no permission to construct a
building on a site shall be granted for natural waterways or drains, Art Commission, also
provision as Bihar is located in Seismic Zone III, IV and V so all Structural Plans should take
it into account. It is also mention about the Distance from Electric lines, Plantation, Means of
Access, Minimum size of plots, Minimum setbacks & Height for non-high rise buildings,
Minimum setbacks for high rise buildings, Floor Area Ratio, Height of a building, Off Street
Parking Space, Interior open space, Height exemption of a building, Exemption in Open space,
Basement Cellar, Provision of Lift, Mezzanine, Heritage Zone, Barrier free access for the
physically challenged person, Rainwater harvesting system, Signs and outdoor display
structures.

CHAPTER -V REQUIREMENT OF SPECIAL OCCUPANCY


There is provision for the minimum plots size and approach road for the apartment building,
Group housing. Also its tells about the parking, Outhouse, Semi- detached and row housing,
Shop cum residence, Cinema, Multiplex and Theatre building, Liquefied Petroleum Gas, Petrol
Pump, Farm House, Farm House.

CHAPTER-VI: INTEGRATED TOWNSHIP


Large Projects- Integrated Townships with minimum 10 Ha of land having access from
minimum 30 m. R/W road shall be allowed. The road shall have adequate provision for cycle
track, footpath, covered drain, plantation, street light and underground utilities, and other
provision for the Integrated township.
CHAPTER-VII: MULTI-STOREYED BUILDINGS AND GROUP
HOUSING SCHEMES/APARTMENTS: ADDITIONAL
REQUIREMENTS
There are many provisions for the Restriction on construction of Multi-storied building, Stages
of Permission, Commencement of Work, Liability of Defective Construction, Maintenance,
number of occupants as per type of occupancy for the stair and doors, ICT Landing Points,
Penal Action against Builders/ Technical Personnel, Occupancy of the Building, Completion
of Construction, Issue of Occupancy Certificate, Structural Safety Design, Standards and other
Services requirements, For Earthquake Protection.

CHAPTER-VIII: DEVELOPMENT AND SUB-DIVISION OF


LAND REGULATIONS
Application, Use in relation to Development Plans, Size of the plot and road width, Area for
development, Park and Open Spaces, Civic Amenities, Exemptions, Security deposit for sub-
division plan,

CHAPTER-IX: COMPOUNDING AND PENALTIES


There are provisions for the Restriction on Compounding, Compounding Rate, Compounding
amount, Compounding amount.
CHAPTER-X: E-GOVERNANCE AND SERVICE DELIVERY
E-Governance-

(1) The State Government shall set up a integrated E-Government system to be used by all
the authorities. All the applications and the associated documents to be submitted to the
various authorities under these byelaws shall be submitted through the E-Government
system. Any application on paper shall be avoided under these byelaws.

(2) All notices shall be issued through the E-Government system.

(3) The E-Government system shall have an inbuilt reminder mechanism to approve
applications wherever provisions have been made for approval within a specified time limit
under these bye-laws.

(4) The E-Government system shall periodically generate reports of occasions where the
Authorities have failed to perform their statutory duties within the prescribed time. The
Authorities shall with their comments forward these reports to the State Government at periodic
intervals specified by the State Government.

CHAPTER-XI: SAVINGS / REPEALS AND INTERPRETATION


Repeal and Savings, Interim Development Plan, Applicability of National Building Code, Prior
Commitments, Decision of the Government to be final, Relaxation by the Government.

Details of qualification, experience and competence of technical personnel like architect,
Engineer, Structural Engineer, town planer, group agency and builder.
