IN THE UNITED STATES COURT OF APPEALS FOR THE SIXTH CIRCUIT INRE: COMPLAINT OF JUDICIAL MISCONDUCT REGARDING BANKRUPTCY JUDGE SUZANNE H. BAUKNIGHT RIFIED COMPLAINT 1, Elliott J. Schuchardt, hereby verify under penalty of perjury that the following is true and correct to the best of my knowledge, understanding and belief. 1. According to the Rules for Judicial Conduct and Judicial Disability Proceedings, it is appropriate to file « complaint against a federal judge for any of the following conduct: © using the judge’s office to obtain special treatment for friends or relatives; having improper discussions with parties or counsel for one side in a case; © retaliating against complainants, witnesses, or others for reporting judicial misconduct; or © violating other specific, mandatory standards of judicial conduct." 2. Thave evidence that Bankruptcy Judge Suzanne H. Bauknight engaged in all of the above proscribed conduct. I have incurred significant damages in connection with this matter. 3. Between May 18, 2016 and June 20, 2018, Bankruptcy Judge Baulknight issued — ‘on her own initiative — at least 87 rules to show cause targeting persons associated with my former law firm, Upright Law. A list of the sua sponte orders is attached as Exhibit A. 4. These orders were used for improper purposes. Bankruptoy Judge Bauknight used her orders to obtain material benefits for both herself and for a friend, who is a court- insider. That friend was paid $200,000 as a direct result of the sua sponte orders. Bankruptey Judge Bauknight also used her orders to force me to dismiss litigation and appeals involving both her, and her friend. 'R. Judicial Cond. & Judicial Disability Proc., Art. Il, § 4(a)(1)(A) & (C) & § 4(@)(4). 5. _Ipreviously filed a judicial complaint in connection with this matter. I was forced to withdraw that complaint, due to ongoing harassment from Banlauptcy Judge Bauknight and her colleagues at the Tennessee Board of Professional Responsibility. The Board's staff attorney, Sandra Garrett, has filed five complaints against my license to practice law, in retaliation for my having reported these matters. This harassment is continuing as of this date, and is described in detail in this complaint. Background 6. have practiced law for neatly thirty years. I received a B.A. fom Comell University in 1989 and a J.D. fom Columbia Law School in 1993. 7. Twas formerly local counsel for Upright Law, the nation's first national consumer bankruptcy law firm, 8. Upright Law provides consumer bankruptey services through a network of attorneys located in all fifty states. The average local partner has at least twenty-five years of ‘experience in bankruptcy law. As of 2018, Upright Law was filing 1% of all of the consumer bankruptcy cases nationwide. That was an extraordinary achievement, which generated hostility among the local bankruptcy bar in many states. 9. Between 2016 and 2018, Bankruptey Judge Suzanne H. Bauknight used her federal bench to sua sponte target and harass persons working with Upright Law, in the Eastern District of Tennessee. She did this while she was overseeing litigation involving Upright Law, asa judge. This was a violation of 28 U.S.C. § 455 and Canon 2 of the Code of Conduct for United States Judges. 10. Between May 18, 2016 and June 20, 2018, Bankruptcy Judge Bauknight issued ~ on her own initiative -- at least 87 rules to show cause targeting persons associated with Upright Law. Her orders were addressed to a variety of persons associated with Upright Law. 11. The first orders sua sponte questioned the integrity and competence of Aftican- American attomey Grace Gardner. At that time, Ms. Gardner was the local partner for Upright Law in the Eastern District of Tennessee. She had a twenty-five year unblemished record in the Jaw. Bankruptcy Judge Bauknight used unsolicited orders to attack Ms. Gardner's record as a lawyer. She also used unsolicited orders to demand and personally review discovery on behalf of Upright Law’s adversaries, in violation of 28 U.S.C. § 455. She used these unsolicited orders to improperly suspend Ms. Gardner from practicing before the court for five years. This was an injustice, given the circumstances of this case. 12. On July 15, 2016, Bankruptcy Judge Bauknight began to issue orders attacking the integrity and competence of Upright Law's management, located in Chicago. As with Ms Gardner, Bankcuptcy Judge Bauknight claimed to "already know the facts" regarding each order, in violation of 28 U.S.C. § 455. Her orders were addressed to Upright Law's managing partner, Kevin Cher, the firm's management, and attorney, Jason Allen. 13, On April 27, 2017, Bankruptoy Judge Bauknight began to issue orders questioning Upright Law's legal fees, in bankruptcy cases pending before her. Between April 27, 2017 and December 27, 2017, Bankruptcy Judge Bauknight sua sponte reduced Upright Law's fees to well-below the amount charged by other local bankruptey firms, No motion had ever been filed, challenging the fees. Improper Use of the Orders 14. All of these swa sponte orders materially benefitted a court-insider, who used the orders for her own benefit. 15. _ That person was attomey Gwendolyn Kemey, the standing chapter 13 trustee in the Eastem District of Tennessee. 16. After Bankruptcy Judge Bauknight began to issue her unsolicited orders, Kemey began demanding a large payment from Upright Law, to resolve the orders to show cause, Upon information and belief, Kemey demanded a payment of approximately $400,000 from Upright law. 17. Ultimately, Upright Law paid Kerney $200,000 in connection with this matter. It is unlikely that Upright Law would have made such payment, if Upright Law had not been required to resolve Bankruptcy Judge Bauknight's sua sponte orders. 18, Astonishingly, no case was ever filed against Upright Law. Kemey filed a single motion against Upright Law — on August 12, 2016 — after Bankruptcy Judge Bauknight had already started created issues involving Upright Law, by means of her own, unsolicited orders. 19, The settlement was improper, and was obtained at the expense of attorney Grace Garcner. Federal law specifically prohibits a federal judge from ruling on a case where the judge claims to have "knowledge of disputed evidentiary facts," as Bankruptcy Judge Bauknight claimed, with respect to Ms. Gardner. 28 U.S.C. § 455 (2023), Pattern of Retaliation 20. After Ms. Gardner was removed from the court, I replaced Ms. Gardner as the local partner for Upright Law, in the Eastern District of Tennessee. Like Ms. Gardner, I had been practicing bankruptcy law for twenty-five years, and had an unblemished record in the law. 21. On August 3, 2017, I advised Bankruptcy Judge Bauknight that her suc sponte orders attacking Upright Law's fees were creating the appearance of improper communication between Bankruptcy Judge Bauknight and Upright Law's adversaries, in violation of Bankruptey Rule 9003, 22. Rather than simply ruling on the objection, Bankruptcy Judge Bauknight retaliated against me for making the objection, She claimed that I had "no evidence" of ex parte communications, and sua sponte sanctioned me for making the objection. 23. Meanwhile, Bankruptey Judge Bauknight failed to disclose that she had a history of sua sponte attacking my predecessors with Upright Law, for the benefit of Kerney. 24, I did not appeal the order, out of respect for Bankruptey Judge Bauknight. ‘However, she continued to use her federal bench to harass me, by means of dozens of sua sponte orders benefiting her friend, Kerney. Further Retaliation 25. On December 29, 2017, I filed suit against chapter 13 trustee Kerney in Tennessee state court” ‘The complaint alleged that Kemey was using her position with the federal government to engage in a pattern of harassment against Upright Law. The complaint sought damages from Kerney for slander and tortious interference with contract 26. A few days later, Upright Law's managing partner, Kevin Chern, contacted me by telephone. At that time, Chen was engaging in settlement negotiations with Kemey. Chem told me that Bankruptcy Judge Bauknight and Kemey were going to "destroy my license to practice law," if I did not dismiss the lawsuit against Kemey. I told Chem that that couldn't happen, and refused to dismiss the lawsuit 27. ‘Two days later, on January 9, 2018, Bankruptcy Judge Bauknight issued seventeen orders to show cause against me, on her own initiative. 28. The orders accused me of engaging in "incompetence" in the practice of bankruptcy law ~- even though I had been successfully practicing bankruptcy law for twenty-five years, at that point, 29. believe that these orders were an abuse of process, due to their frivolous nature. For example, Bankruptcy Judge Bauknight accused me of "missing hearings" that I was not required to attend, She accused me of "delaying cases" when she couldn't show a day of delay. She accused me of filing a "non-compliant chapter 13 plan," but couldn't explain how the plan ‘was non-compliant, ? The case was filed in the Chancery Court for Knox County, Tennessee under the caption, Schucharat v. Kerney, Case No. 195055-3. * The orders are described on Exhibit A. * When I later tried to litigate these issues, I was denied a hearing, and summarily suspended from practicing before the court for two years. Jn re Schuchardi, B.D. Tenn., Case No. 3:18- MC-39-TAV (2019). On the day the U.S. Court of Appeals for the Sixth Circuit agreed to hear the appeal, the State of Tennessee sued me for dozens of additional frivolous allegations. Bankruptcy Judge Bauknight is working with counsel for the State of Tennessee, Sandra Garrett, in connection with many of these attacks on my license and reputation. 30. Bankruptcy Judge Bauknight used these orders for her own purposes. Bankruptey Judge Bauknight agreed to dismiss the rules to show cause only if I dismissed the state court case against her friend, Kemey. Bankruptcy Judge Bauknight also demanded that I dismiss appeals of two of her own orders, involving trustee Kemney. In one of these orders, she used her bench to quash discovery relating to the state court case against Kemey. 31. Rather than litigate against Bankruptey Judge Bauknight, I accepted her terms and agreed to dismiss the lawsuit against her friend, Kemey. This was an injustice, because the case ‘was not decided on the merits. I was forced to dismiss the case solely to resolve Bankruptcy Judge Bauknight's sua sponte attacks on my license to practice law, By attacking my license, she was openly interfering with pending litigation, for the benefit of her friend Kemey. The settlement was documented by means of a consent order entered on February 8, 2018.° Further Retaliation 32. Bankruptey Judge Bauknight continued to use her federal office to retaliate against my license and reputation. 33. On June 19, 2018, I appealed two additional sua sponte orders, entered by Bankruptcy Judge Bauknight.° 34. _ Bankruptey Judge Bauknight used her federal bench to retaliate the next day. On June 20, 2018 ~ Bankruptcy Judge Bauknight issued nineteen additional rules to show cause against me, on her own initiative, 35. There is an appearance that Bankruptcy Judge Bauknight intended to use these unsolicited orders to force me to dismiss the appeals that I had filed the day before -- as she had done with her unsolicited orders entered on January 9, 2018. 36. There was no other purpose for the orders entered on June 20, 2018. All of the matters in the orders to show cause had previously been litigated. Some had been resolved only days earlier. The unsolicited orders were a patent violation of res judicata. 37. In addition ~ as Bankruptcy Judge Bauknight had done with Grace Gardner ~ her orders entered on June 20, 2018 sua sponte demanded the production of discovery. This was the same method that Bankruptey Judge Bauknight had used to remove Grace Gardner from the court for five years, 5 See In re Sandra G. Brown, Bankr. E.D. Tenn., Case. It is a per se violation of due process. As one court has explained: Whey a judge becomes a participant in judicial proceedings, a shadow is cast upon judicial neutrality, "particularly when the judge actively secks the production of evidence that the partics themselves never sought to present." LP. v. State, 718 So.2d 251, 252 (Fla. 4th DCA 1998) (quoting Chastine v. Broome, 629 So.2d 293, 295 (Fla. 4th DCA 1993)). .. A judge should "never suggest or advise counsel how to try his or her case.” Nationstar Mortg., LLC v. Marquez, 180 So.3d 219, 221 n.2 (Fla, 34 DCA 2015) (citing Shore Mariner Condo. Ass'n v. Antonious, 722 So.2d 247, 248 (Fla. 2d DCA 1998), for the proposition that "[tJrial judges must studiously avoid the appearance of favoring one party in a lawsuit, and suggesting to counsel or a party how to proceed. strategically constitutes a breach of this principle").® 39. In the Upright Law case, Bankruptey Judge Bauknight improperly litigated the case from the bench, for the benefit of both herself and trustee Kemey. ation of 28 U.S.C. § 455 40. All of Bankruptey Judge Bauknight’s sua sponte orders were entered in violation of federal law. Specifically, the orders violate the judicial disqualification rules, set forth at 28 US.C, § 455. 28 U.S.C. § 455 states as follows: Any justice, judge, or magistrate judge of the United States shall disqualify himself in any proceeding in which his impartiality might reasonably be questioned. He shall also disqualify himself in the following circumstances: Where he has _a personal bias or prejudice concerning a party, or personal knowledge of disputed evidentiary facts conceming the proceeding. . 28 US.C. § 455 (2023) (emphasis added). 8 DiGiovanni v. Deutsche Bank Nat'l Tr. Co., No. 2D15-4180, 2017 WL 1277737, at *2 (Fla. Dist. Ct. App. Apr. 5, 2017) (emphasis added). See also Lyles v. State, 742 So. 2d 842, 843 (Fla. Dist. Ct. App. 1999) ("The trial court committed fundamental error by sua sponte ordering Lyles fingerprints for the purpose of identification and bifurcating the hearing to allow additional testimony.") 41. The above law requires a judge to recuse herself from a matter if the judge has personal bias towards a party, or if the judge's impartiality "might reasonably be questioned." Id 42. 28 US.C. § 455 also requires a judge to recuse herself if she has "personal knowledge" of disputed evidentiary facts. Id. 43, Both provisions applied to Bankruptcy Judge Bauknight's conduct. The orders — entered over two years against a variety of persons -- demonstrates a pre-existing bias against persons associated with Upright Law, Bankruptcy Judge Bauknight also repeatedly claimed to have "personal knowledge of the facts," with respect to many of the orders. 44, When I litigated these issues, I advised Bankruptcy Judge Bauknight of the substance of 28 U.S.C. § 455. She repeatedly refused to comply with the statute, and to recuse herself. 45. In 2022, Congress passed legislation intended to improve compliance with 28 U.S.C. § 455. That legislation tightened the financial disclosure rules. However, as indicated by this letter, the problems with the federal courts are continuing, due to the lack of independent oversight of the federal judiciary. Ongoing Retaliation 46. For the past five years, Bankruptcy Judge Baukmight has been retaliating against my license to practice law in the State of Tennessee. 47, She has filed numerous complaints against me with the Tennessee Board of Professional Responsibility, and is working with the Board's staff attorney, Sandra Garrett, to damage my law license, for having reported her conduct in this matter. 48. Over the past five years, Garrett has filed dozens of frivolous claims against my license to practice law. Not one of these claims has identified a penny of loss or a day of delay in any case, Not one of my clients has appeared for any hearing whatsoever. 49. In my mind, there is no question that Garrett's claims have been filed at the request of -- and for the benefit of -- Bankruptey Judge Bauknight. 50. Garrett first attacked my license to practice law on June 6, 2018, at the request of Bankruptcy Judge Bauknight. Since then, she has continually used her state office to retaliate against me for the Bauknight complaint. SL For example, on August 27, 2021, the U.S. Court of Appeals for the Sixth Circuit agreed to hear an appeal of an order based on Bankruptcy Judge Bauknight's complaints against my license to practice law. ‘The order was docketed by the clerk of the Sixth Circuit on the morning of August 27, 2021. 52, Approximately three hours later ~ on that same day -- Sandy Garrett filed dozens of frivolous claims against my law license with the Tennessee Board of Professional Responsibility. As with Bankruptcy Judge Bauknight's attacks on my license, Garrett focused on frivolous matters that were not violations within the plain meaning of the rules. 53. As of this date, Garrett has filed a total of five petitions attacking my license to practice law in Tennessee. At least three of these petitions were commenced at the request of Bankruptcy Judge Bauknight. The other petitions were filed on January 14, 2022, April 7, 2022 and July 25, 2022. 54, After I sought discovery in one of Garrett's cases, Garrett obtained an order preventing me from obtaining discovery or presenting evidence on the issue. (Such evidence ‘would have shown that Garrett was making false claims in the case.) $5. _ Garrett then sought and obtained an ex parte order from the Tennessee Supreme Court immediately preventing me from practicing law in Tennessee. When I sought a hearing in connection with this matter, Garrett obtained an order from the Tennessee Supreme Court denying me a hearing, and preventing me from presenting any evidence on these issues. This is not fair play, and is simply retaliation for defending my reputation in this forum. 56. On September 29, 2022, I filed a civil complaint against Garrett and the State of Tennessee in the U.S. District Court for the Middle District of Tennessee. The complaint alleges that Garrett is using her office with the Tennessee Board of Professional Responsibility to file frivolous and knowingly-false claims for political reasons -- namely, to retaliate against me for having filed a judicial complaint against Bankruptey Judge Baulmight. The complaint also contends that Garrett has a history of using her employment with the State of Tennessee to engage in political retaliation for the benefit of government officials.” 57. Tam also reporting this matter widely to persons in the Tennessee legislature, to seek rule changes in the Tennessee courts, ° The case is filed under the caption, Schuchardt v. Tennessee, Case No. 3:22-cv-00762. Interference With This Process 58. As explained above, Bankruptcy Judge Bauknight has continuously interfered with this investigation process. 59. I was forced with withdraw an earlier version of this complaint, due to Bankruptcy Judge Bauknight's attacks on my license to practice law in Tennessee." 60. I have repeatedly reached out to Bankruptcy Judge Bauknight and Garrett to resolve these matters, in a respectful manner. 61. However, Bankruptcy Judge Bauknight and Garrett have continued their attacks on my license and reputation. I therefore would like to pursue this complaint against Bankruptcy Judge Bauknight to the fullest extent. 62. _ Ihave previously reported these matters to other courts in the Judicial Conference and to the Tennessee Supreme Court. My complaints have been met with silence, and more often, with retaliation against my license to practice law. 63. _ Tam actively reaching out to members of Congress to resolve these matters. I have reported this matter fo persons serving on the Judiciary Committees for the U.S. Senate and the ULS. House of Representatives. I believe that my letters have contributed to the recent focus on judicial ethies in both Congress and the United States media, 64, I would very grateful for any assistance that you can provide in connection with ‘this matter.
