Decision

HONDA MOTOR CO.LTD a Japanese company filed the instant application for
the grant of patent on 20/02/2014.The application was examined on request
made by the applicant’s agent and first examination report was issued on
20/11//2018. The applicant’s agent filed reply to first examination report
on 20/05/2019 but following objections were still outstanding:

1. All three claims of divisional application are present in already


granted parent application; this is not allowed as per the Section
16(3) of the patents act 1970. The main application and the
Divisional Application(s) may be amended to ensure that neither of
the complete specifications includes a claim for any matter claimed
in the other.
2. The Principal claim should elaborate all the Novel/ inventive
features of the invention after the phrase “characterized in that”.
3. Form 13 has not been filed for the technical amendments carried out
in the technical specification.

The applicant`s agent appeared for a hearing & filed written submission
on 22/12/2021.

Having considered all the facts and submissions made by the agent for
the applicant during the hearing as well as all the documents on record I
hereby allow this application (490/DEL/2014) for further proceeding to
grant of patent in accordance with the provisions of the Patents Act, 1970
(as amended).
