CUENCO, PROPOSED ORDINANCE “AN ORDINANCE ESTABLISHING A CREMATORIUM AND CREMATION UNIT UNDER THE CEBU CITY MEDICAL CENTER, IMPOSING PENALTIES FOR SPECIFIC INFRACTIONS, AND PROVIDING FUNDS THEREFORE.” WHEREAS, Section 8.1.7 of the Implementing Rules and Regulations of Chapter Xx!~ Disposal of Deod Persons of Presidential Decree No. 856 otherwise known as the “Code on Sanitation of the Philippines” provides for the establishment and operation of crematorium by public and private cemeteries, funeral partors, and hospitals; WHEREAS, pursuant to World Health Organization (WHO) Interim Guidance Issued March 24, 2020 and updated September 4, 2020, entitled: “Infection Prevention and Control for the Safe ‘Management of a Dead Body in the Context of COVID19", people who have died from COVID-19 can be buried or cremated according to local standards and family preferences; WHEREAS, pursuant to Department of Health (00H) Department Memorandum No. 2020-0067, Issued February 3, 2020, entitled: “Guidelines on the Disposal and Shipment of the Remains of Confirmed Cases of 2019 Novel Coronavirus Acute Respiratory Disease (2019-nCoV ARD)”, cremation is preferred over burial of dead bodies, for deaths due to the Corona Virus Disease 2019 (Covin19); WHEREAS, pursuant to Department of Interior and Local Government (DILG) Memorandum Circular No. 2020-063, issued March 27, 2020, entitled: “interim Guidelines on the Management of Human Remains for Patients Under Investigation (PUI) and Confirmed Coronavirus Disease 2019 (COVID19) Cases", burial, preferably cremation, shall be done within 12 haurs after death; WHEREAS, due to Increased number of deaths caused by Covid19, existing public cemeteries In Cebu City are already in full capacity; WHEREAS, while private cemeteries and private crematorlums are avallable, not all Cebu City constituents have the privilege to avail of these cemeteries and crematoriums due to expensive burial and cremation costs; WHEREAS, It Is a Filipino tradition to hold wakes for nine (9) days over a deceased relative. The death of a loved one due to dangerous communicable disease, like the Corona Virus Disease 2019 {CoVidi9), as declared by the Department of Health (DOH) has deprived bereaved families of holding their last respects for their beloved dead; WHEREAS, the welfare of the dead and that of the bereaved families are paramount concems of tthe city as enshrined In the General Welfare Clause of Republic Act No, 7160 or otherwise known ‘as the “Local Government Code of 1991"; WHEREAS, in furtherance of the afore-cited laws and regulations and; the primordial obligation to provide medical services through cremation to the constituents of the City of Cebu, there isa need to establish a crematorium and a cremation unit at the Cebu City Medical Center. NOW THEREFORE, the Sangguniang Panlungsod of the City of Cebu In a regular session duly assembled hereby ordains that: SECTION 1. SHORT TITLE. - This ordinance shall also be known as the “2020 Cremation Ordinance of Cebu City” for brevity. SECTION 2. DECLARATION OF POLICY. - It Is the policy of the State to adopt an integrated and comprehensive approach to health development which shall endeavor to make essential goods, health and other social services avallable to all people at affordable cost. Furthermore, to provide for an alternative disposal of dead bodies by cremation under any circumstance, especially those which died under emergency situations and under dangerous communicable disease, as Identified by the Code of Sanitation of the Philippines, such as: 1. Acquired immune Deficiency Disease (AIDS) / Human Immunodeficiency Virus (HIV); Cholera; Ebola hemorrhagic fever; Hepatitis; Plague; Yellow Fever; Meningococcemia and; other dangerous communicable disease as declared by the Department of Health. PN OWRD It Is the policy of the City of Cebu to provide cremation services to all its constituents, especially to the less fortunate families of Cebu City. ‘SECTION 3. PURPOSE AND OBJECTIVE. — Subject to the provisions of the Code of Sanitation of the Phillppines, there shall be established a crematorium and a cremation unit at the Cebu City Medical Center for the purpose of catering the needs of families who opt to dispose dead bodies of thelr loved ones by cremation, elther voluntarily or upon order of any competent authority. ‘This crematorlum may also be used to dispose of illegal substances under Dangerous Drugs Board {0DB) Board Regulation No. 1, series of 2002, entitled: Guidelines on the Custody and Disposition of Seized Dangerous Drugs, Controlled Precursors and Essential Chemicals, and Laboratory Equipment, as amended, wherein thermal destruction method in accordance with applicable laws is allowed. SECTION 4, DEFINITION OF TERMS. — As used hereunder, unless the context otherwise requires: a. CREMATION means a process that reduces human remains to bone fragments of fine sand or ashes through combustion and dehydration. b. CREMATORIUM means any designated place duly authorized by law to cremate dead persons. ©. CREMAINS means the remains of cremated dead body of a person. d. CREMAINS CONTAINER means a container that must have a minimum capacity of 0.0049 cubic meter of polyethylene provided with linear bag (preformed Sml plastic) with locking tle and Identification label. e DEATH CERTIFICATE means a public document issued by the attending physician or In his absence, by the city/municipal health officer or other duly authorized government official, using the prescribed form certifying the death of a person. f, DANGEROUS DRUGS mean dangerous drugs as defined In Artie |, Sec. 3()), Republic Act No. 9165 or otherwise known as the “Comprehensive Dangerous Drugs Act of 2002". Such drugs Include, but not limited to, heroin, morphine, ‘oplum, cocaine or cocaine hydrochloride, marijuana, marijuana resin, marijuana resin oll,__—smethamphetamine hydrochloride = or “shabu”, methyleneoxymethamphetamine (DA) or “ecstacy”, 2 paramethoxyamphetamine (PMA), trimethoxyamphetamine (TMA), lysergic dlethylamine (LSD) and gamma hydroxybutyrate (GHB). REMAINS mean the body or parts of the body of a dead person Including cremated remains. THERMAL DESTRUCTION as defined under Dangerous Drugs Board (DDB) Board Regulation No. 1, series of 2002, entitled: Guidelines on the Custody and Disposition of Seized Dangerous Drugs, Controlled Precursors and Essential Chemicals, and Laboratory Equipment, as amended, means the action or process of destroying selzed or surrendered dangerous drugs or controlled chemicals by fire or heat of incineration. UNDERTAKER means a duly licensed person who practices undertaking. UNDERTAKING means the care, transport, and disposal of the body of a deceased person by any means other than embalming. SECTION 5. CREATION OF THE CREMATORIUM UNIT UNDER THE CEBU CITY MEDICAL CENTER [AND STAFFING. ~ There shall be created a Crematorium Unit under the Cebu City Medical Center (CCMC) and shall also be known as the Cebu City Crematorium. The Head of the Cebu City Medical Center or the Local Chlef Executive ls hereby authorized for the creation of positions of personnel among others who are licensed to care, transport and dispose of body of deceased persons, which i, but not limited to a licensed Undertaker subject to Civil Service Commission (CSC) Rules and Regulations. SECTION 6. DUTIES AND RESPONSIBILITIES OF THE CREMATION UNIT. - The Cremation Unit under the Cebu City Medical Center (CCMC) in compliance with the Code of Sanitation of the Philippines shall: b Manage and operate the Cebu City Crematorium subject to existing laws and to the provisions of this ordinance; Comply with the Department of Health (DOH) requirements for the establishment and operation of the crematorium. Prepare and submit a feasibility study reviewed by the regional health office concerned and approved by Secretary of Health or its duly authorized representative. Ensure that the Cebu City Crematorium Is duly issued a sanitary permit valid for ‘one (1) year ending on the last day of December of each year, and shall be renewed every first month of the year thereafter; and that this permit shall be posted In @ conspicuous place In the crematorlum and shall be avallable for Inspection by authorized health personnel. Ensure that all personnel who undertake the care, handling, transport and disposal of deceased by cremation must be lensed undertakers; and that undertakers must wear cover all, rubber gloves, face masks and other appropriate personal protective equipment when working. Ensure that no person shall be employed in the crematorium without a health certificate Issued by the Cebu City Health Department (CCHD). 3a Ensure that washing facilities with soap, detergents, and germicidal solution shall atall times be avallable exclusively for use of personnel working the crematorium. Ensure that no person other than the personnel working In the crematorium shall be allowed to enter the cremation room. Dispose cremated remains In accordance with the requirements of the Code of Sanitation of the Philippines, that Is, cremated remains must be reduced to the size of a fine sand or ashes and packed In cremains container or ums. Perform other duties as required by law, ordinance, authority, or court orders including among others, the burning of dangerous drugs in the crematorium as provided for by the guidelines of the Dangerous Drugs Board (008) Board Regulation No. 3, serles of 2002, entitled: Guidelines on the Custody ond Disposition of Selzed Dangerous Drugs, Controlled Precursors and Essential Chemicals, and Laboratory Equipment, as amended. SECTION 7. DESIGN AND CONSTRUCTION OF CREMATORIUM. ~ The Cebu City Crematorium shall be designed and constructed with following: Cremation Room, waiting and/or viewing room, tollet facilities, washing facilities, processor (grinder). Cremation Room separated by a transparent glass and concrete wall from waiting and/or viewing room. ‘A mortuary refrigerator/freezer for safe storage until final disposition and temporary holding peak activity or emergency situations. Sufficient firefighting equipment as approved by the Bureau of Fire Protection, Regional Office Vil (BFP Vil). Gas room/storage of concrete or impervious material and located below the ground five (5) meters away from the cremation and walting/viewing rooms. An inlet measuring seventy-five centimeters (75 cm) by seventy-five centimeters (75 em) at the cremation room ifa single crematorium equipment ls installed for proper combustion and cooling of the equipment. The Inlet may be louvered or screened and shall be located near the rear of the unit. Crematorium over with temperature of eight hundred degrees centigrade (800 C) to one thousand three hundred degrees centigrade (1300 C) with a detention time of five to stx (5-6) hours. Design of Smoke Stack in accordance with the standards of the Department of Environment and Natural Resources - Environmental Management Bureau (DENR-EMB). The City Crematorium shall be established at least one hundred meters (100 m) away from residential areas. ‘SECTION 8. GUIDELINES FOR THE DISPOSAL OF DEAD BODY BY CREMATION. ~The cremation of dead bodies shall be In accordance with the following guidelines and other related laws: 4 Family members or relative shall apply with the Cebu City Medical Center (CCMC) Crematorium Unit to avail of the services of the crematorium by presenting a valid and original Death Certificate. Dead bodies for cremation must be with known family members or relatives. In case of unknown deceased with highly contagious disease, government authorities shall request or endorse for the cremation of that unknown deceased body provided that requirements under pertinent laws are complied with. ifthe deceased body is In the custody of a funeral parlor, the application may be filed by the officer-in-charge of such funeral parior with the conforme of family or relatives, If known, and in case for unknown dead bodies with the approval of any government body or authority, such as but not limited to the Cebu City Health Department (CHD), Department of Health (DOH) or the Courts; Upon filing of application with the attached Death Certificate, the Cebu City Crematorium Unit shall check the avallabllity of the crematorium and schedule the cremation in accordance with request or the availability of the crematorium. Cremation as an alternative to burial may allow a ceremony and/ or religious or splritual ritual. ‘A cremation permit shall be secured from the Cebu City Health Department (CHD), subject to fees. However, fees may be waived upon request if the deceased body Is Identified as an Indigent resident/constituent of the City of Cebu, with family members or relatives who do not have the means to pay such fees. SECTION 9. RECORDS AND CERTIFICATES. - The Unit Head / Officer-in-Charge of the Cebu City Crematorium shall keep book of records In which shall be entered the name, age, sex and residence of each person whose body Is cremated, together with the authority or permit for such cremation and the disposition of ashes. The Unit Head / Officer-in-Charge shall complete the cremation permit, retain a copy for the record and forward the original permit to the Office of the City Civil Registrar (OCR) who shalll keep such cremation permit on file as part of the records of the local civil registry. SECTION 10. CREMATION PERMIT. - The Office of the City Civil Registrar (OCR) shall Issue a cremation permit in accordance with the following procedure: ‘The Death Certificate required by law shall be filed with the Office of the City Civil Registrar (OCCR). The Chief Medical Examiner, Deputy Chief Medical Examiner, Associate Medical Examiner, or an Authorized Assistant Medical Examiner shall complete the Cremation Certificate, stating that such Medical Examiner has made inquiry Into the cause and manner of death and is of the opinion that no further examination Is necessary. The Cremation Certificate shall be submitted to the Office of the City Civil Registrar (OccR). Upon receipt of the Cremation Certificate, the City Registrar shall authorize the cremation certificate, keep It on permanent record, and Issue a cremation permit not later than forty-elght (48) hours from the death of the person to be cremated. 5 However, issuance of sald cremation permit shall be within eight (8) hours In case of death due to communicable disease. e _ When the Cremation Certificate Is submitted to a town or city other than that where the person dled, the local registrar of such other town or city shall ascertain from the original removal, transit, and burial permit that the certificates required bythe laws, rules, and regulations have been received and recorded, that the body hhas been prepared In accordance with laws, rules, and regulation and that the entry regarding the place of disposal Is correct. f. No body shall be cremated until at least forty-eight (48) hours after death, unless such death was the result of communicable disease, and no deceased body shall be received by the crematorium unless accompanied by the permit provided for In this section. SECTION 11. APPROPRIATIONS. — For the purpose of this Ordinance, there shall be appropriated the amount of FIFTY MILLION PESOS (Php 50,000,000.00) which shall cover capital outlay, that Is, the cost of the construction of the Cebu City Crematorium and acquisition of equipment, and cover to initial fund requirement for supplies and personnel services under the plantilla of positions so created for the management and operation of the Cebu City Crematorium. SECTION 12. PENALTY. - Any person who makes any false statement In procuring any permit required by this ordinance, or who violates any provision of this ordinance, shall be fined by not more than Five Thousand Pesos (Php 5,000.00) or imprisoned by not more than two (2) years, or both. SECTION 13, IMPLEMENTING RULES AND PROCEDURES. - The Unit Head / Officer-In-Charge of the Cebu City Crematorium shall prepare the Implementing rules and procedures for the cremation as well as the burning of dangerous drugs in the crematorium, provided that the same 1s in compliance with existing government laws and regulations for the procedure of cremation, or upon court order, the burning of dangerous drugs. In the Interim, the Officer-in-Charge of the Cebu City Medical Center (CCMC) along with professionals and experts in the field of disposition of bodies by cremation to become members of an Ad Hoc Body for this purpose, shall cause the establishment of the Cebu City Crematorium and shall formulate the required interim implementing rules and procedures. ‘These rules and procedures, interim or otherwise, shall form part of this ordinance. Violations thereof may be prosecuted under Section 12 hereof. SECTION 14. SEPARABILITY CLAUSE. - If any section or part of this Ordinance shall be declared Invalid or unconstitutional, the remainder not otherwise affected shall remain in full force and effect. SECTION 15. REPEALING CLAUSE. - All ordinances, resolutions, local executive orders, or administrative Issuances or part thereof inconsistent of this Ordinance are hereby repealed, modified, or amended accordingly. SECTION 16. EFFECTIVITY CLAUSE. - This Ordinance shall take effect fifteen (15) days after its publication in a newspaper of general circulation. an by [ES ANTHONY R. The ordinance also seeks to impose penalties for persons who shall make any false statements in procuring any permit required by the said ordinance and for any violations of its provisions, as well as. provide funds for the Implementation of the ordinance. This Committee is mindful of the fact that under Sec. 8.1.7 of the Implementing Rules and Regulation of P.D. 856, otherwise known as the Code on Sanitation of the Philippines, Well enshrined in the Local Government Code Is also the General Welfare Clause which provides that every local government unit shall exercise the powers expressly granted, those necessariy implied thereffom, 2s well as powers necessary, appropriate, or incidental for its effcient and effective governance, and those which are essential to the promotion ofthe general welfare. This Committee observes that the proposed Crematorium and Cremation Unit has two purposes. The first is to provide services for those who wish to have the bodies of their deceased loved ones cremated, whether voluntarily or by order of ‘competent authority, especially in cases where the cause of death was due to a deadly ‘communicable disease It aims to cater especialy to the less fortunate who might not be able.to afford crematory services of private funeral parlors and crematoriums. ‘Considering the current pandemic and the other potential communicable diseases that pose as risks fo our ever-growing city, this would actually be a welcome additonal service for the CCMC. The second purpose is to serve as a facility to dispose ilegal substances by thermal destruction pursuant to law and the applicable guidelines. Considering the foregoing, its patently clear that the proposed ordinance falls. within the ambit of the General Welfare Clause, and thus well within the authorty of the Sangguniang Panlungsod to enact. Furthermore, its provisions appear to be pursuant to law and existing rules and regulations, and does not appear to suffer from any legal impediment. Should the Members have nothing further to add, modify, or delete, to proposed ordinance maybe enacted ins entirely However, since the proposed ordinance provides for a penalictause, it must undergo before its second reading pursuant to this Sanggunian’s House Rules. A public hearing will give any interested person, or in this case the affected establishments, ample opportunity to air out grievances or concerns, if any.
