Heard.

It is submitted by the Ld. Counsel for the appellants that the

appellants do not intend to block the said iron grill. The only difficulty of the

appellants is that if they want to get the wall supporting the iron grill painted /

renovated the respondent reports the matter to the local police station and uses

the impugned injunction order to harass the appellants.

The respondent has denied these allegations.

If so advised the appellants can file appropriate application before

the Ld. Trial Court for seeking permission to carry out necessary repairs /

renovations / painting job etc.

The respondent submits that he may be also allowed to move

similar application before the Ld. Trial Court.

The parties are free to move appropriate applications before the Ld.

Trial Court for seeking permission to carry out necessary repairs / renovations /

painting job etc.

In view of the above, Ld. Counsel for the appellants seeks

permission to withdraw the present appeal.
