(CIC) was retained by the Northampton Police Department to conduct an inquiry into allegations of Policy and Procedures violations during an arrest on April 48,2023. The complainant alleges that Office Jonathan Bartlett and Officer John Sellew used excessive force, The focus of this inguiy is determining whether Officer's Bartlet and Sellew violsted Northampton Police Department Rule 6,5, Unnecessary Force, and Rule 66, Discourtesy. For the purpose of this investigaion, CIC has reviewed all relevant documents, Policy and Procedures, recordings, and consulted with outside Use of Force experts, CIC has used those _materals to establish facts about the case and make a finding. Based on those facts, CIC's finding determines whether Northampton Police Department Rules 6.5 & 6.6 were vilated. CIC inverviewed Officer Sellew regarding the incident involving, Marisol Driovech (Ms. Driouech) on April 4, 2023. These following facts are from his reports and interview. 3. On April 44,2023, Officer Sellew was on duty. Directly proceeding the incident in question, ‘Officer Sellew was parked in the Acme Auiomotive Centex packing lot, observing trafic and ‘conducting normal duties. 4. Ataround 11:38 PM, Officer Sellew observed a black Kia Soul pul out of the McDonald's ‘atking lot on 221 King Street, Northampton, MA. 5, Officer Sellew recognized tha the vehicle had Ind intnted a motor vehicle ‘Hop, Officer Selle pled tend the vehicle and ativated his blue light, 6. Officer Sellew sated in his interview that the vehicle comtinued on for approximately 3 ‘quarter mile and did not stop because of his blue lights, so he activated his sirens, He said ‘that at that point, the vehicle pulled to the side and stopped in ron ofthe Starbucks on King Street. 7. The vehicle driver was later identified as Ms. Driouech 8, Officer Selew said that he sat in his cruiser for about a minste. He exited the crise. He {followed his usual routine, He walked up, place the hand onthe rear ofthe vehicle, and then ‘went to make contact with the diver 9, Officer Sellew reports that he began the stop by identifVing himself to Ms. Driouech. He ‘recalls explaining to Ms. Driouech the reason for stopping hee vehicle, but was interrupted by her saying, “What.” POO COO CE COE EEE EE RRR ARR AAR ATA ANI IIIA 10. Officer Sellew reported that he again sated he was « Northampton Police Department Officer and stopped Ms. Driouech because her MMIII He ded that she had filed to. stop fora Police Offices. 11. Officer Sellew recalls that Ms. Driouech ignored his statements and began explaining that ‘she was a making a food delivery fr her job asa DootDash driver. She reportedly followed this by saying, “hy yow stop me? * 12, He documented that at this time, he explained again about SUMINNIS and was further interrupted by Ms. Droucch ying, CIGNA” Officer Sellew suid Ms, riouech bbogan to play with her lights, attempting to activate the high beams in oder to foo Officer Sellew that he 13, Office Selle walked owards the front of the vehicle and pointed cu he NS. em ie iorme Ms, Driouech tat he was being sapped for RRB hat ‘he fled to step he vehicle or a Police Office. 14. Office Selew in his interview described the interaction between himself and Ms, Driouech this way: Bennett! Okay. As aresult ofthe operator interrupting you, saying what, what was the next ‘thing? Sellew Sheimmediately it appeared to me that she was trying o formulate the words to. ‘answer me, and she said in lke what appeared to be halting English. She was coming from McDonald's and was doing essentially « DoorDash delivery. No. ‘Asa resulof that, what did you sty tober? | believe requested ita couple more times aler some more interaction with her. ‘She was questioning why she said, she ssid she was stopped and pulled over and she was, she asked why or she suid she did not know I was pulling her over. said, “I's the Jaw in Massachusetts to pull over for emergency vehicles behind you.” And! mentioned that in driver's el they teach you that you're supposed to stop emergency vehicles when they're behind you and they asked for license ‘registration again. I believe 1 asked fora total of four times before 1 asked her if he Ta ‘What did she ask you about being a police officer? And at that point ster previously waiting on for backup, I ordered her out ofthe vehicle and she refused. And then she started reaching for her shier and her window started rolling out. So, thought she's about to attempt to end the stop and drive away. So, 1 reached for her door ‘and opened it It was unlocked, Ordered her out of vehicle «couple more times She refused. So, then I reached in and started to proceed to tke her out ofthe vehicle Bennett How were you dressed at that ime? Sellew My duty issued uniforms. Um, 511 blue pants. And was wearing ‘black ball ap and withthe shir stating Northampton Police Department oni 15, He recalled that he then asked Ms. Driouech for her license and registration. TS 17. Officer Sellew again asked for Ms. Driouechs license and registration. Ms. Driouech stared blankly at Officer Sellew, ignored the situation, and stated that she had pulled over. 18. Ms, Dio.) Officer Sellew recalls Ma, Driovech being ‘ncreasngly angry and tlking louse 20. Officer Selow calle in request fer ditional unit to his location, 21. Officer Sellew beeves Ms. Driowsch was pretending not to understand the situation of his requests, as she continuously tated the same story bout being a DoorDash Driver 22. Ms, Driowech reportedly sad, “Youno police offer.” Officer Sellew responded by telling het ‘that he was a Police Officer. Ms. Diouech replied, “Not” 23, Officer Sellew told Mas. Driouech toexit the vehicle. 24, Officer Sellew's report says that Ms. Driouech didnot exit the vehicle She began rolling up her window and attempted to shift into dive by reaching the gear with her right hand. 25, Officer Sellew reported that he grabbed the door handle and opened the door. He instructed her twice more to exitthe vehicle. She didnot exit the vehicle. 26, Officer Sellow stated in his interview that his adrenaline was pumping through his body because he was unsure of what was in the car with how she was being evasive and ‘uncooperative with his request and orders Hs tone and words did not deescalat the situation. 27. Oficer Sellew reached over and unlocked her seatbelt and began to remove Ms, Drouech, ‘28. Officer Setlew report indicates that Ms, Driouech IRMNEIBhis arms immediately, grabbing the ‘A and B pillars ofthe vehicle COO O OO CE COPEL OEE EE ERR AD ARIAS IAAI 29, Inhis interview, Officer Sellow stated that while the engine was running, Ms. Driousch hooked ‘one of her fet through the bake and gas pedals o try to prevent him fom geting her out of the vehicle. Ms. Driouech vehicle was a stick shift vebicle and was in neutral, 30, Officer Sellew reported tat he was able to make some progress removing her from the vehicle ‘and then Ms. Driowech hooked her left am around the seatbelt. Ms. Driouech wrapped the ‘seatbelt around her forearm, Summa Officer Sellew from bringing her othe ground. 31. Officer Sellew was workiag to subdue Ms. Driouech as she forcefully Qu Officer Sellew ‘began unwrapping the seatbelt from Ms. Driouech forearm. She began yelling and sereeching loudly, yelling for help. 32, Ms. Driowech reached towards Officer Sellew’s duty vest and grabbed his police asved baton, Ms. Driouech was able to extend the baton from Officer Sellew's holster and partially extend ae 33. Officer Sellew in his interview described how a baton is deployed this way: Bennett Okay, When you say half deployed, what does that mean? Sellew So, our police issued baton and its, it collapses into about approximately like a foo, foot and «haf and if you slam it out as you'r, like, going to punch tothe ‘ound it deploys to about three fect, give of take, and has inerements where it ides into almost like a tent pole and it half deployed where only one increment ‘came out the other one was stil inside ofthe handle. Bennett What's the purpose of it being able to deploy in that manner sometimes half, sometimes full? 999999999999 corerececere Sellew 1s used to assist usin effecting arrests by using takedowns with it and helping to {Buide offenders tothe ground. IFi's fully deployed it can be used asa non-lethal ‘weapon to help, am, disarm a suspect who may have non-lethal weapon themselves, such as maybe a large stick, a baseball bt, Something along those lines. 34. Officer Sellew noticed the baton and quickly secured her right wrist and left arm and took Ms. Driouech tothe ground. 35, Upon hitting the ground, Officer Sellew released Ms, Driouech's left arm, so he could grab the ‘baton, He threw the baton to the side. ‘36. Officer Seew stated in his interview that his radio got ripped off his ves. Ms. Driouech ripped ‘one of his magazines out of the pouch. He was trying to subdue heron the ground and wait for beckup to help effectuate an srt. 37. Officer Sellew stated what he meant by Ms. Driouech grab Bennett, Sellew Bennett Seliew his magazine out of his pouch. ‘You mentioned the magazine got taken away from you. What do you mean by that? So, on my pouch, i have my two extra magazines for my firearm. They hold 15 rounds each. And sie when she was reaching up, she's grabbing everything off my ‘vest at this point Sse grabbed one out ofits holster and threw i onthe ground, ‘And what could be te result of grabbing a magazine like that with live rounds in in ‘Asa possiblity they may intend to somehow use itor it could also like goof, ike, an accidental discharge, Very rare, but it could happen, n CEO OO OEE OOO COE EEE ER REBAR AIAN SAA IAAI 38. Officer Sellew stated he kept saying, “HIME " And ot one point said, “WI —_ 39. Officer Sellw stated Ms. Driouech was sereching and yelling for help prety much the centre time 40. Officer Seilew got Ms. Driouech’s arms behind her back and she began to roll around, continuing to yell, ond a. 41. Inhis interview, Officer Sellew stated when Mi Driouech went to the ground it was in between his marked cruiser 52 and her Vehicle. They were inthe rosdway on King Stret, on the edge ‘of the double lane road, heading northbound towards te intersection of Damon and King. 42. Officer Jonathan Bartlet (Officer Bartlet) arrived on the scene and ran over to ssist with reatrsning Ms, Driouech. Officer Sellew told Officer Bartlet that she had taken his baton. 43. Ms, Driouech continued to keep her right arm pinned underneath her body, the to officers to handcuff her. Officer Butet twice told Ms. Driouech to Sm 44. Ms, Driowech did not so Officer Barltt deployed 0.C. spay. The spray did nat appear to have another effect, so Officer Burlett again released a burst of 0.C. spray. 45.Ms. Driouech continued @agMfor approximately 10 seconds ater the second O.C spray before ceasing ER ‘46, Officer Sellew noted in his report that his Use of Force increased when Ms. Driouech grabbed his baton, The police baton, Officer Sellew noted, when used improperly on the head and neck ‘area can be extremely dangerous forthe officer. u COE OC ECO EEE EERE RRR ARIAR AANA IAAI 47. Officer Bartlet ordered Ms. Driouech to again or she was going to get sprayed. (Ms. Driouech kept so Ofer Bartlett deployed his OC spray twice, for half second ‘bursts, towards the head area, 48, Officer Sellew stated after about 10 seconds or so, Ms. Driouech started to calm down and said, “Wty do you do thar?” 49. The officers were able together arm free and place her in handcuffs arms to rear. 50. Officer Sellew was asked why he didn’t wat for backup. Bennett Sellew ‘Olay. Is there a reason why you chose to yank her out ofthe ear and net wait for ‘backup in that situation? | fek.as though she was going o try to flee the scene and by her reaching for her shifter and rolling up the window, she had, in my opinion, was intending to end to stop herself and drive of. And I just ft as though my belief was there may have ‘been something dangerds in that car, but the way she was acting towards me, being ‘evasive and uncooperative. So, | didnot want to sk tht going anywhere whethet {tbe a gun, drugs or something else, maybe if there if there was ay in the er. S, 1a, like, I'm ay to prevent her from leaving. ‘At a certain point, did you determine you were going to place her under arrest? Yes. ‘And wien was that? When she QQRBIIIINN and I called for backup. 1 knew I was going to take her out of the vehicle and ares her 99999999994 PPE RARAR AAR AAA coereccecerer ‘Officer Sellew stated during his interview. “J jurt want osay that during the altercation, when she took my baton, her department policy ‘and my training through the MPTC and their use of force continuum, righ there I could have ‘been cleared to use a series of strikes or possible more lethal force because the baton i a metal 10d that could inflict serious or Bodily injury. But I did not because I felt as though I could ‘control her with ust my hands and physical force alone.” 51. Lieutenant Brian Letzeisen (Lisutenant Letzsisen) and Ariangna Gonzalez (Officer (Gonzalez) sppeared on the scene shorly afte. ‘52. Officer Gonzalez is a police officer in the Northampton Police Department. On April 48, 2023, ‘she was called to provide assistance. Once she arrived, he was asked to translate. Officer Gonzalez spoke to Ms. Driovech in Spanish. 53. Officer Gonzalez told Ms. Driouech in Spanish thatthe officer was trying to stop her. Ms, Driouech said that she came out ofthe MeDoriad's and she saw lights so she stopped. ‘54, Officer Gonzalez asked her what happened ater the stop. Ms, Driowech said hat she was going, ‘to give him his MHHMM, but that she said that he was being too aggresive with het. Mi. Driovech sid that he took her out the car and dragged er on the cement and her face was scraped. She said that she's not a threat and mentioned her height and weight. 55. Officer Bartlet is employed by the Northampton Police Department asa police office. He ‘woe a report regarding this incident. He was also interviewed regarding tis incident. ‘56. On April 4*,2023 Officer Bartlett was on duty asigned to downtown patrol, 51. Officer Bartlett was responding to separate assignment related to the point of inuiry inthis cease, He received a radio transmission around 11:43 P.M. from Officer Sellew requesting COO OOOO COEOE. COEFF EEO R AAR ARANDA backup. He reclied the transmission, “was scratchy, unreadable, anda female could be heard’ screaming inthe background.” 58. When Officer Bart arived on the seme, he observed Ms. Drovech NSAIMIN® snd MURINE hance. He decided that boca MIME bad been active on the side of the road for many minutes, any vebaldeeacalation tts pont would not work. 59. Ins interview, Officer Bartlet stated thee was equipment in the roadway including Officer Sellew's radio and baton. 60. In his interview, Officer Bartlet stated he did not knaw Ms. Driouech 61. Officer Bartlett verbally instructed Ms. Driouech that if she did nt ESN he Would ‘administer 0.C. pray. Ms. Driouech continued @iBmmag and Officer Batt administered 2% second burst of Department Issue Saber Red Oleoresin Capsicum Spray. (2, Officer Bartlett observed thatthe spray didnot have the desired effect of ending resitanee, 20 he administered another 4 second burst of O.C spray. This time it was sprayed more directly to the eye area. Officer Bartlett recorded that immediately after the second spray, Ms. Driouech StoppecMNBER ond sid, “Why you do hat.” 63. Inhis imerview Officer Bartlet stated: ‘Bennett And what was your thought process as far as using OC spray? Bartlett The suspect had at that point very clealy in my perception SMR OfTcer Sellew of his baton and potentially also of his radio. Ske was actively IND (Clasping her hands together. So, I elected to spray her with OC in order to disoient Ine and effectively place her inthe handcuffs. 64, Officer Sellew was then able to secure handcuffs on Ms. Driouech. (65. Officer Bartlet pulled Ms. Driouech to her fet, searched her, and placed her under ares the back of Officer Sellew’s patrol car. Officer Batet reports thet while attempting to place her in the back of Officer Sellew’s exr, Ms. Driouech ammmNMPby Licking, screaming, and overall BMsitting inthe vehicle, (66.0n April 5%, Lieutenant Letzssen informed those present athe Cornmand Staff Meeting that hhe had concems about an ares ffom the prior night. Liewtnant Letaeien recommended that ‘the arrest should be reviewed by the Department. 67. Cruiser footage from the arest was captured by the WatchGuard System and used for the 68, Northampton Police Depertment Captain Caputo determined that tree aspects ofthe arrest ‘needed to be reviewed. He wrote in a memo to Chief Kasper, thatthe inital review was regarding, “The use of force lel the requirement for de-escalation contained within our Use of Force Policy (AOM 0-101) and Rule 6.6 discourtesy.”" (69. The reviewers ofthe Response to Resistance Report went over the Departments Policies and reviewed the WatchGuard Footage 170. The review team found that the Use of Force during the arrest was within policy. Furthermore, they determined Rule 6.6 was not violated during the arrest, given tha the language was used in order to contol a tense situation ‘71. The review team did believe that oe of the arresting Offices, Oficer Sellew, had room for improvement on de-escalation during the early pars ofthe interaction. COTE OEE COOP CEE EER EIB AAADAANAAIIAIIIAIAIAAY 72. Based on the findings of the review, the Northampton Police Department put Officer Sellew through various activities and training to improve on bs de-escalation tactics, Detective Beaver ‘Conducted Remedial Defensive Tactics training with Officer Sellew. That session inchuded ‘taining related to de-ecaltion and finding various approaches that could have helped Officer Sellew in scenarios similar tothe April 4# arrest. Lieutenant Letzesen went over the arrest with Officer Sellew and discussed areas to improve and what futue training he would be tending, The Peer Support Team reported no problems with Officer Sellew. Leadership Within the Northarapton Police Department all said Officer Sellew was receptive to traning and showed a positive atitude towards learning anything that could help him as an Office. 73. On May 1*, an additional review process began, as Chief Kasper passed along o lene of complaint to Captain of Operations Caputo. The letter was «formal complaint from Sap (mw + fiend of Marisol Driouech, concerned about the manner in which her fiend was arrested, 74. The letter was sent on April 26* by IMIR In the leter, she requested that the arrest on ‘April 4% be thoroughly investigated. ‘QIMIMIND alleged that her friend was stopped for & (SURNNNGRG The eter alloges that Ms. Driovech was pulled from her car and “thrown (on the ground," GERRREEEN claimed her fiend was struck in the head, pepper sprayed by (Officer Jonathan Bartlet, and her glasses were broken. SUNIMNUMNBD reports that she saw Ms Driouech 12 hours after the arrest and that she was, “raumatized, badly Bruised, her head had many swollen welts." MIU expressed her shock from the incident and concem over police conduct. 75, After receiving NMS eter, Capain Caputo reached out to her and explained the sinaton. On June 128, retired Police Chief and current DT Instructo/Use of Foree MPTC, Francis R. Fox Jr. released his findings on the arrest. Mr. Fox informed the Northampton Police Department that in his expert opinion, the Use of Force was not violated by Officer Sellew or Officer Bartlet. He recommended tht Officer Sellew could benefit fom further training in de-escalation and communication skis, 18. MII expressed thoes actions wore nti nd that she would ike fo olect her ‘thoughts and proceed with a complete formal complaint. Captain Caputo stated to that «formal complaint in these situations had tobe completed by ax ouside investigation. MRE stated that she would like the outside investigation to be conducted. 79. CIC reached out to@NEEpand asked if she was willing to be interviewed (NII at fest agrecd tobe interviewed MMs indicated that she woud not be interviewed. ‘She indicated Ma, Drouech had an storey and it was Me. Drioech's wich tha SIN ote fterviewed MMMM also indicated Ms, Driovech did not want to be interviewed. 81. CIC sent Ms. Driouech two letters. One was writen in Spanish and one was in English. They ‘both asked if Ms. Diouech if che would be interviewed. She didnot answer either eter (CIC's Use of Force Expert's Analysis (CIC retained Charles M, DiChiara to evaluate the Use of Force of both Offizer Bartlet and Officer Sellew. Excerpts from his report are included inthis section. Mr. DiChiars's report in it entirety included as Exhibit #1. Thave been a police officer since 1989, beginning withthe North Andover, Massachusetts Police Department, before transferring to the City of Waltham Police Department in 1997. 1am currently the Training Officer forthe Waltham Police Department, as well as an InstrctorIraner forthe Municipal Police Training Commie. 1 have tained both recruit ‘and veteran police officers in the areas persining to Use of Force, Defensive Tactics, ‘Firearms and Patrol Procedures, | was asigned othe Northeast Massachusetts Law Enforcement Council's regional SWAT ‘eam for the past 30 years, having participated in excess ofa thousand SWAT operations. In 2014, 1 was a contibuting author tothe rewrite of the Defensive Tactics Instructor ‘Manual for the Municipal Police Training Commitee, In 2018 1 assisted with the revamping and rewrite of he MPTC’s Basic Recruit Academy Training Program for police recruits in the areae of Use of Force and Arrest and Control In 2014, [attended the Force Sclence Institute in Washington D.C to become a certified analyst in human behavior ait elates to use of force evens.
