Benefits Under EMLL

Paid leave benefit granted to a qualified female worker in the public


and private sector, for the duration of:

➢ 105 Days – any instance of live childbirth (normal or )


➢ 120 Days – additional 15 days for solo parent under R.A. No
8972 or Solo Parents’ Welfare Act
➢ 60 Days – miscarriage or emergency termination of
pregnancy (ETP) including stillbirth
Employed female workers shall receive
FULL PAY which consists of:

SSS Maternity Salary differential to be


Benefit paid by the employer
Benefits Under EMLL

Option to extend for additional 30 days without pay in case


of live childbirth, provided that the employer shall be given
due notice.

Paid maternity leave and allowances and benefits granted


to female national athletes; and

Health care services for pre-natal, delivery, postpartum and


pregnancy-related conditions as governed by the existing
rules and regulations of the PhilHealth.

AMOUNT OF MATERNITY BENEFIT
✓Daily Cash Allowance equivalent to 100% of female member’s

SSS shall pay directly to:


✓A member whose contingency occurred while employed but later
on became unemployed, was temporarily laid off, or her company
is on lock-out or experiencing a labor strike.

✓An unemployed, self-employed, voluntary member,

MANNER OF ENJOYMENT OF THE MATERNITY BENEFIT
▪ Availed of in a continuous and uninterrupted manner.

▪ Can be credited as a combination of prenatal and


postnatal leave as long as it does not exceed 105 days,
120 days, or 60 days, as the case may be.

▪ Postnatal care shall not be less than 60 days.

▪ Granted in every instance of pregnancy, miscarriage or


termination of pregnancy regardless of frequency.
MANNER OF PAYMENT AND REIMBURSEMENT

THE EMPLOYER SHALL PAY
IN ADVANCE THE BENEFIT
WITHIN 30 DAYS FROM
FILING OF THE MATERNITY
EMPLOYER EMPLOYEE LEAVE APPLICATION.

THE AMOUNT ADVANCED


BY THE EMPLOYER WILL BE
REIMBURSED 100% BY THE
SSS THRU THE EMPLOYER’S
EMPLOYER DISBURSEMENT ACCOUNT.

Photocopy of member’s SS card or two


valid IDs both with signature (at least
one with photo) duly certified by the
member and authenticated by the
authorized company representative.
DOCUMENTARY REQUIREMENTS
For Solo Parent
Valid Solo Parent ID issued by DSWD
For Employers filing maternity reimbursement claims of their former
female employees who were not able to submit the required
documents:
✓ Maternity Notification duly received by SSS either thru SSS web or over-
the-counter (OTC);
✓ Proof of pregnancy submitted by the female member to the employer;
✓ Proof of advance payment of the SS maternity benefit to the female
member; and
✓ Certification from the employer that the employee no longer returned
for work after giving birth/miscarriage/ETP.

COVERAGE

For Maternity Benefit Application (MBA)


• All female Self-employed (SE), Voluntary Members (VMs),
Overseas Filipino Workers (OFWs) and Non-Working Spouse
(NWS); and
• All female members who are separated from employment
and did not receive any advance payment of maternity
benefit from their employers.

For Maternity Benefit Reimbursement Application (MBRA)


• All employers including household employer.
PRE-REQUISITES FOR ONLINE APPLICATION

• registered My.SSS account

• disbursement account enrolled with SSS through the


Disbursement Account Enrollment Module (DAEM) in
the member’s My.SSS account.
POLICIES

Grounds for adjustment of maternity:

1. Member is qualified as solo parent;


2. Correction of type of claim
• From normal to caesarian delivery; or
• From miscarriage to ectopic pregnancy with operation;
3. SSS’ computation is higher than employer’s computation;
4. Additional posted contributions will increase the amount of
maternity benefit;
5. Correction of approved number of days from 60 or 78 days to 105
days; and
6. Allocated leave credits not used due to separation from
employment of the child’s father or qualified alternate caregiver
POLICIES

Confirmation of advance payment:


Employee shall confirm/certify receipt of the advance payment
made by her employer within seven working days from the date
of sending of e-mail by SSS.

In case employee confirmed that she did not receive the


advance payment or she failed to act within the prescribed
period, the MBRA shall be rejected.

Said confirmation/certification shall be submitted through any of


the following channels:

a. Link provided in the e-mail notification sent by SSS; or


b. Employee’s My.SSS account in the SSS Website.

Employee’s confirmation/certification shall be submitted via:

a. The link provided in the e-mail notification sent by SSS;


or
b. employee’s My.SSS account in the SSS Website.

This confirmation/certification shall not be required for


claims tagged as separated, absence without official leave
(AWOL), and deceased member.

For MBRA – the date of confirmation/certification of the


employee or the date of successful submission of the
claim if the employee is already tagged as separated,
AWOL, or deceased

Refiling of claim:

✓ Rejected claim due to non-receipt of advance payment


made by employer or failure to confirm/certify receipt of
said advance payment within the prescribed period.

✓ A claim which was previously submitted but was not


accepted based on the evaluation made by SSS
