MOHINDER PAL ALIAS BINDER V/S STATE OF PUNJAB

Present: Mr. S.S. Bhinder, Advocate for the petitioner.

Learned counsel for the petitioner submits that as per
allegations in the FIR, the son of the complainant was a drug addict and he
was earlier admitted in De-addiction Centre and after two days of his death,
the complainant levelled allegations against the petitioner and his family
that his son was killed by them, the case was registered under Section 307
of IPC. He further submits that as per the MLR (Annexure P-2), the injury
has been shown to be abrasion on the left cheek and sutured laceration over
the chin which was around 2.5 cm. None of the injuries was dangerous to
life. Learned counsel submits that the son of the complainant was
discharged from the hospital and died one month thereafter. The injuries
suffered by the son of the complainant were not anyway connected with his
death. Co-accused, namely, Bhag Chand @ Bhaaga has already been
granted concession of interim anticipatory bail by the Co-ordinate Bench of
this Court (Annexure P-4). Learned counsel, therefore, submits that the
petitioner is ready to join the investigation as and when required by the
Investigating Agency.
Notice of motion.
On the asking of the Court, Mr. Jaiteshwar S. Bhandari, AAG,
Punjab, accepts, notice on behalf of respondent-State.
Adjourned to 27.02.2023.
Meanwhile, in the eventuality of arrest of the petitioner in the
instant case, he shall be enlarged on interim bail subject to his furnishing
personal bond/surety bond to the satisfaction of Investigating
Officer/Arresting Officer. The petitioner shall join the investigation as and
when called upon to do so by the Investigating Agency. The petitioner shall
abide by the conditions as laid down under Section 438(2) Cr.P.C. in letter
and spirit.
